If you do move forward with a suit, expect it to take a long time and it may cost more money than you'd gain in a settlement or an award. If you do hire a lawyer, you'll have to be very proactive in your case and make sure things occur as they're supposed to. Dealing with lawsuits (on either side) and lawyers is not all that pleasant. And you can still lose no matter how strong a case you may have.

Supposedly, the FICO formula takes into account that people may shop around for mortgages, therefore generating multiple inquires, and takes this into account when calculating your score, so as not to harm your rating.

That's a myth, also you should always go to a bank instead of a motgage company. Banks have a better reputation plus they don't sell you loan to other mortgage companies. Smaller "mom & pop" banks are competitive and are more apt to approve you loan. Remember with condos the building has to be at leat 70% owner occupied to make the building more attractive for the loan application approval.

If you engage in business with behemoths like Chase and BofA, then you deserve whatever misery befalls you.
There are dozens of options better suited for us Joe Schmoes. Regionals (Valley National, Provident), credit unions (for a small donation to a military family support group you can join the Pentagon Credit Union), and online banks (ING Direct.)

You have to realize that Chase has the resources and time to spend fighting your gripe with 100 lawyers that have nothing else to do but bust your chops. No different if you were trying to sue the IRS. What do you really think your chances are of getting anywhere? Get over it and move on and try someone else. Unless of course you have $100,000 nest egg account that you're willing to blow for the hell of it.

Agreed that trying to refiance with your existing mortgage company is a waste of time. When I did my re-fi last year, I called everyone (banks, brokers, etc), and my exisiting mortgage company (Bank of America) - guess what, BofA quoted me the highest rates and fees. I just took it that they don't want my business anymore, and accordingly, I took my business elsewhere. Take that BofA (not that they care, and sadly, that's where the problem is!!!).

Dealing with your current lender on a refinancing is just about the worst way to go. Think about it. They have no financial incentive to move you into a loan that pays lower interest. I called my lender, Bank of America, and the mortgage "specialist" on the phone did everything to discourage a refi - even though my FICO scores were excellent and I wasn't underwater on the loan. As others have said, try one of the smaller community banks, or a mortgage broker. You may end up paying somewhat higher fees with a mortgage broker, but he/she doesn't get paid until your loan goes through. A good one also does all the work hustling your application through all the bureaucracy. Also, if your current loan is underwater or your credit score isn't great, the mortgage broker may be able to come up with refinancing solutions that your bank can't or won't - though you'll still end up paying a higher rate than a "prime" borrower or be forced to pay mortgage insurance. Just weigh all your options carefully, and be shrewd enough to realize that a broker makes his living from fees and commissions, which he does have to disclose.
Also, be aware that your refi application can be rejected simply because you live in a condo and the building doesn't meet certain criteria. A bank could reject you if the owner occupancy ratio of your building is too low, the HOA's reserves are too low, or the building carries insufficient insurance. All these hurdles are a hassle, but imo, these are standards that should've been in place pre-2008 but sadly weren't. A lawsuit would be a waste of time and money. Unless you can prove your loan application was rejected on the basis of race or gender, the bank is legally in the clear.

It also helps if you can show them that you are not only employed but have considerable savings or assets. You could also offer to pay more in monthly payments for a set period of time and then have them refinance. Of course this all depends if they even want to play ball with you.

Check your credit rating. I'm not on the side of big banks and I don't know you, but in 2 minutes I looked up your account on the Jersey City - Online Tax Inquiry and saw that in the last 4 years your real estate taxes were paid late 14 times and on time only 2 times. If I could do this, I'm sure the bank is also looking.

Some lenders allow something called a "Loan Adjustment" which lets you take advantage of a new lower rate without going through a refinance process and new closing etc.
I did this with my lender, Haven Savings Bank in Hoboken, Robin.

You're not going to get anywhere - take it from someone who has been dealing with BoA.
There are intricacies of every mortgage product that can make it either complex or simple the refi. One example being leader payed PMI... Aside from not knowing your credit rating, the amount of equity that you have in your home, what the home is valued, etc., etc., etc. you are likely in no position to sue them. The lawyer will be a no good and you will have wasted more money. I have personally wasted $500 on a home inspection that resulted in a failed refi... As an aside and a bit of my own rant... it is COMPLETE BS that as an individual that has never missed a mortgage payment and has excellent credit that I cannot refi to take advantage of lower rates... I am in essences paying for the failures of my home buying peers. There apparently is no reward in doing the right thing.... Although something that I wouldn't consider... if you really want to screw the man... file bankruptcy

Have you tried just going to a different bank? I strongly recommend Bayonne Community Bank if you have a property that doesn't fall into a conventional category (i.e. a residential building under an LLC).

I need a good lawyer. Chase bank for the thrid time is denying me a refinance. Just last week they sent me a pre-approved letter. I'm working, sent in w2's, letter of employment. I even have my own FREAKING COMPANY and am putting people to work.
I'm livid right now and am going to sue them. Everybody and their brother got theirs in the 2008 financial crisis. I was out of work for a year and a half. Tried to refiance under the original TARP because I experienced hardship. NO.... Then they pulled this same shit on my last year charging me $395 and saying no, keeping the money. And now this... I need a really good lawyer. Please advise. Thank you. FG
