I think many of you are missing the point of a corkage fee. Think about it. BYOB is a beautiful thing and even with a $5 or $10 corking fee you are saving a ton of money not having to buy the establishments wine from a glass or a bottle. At $1.25 per person it's a small fee to pay for the privilege of bringing your own wines.
Also, keep in mind that it's the responsibility of the server (Sommelier if they have one) to serve it correctly. Which means if a person brings in a bottle of wine (that should be cellared) at extremely warm temperatures they could get a bit angry at the temperature that they brought it in and want the restaurant to rectify the problem. Shocking and old bottle of Bordeaux in a bucket of ice is not the best road to take..... Note to The Dopeness: "Corkage free nights" seems to be gaining in popularity.

Corkage fee is an instant turn-off; it is like a cover charge to me. I'd feel ripped off paying it. Why go there if I can eat elsewhere without having to put down $5 for essentially nothing.

http://www.nj.gov/oag/abc/faqs.html Are non-licensed restaurants permitted to allow customers to bring their own alcoholic beverages (byob) for consumption with their meals? Unless there is a local ordinance prohibiting it, customers of an unlicensed restaurant may be permitted by the ownership of the restaurant to bring and consume only wine and beer. The restaurant can supply glasses, ice, etc., but may not impose a cover, corkage or service charge. Also, under no circumstances may spirituous liquor be permitted. There may be no advertising whatsoever of the fact that wine or beer may be permitted. Additionally, the owner may not permit wine or beer to be consumed during hours in which the sale of these products is prohibited by licensees in that municipality, nor allow consumption of beer or wine by persons under the age of 21 years or by persons who are actually or apparently drunk or intoxicated. (N.J.S.A. 2C:33-27).

Gotta say that I agree with the general sentiment that the Dopeness response, as stated (all caps, confrontational tone, etc.) was rather off-putting. I am all for supporting local businesses, and go out of my way to spend a decent amount of money every month eating at local places, but I will not be supporting this business anytime soon.
You've got some major stones to come in here with a surly attitude while trying to get a new business off the ground. Very uncool, and unprofessional. Some would say not dope, at all.

2 things first I think the name of the place is out of place. And no I have not tried this place yet.
second what if we brought our own cork screws ? It's not the customer's fault if a restaurant owner couldn't get a liquor license, they should think about that prior to opening.

Could someone else elaborate/clarify this "setup" fee? In the state of New Jersey, it is illegal for a restaurant to impose a cover, corkage or service charge when it lacks a liquor license.
Is it fair to the restaurant? No, as they do incur some expenses, such as providing stemware, service, clean up, etc., but it is the law. In their (possible) defense, they may not even be aware of the law, as I recall something similar happening with another local restaurant some time ago. Once they were made aware of the law, they stopped charging the corkage fee. There was a thread on that here in JCLIST, but I am too lazy to look it up right now.
