If you're really that concerned about whether or not you can get a ticket for riding a bike drunk, you might want to spend more time browsing AA meetings.

To the last 2 post. Yes a pedestrian always has the right of way. I'm not sure of their rights if they are, say, crossing on a red light.
K-Lo, I don't want to speak for brewster, but I think he was referring to a few lights where the walk/don't walk signs correspond exactly to the lights. There are some intersections designed to give cars or pedestrians extra time.

If the car has a green to turn, doesn't the pedestrian have the same green light to walk? The Don't Walk is flashing as a warning the same way a yellow is a warning. (And yes, I walk, bike and drive too.)

You get a short enough time to turn as it is, yet they force a confrontation. Making a L out of BJ's onto Marin is bad for this, as are numerous spots in Manhattan. When I'm walking, I respect the turn light.

Going the wrong way on the one way street poses a major danger to pedestrians who are looking only way for traffic.

When I was in undergrad after a long night out I got a call from a girl I wanted to go see. I decided to be safe and pedal there as I was in no shape to drive. I started the ride in all kinds of good spirits. I ended with a fractured scapula, a broken collar bone, and a bunch of road rash. At least nobody else was involved and the bike wasn?t even scratched. I considered it a good lesson learned, hah!

Recently I was stopped at the 6th St light on Grove when a stoned clown on a bike plowed right into the back of my van making a huge dent. At first I though it was "biking while texting" but a resident told me the guy was a local fixture, always high on something. The cops and EMT's thought he was high (nothing like an incident around the corner from the precinct for instant police presence!) but he was hauled away in an ambulance and I didn't see a summons issued.

People who ride the wrong way down the street need to be dealt with harshly. I usually go for a game of chicken to force them into traffic.
Riding while drunk, however, is a completely different story. Anyone who enjoys speeding down the Newark Avenue hill while wasted deserves free beer.

i know people in other states - NY, and CA - who got DUI / DWI on bicycles.
and someone in NYC who got a "going the wrong way on a one way street" on a bicycle (riding up St Marks Place)... watch out!

It is not stated in the statute per se. Look up the case NJ v. Tehan. The court in that case established the precedent that one could be charged with DUI when riding a bicycle.

probably less of that going on than there is knuckleheads riding their bikes while talking on the phone, (no ear piece, either) which I think is as bad as anything you can do on a bike.
