I agree with others that you should look for a new apartment. I would think that if your landlord is being soft on your neighbors, he will also be soft on you and let you out of the lease. Your apartment sounds like a dangerous place to live, with mold and everything else you describe.
I would also call the numbers others have provided, though I can see why you're hesitant about taking an action that could leave a family homeless. But definitely take charge of your own situation and find a new apartment.

Sorry you aren't receiving more useful advice here and other people have this holier-than-thou attitude about you identifying the family below you as immigrants. Anyway, you probably do have some kind of legal option against the other tenants and/or your landlord, but it would probably take way too long to get the wheels in motion (especially with the courts backed up the way they are right now) while you continue to suffer. All I can suggest is that you look for a new place. Moving sucks, but so does breathing in mold. If the landlord refuses to let you out of the lease and/or won't return your security deposit, gather as much evidence as possible (i.e. pictures) of your apartment's uninhabitability and move out anyway, then deal with it in the courts later. Probably not what you wanted to hear, but how much longer can you continue to live this way?

It seems like there are a lot of these situations popping up (I have another thread that went nowhere about a friends whose landlord is more concerned about saving his floors by putting heat over 120F in the place, rather than dehumidifiers and cleaning baseboards, replacing drywall and insulation from the flood waters which was sewage water). It seems so many issues are popping up where landlords aren't doing what they should.
I hope people can help guide us here....

I live above an immigrant family of 6 whose apartment had 5 feet of water during the storm. After the storm, they dried out their things and went right back in. The landlord wants to gut the place, but the family refuses to move out, insisting it is fine but only because they have nowhere else to go. Meanwhile, my apartment upstairs smells like a dead body and the roaches and mice from their place are now overwhelming. The allergic reactions I've been having from their dirt and mildew getting into the air have made it inhabitable. My roommates and I have talked to the family, but the father is a stubborn man and now appearing somewhat delusional. The landlord is being extremely soft on them since they will be homeless and hasn't made a strong effort to get them out. We have withheld rent but I would much rather be able to live in my own apartment. Surely they can't just refuse forever, this has to be some sort of health violation? Any advice is appreciated.
