I too fell right by the PATH machine before turnstiles on Mon, Jan 25th, the day it was pouring rain with 60 mile an hour winds (I remember day as had to be in downtown brooklyn that morning) and who should be there to help me up by Councilman Fulop!
The guy seems to be everywhere helping these days.

The reason they do not fix the ramp is because it would be extremely costly to do so. I am disabled and the ramps there are so steep they hurt my back tremendously.
The bureaucracy that would be wrapped up in just doing the drawings and specification for the flooring would cost millions. never mind who has any idea if the slope ratio is correct. Instead they put out the walk off mats in the rain probably because of the cost. What station besides Journal Square is actually accessible? Pavonia is not really, Grove is not. I have no idea about Exchange Place. Only 33rd in the City is accessible.

I've slipped on this ramp a few times, even though I'm pretty careful, and I can't tell you how many others I've seen do a complete wipe-out esp when people are rushing in the morning. That rubber mat they put out during rainy/snowy days is useless and gives a false sense of security. I've seen one lady fall even though she was holding onto the rail. I don't know if $7 mil is too much or too little, all I know is that I understand why there would be a legitimate lawsuit here.

If she really was unable to continue her career, then $7M for a doctor's lifetime is not so outrageous when combined with pain and suffering. But she seems to still have a career, so I don't know how this all reconciles with the award.

I think the jury only decides if there was negligence or not. The award amount is determined by the lawyers and ultimately the appellate courts, where they are often reduced. I am not a lawyer, though, so I may be wrong.

OK, so I want to throw this out for general discussion.
Pretty much everyone who has responded on this thread agrees that this award is too high. When an accident is reported in the news (like the LightRail accident) on this site and others that I visit, respondents can be counted on to comment about an expected lawsuit and payday for an undeserving victim. Politicians and political pundits are commonly complaining about our litigious society, etc. Just walking on the street, I hear people say things like "Careful of that ____ there. Someone's going to trip on that and sue for a million dollars." You get the idea. Next Point: These are awards made by a jury. A jury of our peers. So why do people, presumably like you and me, make these awards? We all agree that seven million dollars, in this case, is ridiculous. Is the jury not made up of people like you and me? Or did this jury learn something during the course of the trial that we don't know from the news reports? Is there another explanation for the difference between our's and the jury's viewpoints? Anyone have any thoughts on this?

The doctor will be successful regardless of her right arm.
She said that she can't do pap test anymore? My internist is also a doctor with NYU, and she said that she doesn''t know any internist in New York City that does pap test. A rape victim only got $760,000. They should switch the award. The rape victim should get the $7 million, and the doctor should get the $760,000. Hudson jury awards $760,000 to woman raped by 2 NJ Transit cops she had asked to protect her

The ramp I am referring to leads up to steps going to the platform. People with disabilities can use the neighboring ramp, which is adjacent to the elevators. And by the way not all PATH stations have disability access.

Isn't the ramp required by the disabilities laws? I know somone who fell there and broke her wrist. How many times do people have to be injured in the same spot for the Port Authority to come up with a practical solution for the ramp to be wheelchair accessible AND safe.
And I expect that judgment to be cut down on appeal....as they generally are.

It seams the issue of problems with the pedestrian ramps at the Pavonia (Erie) station have been complained about for some time now.

clutz or is it a clear case that duty of care and negligence to provide public safety when conducting business - did they forget to mitigate risk with their operation and short cuts taken ($).

While that judgment seems a bit high, that ramp really is deadly. I've slid in sneakers, dress shoes, and hybrids. A pregnant friend almost slipped with rubber-soled shoes.
They should resurface it with something slip-resistant. I wonder how many folks have busted their butts there and never bothered to complain.

7.2 million from a jury at a time we have 19 year old kids coming back from a war without limbs and getting nothing but good will.
Makes me ill. Is there a single person here that would defend that judgment?

7.2 million for someone with no patients renting a single dirty room in brooklyn who manages to reopen her practice bigger and better after the accident?
http://www.positivehealthpc.com/biography.html Absurd indeed. If you fall down, it's your own damn fault. Wear more practical shoes, watch where you're walking and hold onto a railing. Don't blame others for your being a clutz.

That ramp is mighty slippery. I slide on it when it's wet. Wonder how they can make it safer?
A jury in Hudson County has awarded $7.2 million to a doctor who sued the Port Authority after she fell and broke her elbow on a ramp at a PATH station. http://www.nj.com/news/index.ssf/2010 ... er_port_authority_to.html
