Showing intent might be difficult if the assault was part of the robbery. Felony murder is a slam dunk. What does 'hate crime' add to a 25 to life sentence?

Legitimate question. If all of them are, perhaps they should be charged with a hate crime, since the guy they murdered is hispanic.

How do you know if teacher is a caucasian or black checking to see if they are black, and not caucasian, or checking to see if they are caucasian and not black. So implying the reference 'white hood" is demeaning to both white or black. So have they released the names or pictures so we can "determine" the reason this guy got killed. And if they did not have the intent to kill then it isn't murder.

This attack was an act of "fun" - the game many youths play on the streets of Jersey City is called "knock-out". Groups of them run up on random people, jump them, beat them, and steal from them if they can. Not too sure more options for recreation in this city will be able to compete with this kind of "fun". It all boils down to parenting or lack there of.

This is sad and senseless. I'm glad these 8 punks are off the streets and are old enough to be charged as adults.

Nice work JCPD. Hopefully these "kids" will be charged as adults and rot in jail. If they are charged as juveniles, they will likely be out of juvie in time to celebrate their 18th birthday (probably by jumping some other poor bastard).

Good job JCPD for the quick arrests and resolution. Why are the charge only aggravated assault? From my understanding that's when you punch somebody etc...in this case shouldnt it be at least manslaughter? I mean they beat the guy almost to death with a brick for chris sake, and it's not an accident either.

NAME & ARRESTS Cops ID victim charge 8 teens
Tuesday, March 03, 2009 By TOM SHORTELL JOURNAL STAFF WRITER Jersey City police have arrested eight teenagers for Tuesday night's brick attack that sent a 26-year-old Jersey City man to the hospital in a coma. Police have identified the victim, but wouldn't release his name yesterday. The teenagers, all boys from Jersey City ranging from ages 13 to 17, have been charged with aggravated assault, robbery and various weapon charges, police said. Tips led to the arrests that took place between Friday and Sunday night, officials said. The teenagers have been remanded to the Secaucus Youth Facility, police said. At least one of the teens has a prior record, police said. Police said the eight teenagers attacked the victim as part of a robbery at Cornelison and Florence avenues Tuesday at 8:06 p.m. When the victim resisted, the teens struck him in the head with a brick, sending him into a coma, police said of a witness's account. The victim's identity has not been released because police have not been able to contact the family. The man has not regained consciousness and remains in serious condition, police said.

The victim still hasn't been identified per NBC 4 News @ 6.
This poor guy gets savagely beaten and after 5 days has not been identified and based on the pic from the news, looks like he can't even speak. The parent(s) need(s) to get a grip on the kids and these kids need to step up and take responsibilty, but it just looks like a lost cause.

ok heres some ideas to deter crime.
1. an ankle tracking device that also acts as a shock collar. it will go off if 2 convicted felons with these devices get to close to each other or if a petafile gets within a certain distance of schools etc. 2. lets join the 40 other states that allow the right to carry. Unlike other states NJ can lead the way in gun safety by having mandatory strict testing for all carrying civilians and make them carry gun insurance. it would be a great tax revenue for a state that loves to tax the life out of us. 3. mandatory death penalty for any 1st degree murder. I dont care if it doesnt deter crime. little chance of a dead man escaping jail.

Where this attack happened is also a stone's throw away from the police station at the base of the Beacon on Cornelison Ave and Bright.
I've walked past this intersection a number of times taking a shortcut up to or back from the Heights. I've always felt at major risk walking around there. It is desolate aside from a lot of thug/crackhead types milling around the fried chicken and Chinese food place at Florence and Montgomery. This doesn't surprise me one bit. If the cops had any wits to them, they would have installed cameras around this area a long time ago.

That would be helpful if the residents of the beacon didn't have to come out of the gate every once and a while. It also presupposes that some thug cant climb a fence or sneak past a security guard sleeping in a booth. Pleasant dreams.
