I was told they broke in through the garden level door/gate that leads to the area under the exterior stairs. Once hidden in that space, at night, it's a simple matter to break the door glass and unlock the inside door.
Word of advice: even if you have bars or grillwork on the gate, make sure there is no open space along the top or bottom of the gate. A-holes can use a stick or something like it to reach the thumb-turn and unlock the gate. Jack-offs are looking for a way to get in that's quick, quiet and hidden. Always try to make your place tougher to break into than the place next to you. Also, keep in mind what you throw out, especially on recycling night. Big cartons from flat panel televisions, computers, etc. are just advertisements to these scumbags for what's inside your house.

Some of you people can be such a bunch of PC-friggin-a-holes...
While you're debating definitions, there was a similar break-in on Wayne just off Varick on Saturday night about 10pm. Laptop and jewelry taken from house.... Cops said it's the 6th time in the past 2 weeks. Define that.....

My original question was to determine whether there was someone breaking into homes while the owners were away or someone waving a gun in peoples faces and robbing them on the street. A big distinction in my opinion.

I was using the definition I recalled from law school, which is what is commonly referred to as the multi state definition. Of course it's been modified. In fact, the offense originally had to be committed at night to be considered a burglary. Naturally each state is going to have their own particular definition of it, though I suspect most closely resemble each other and I would doubt any of them require the "night time" component.

I was describing burglary in terms of the most common situation, not attempting to provide the legal definition for it. But since we're nitpicking:
"Actually", your stated definition is more narrow than the legal definition of "Burglary" under the New Jersey Criminal Law as I read it: (1) There need not be "breaking" under NJSA 2C:18-2(a) as you say; (2) It need not be a "dwelling" as you say, rather a "structure" suffices among other things stated in NJSA 2C:18-2(a); (3) The intent required is not to commit a "felony" (that is, a violation for which the authorized maximum term of imprisonment exceeds one year) per se, it is with the intent to commit an "offense." (NJSA 2C:18-2(a)) "Offenses" are defined under NJSA 2C:1-4 to include more than just felonies. ...not that anybody on this board is overly concerned with these nuances. Stay safe everybody! For clarity's sake, pls keep in mind that a "robbery" involves taking property from a person or in the person's immediate presence by use of force or threat of force. It requires a personal encounter and using/threatening physical force against the victim. More scary.
"Burglary" is what you call somebody entering a dwelling and taking stuff unbeknownst to the occupants. No personal encounter needed. Less scary. Obviously, one could be "robbed" in their home, but I'm guessing you mean a burglary. FWIW: I've been the victim of a burglary while living here, but never a robbery.  /

I was told that it was a home robbery. My info is secondhand so I'm hoping someone knows more.
Apparently there were police on the scene during the day and one neighbor thought they may have caught the person. Something definitely happened, but I'm just not clear on the details. It seems pretty brazen if indeed it was a daytime break in...
