AG?s office knocks Gene Rubino out as Esther Suarez?s Chief of Detectives

Whispers about his lack of qualifications have followed Gennaro ?Gene? Rubino since Hudson County Prosecutor Esther Suarez made him Chief of Detectives for the Hudson County Prosecutor?s Office (HCPO).

According to a letter sent to Real Jersey City, it seems like Rubino?s tenure as the HCPO?s Chief of Detectives is now over because of those whispers ? which are that he never completed a Police Training Commission (PTC) approved course for either county detectives or police officers.

In a letter apparently written by Veronica Allende, director of the New Jersey Attorney General?s (NJOAG) Division of Criminal Justice (DCJ), it states that ?it is our office?s position that Mr. Rubino does not meet the requisite qualifications necessary to serve in the position of Chief of Detectives in your office...

...It should be noted that Allende spoke highly of Rubino in the letter, saying he had a ?stellar reputation in the law enforcement community.? Yet, given the cloud of suspicion surrounding the NJOAG-HCPO connection related to the Katie Brennan case, the timing of the move might seem questionable to political onlookers."

Prosecutor admits she got 4 emails about Katie Brennan rape case, but say she did not read ?substance of them?

By Ted Sherman | NJ Advance Media for NJ.com and Craig McCarthy | NJ Advance Media for NJ.com

Hudson County Prosecutor Esther Suarez received four ?routine? emails laying out accusations of sexual assault involving members of Gov. Phil Murphy?s election campaign, but ?did not read the substance of them,? according to the Attorney General?s office.

In a letter obtained by NJ Advance Media sent to a legislative committee looking into what Suarez may or may not have known about the controversial case, state investigators said they also determined that Suarez did not reply to the emails or forward them to anyone. Suarez has consistently denied knowing her office was investigating the alleged sexual assault.

The Middlesex prosecutors asked her only one question ?How much did you drink that night?? And didn?t interview her husband, who she said she called after the incident? Talk about the fix bring in!

For months, Hudson County Prosecutor Esther Suarez has denied knowing her office was investigating a rape case involving two high-profile members of Gov. Phil Murphy?s election campaign.

But copies of what appear to be inter-office emails obtained by NJ Advance Media show the prosecutor was included on a chain of messages laying out the accusations, three days after the alleged rape of campaign volunteer Katie Brennan by Albert J. Alvarez ? then the campaign?s outreach director for Muslim and Latino communities in April 2017.

(Speaking of kosher, if Alvarez is so innocent, why has this question not been answered yet? It does make one go hmmm.)

By Tom Moran tmoran@starledger.com
Columnist, The Star-Ledger

Brendan Gill wants to be clear about one thing: It wasn't him.

He is not the guy who was behind the decision to hire Al Alvarez to a senior job in the Murphy administration after Katie Brennan accused Alvarez of sexually assaulting her. The rumors, he says, are dead wrong.

"I had no communication with anyone to encourage the hiring of Alvarez," said Gill, who was Murphy's campaign manager, and serves as a freeholder in Essex County. "I was not involved in the transition or hiring practices of the administration."

So, the mystery lives. It is amazing to me that no one in the Murphy administration has stepped up and admitted to this mistake. And it's even more amazing that the governor allows the question to drag on, week after week.

"This is so silly," says Sen. Loretta Weinberg, D-Bergen, the co-chair of the committee. "All the governor has to do is tell us."

Maybe he doesn't know. But if that's the case, why hasn't he called all his people into a big conference room and pounded his fist on the table, demanding to know?

Instead, we heard a parade of Murphy's senior people swear oaths before the Legislative committee investigating this case, and claim that it wasn't them, leaving legislators exasperated.

Nor should it.

Agreed! If a sexual assault took place, and a coverup attempted, those responsible should be held accountable. Enough with the rationalizations and excuses. Given what we already know about this episode, something is not kosher.

You could be correct, or you may not be. But, what (I think) has gotten people (rightfully) rankled is the manner in which the matter was handled immediately after the report/accusation was made, and the ensuing charade.

Of course it?s possible. But Murphy?s response to the questions about his administrations reaction (how can they not tell us who hired the alleged rapist?) points to a true cover up. Non disclosure forms signed by everyone, down apparently to the food truck operator?

Yes. There are candidates that run against the democratic machine here in Hudson County. By no means do they have any power or influence. Hudson is true blue and we suffer the consequences of it.

She sounds ridiculous, though, when she invokes anger at Kavanaugh and Tump.

You lost any credibility when you mentioned GOP. Where? You have to turn off the MSNBC. GOP in Hudson county! That's a good one!

Pretty much agree with everything you wrote. But, "The open secret is that Hudson County is probably one of the cleaner Counties.".... WUT?

Hudson is pretty much universally recognized as the most corrupt county in all of NJ, and that has been the case since forever.

‘I went from numb to angry to crying.’ Katie Brennan rips latest decision by prosecutor not to pursue rape case.

Katie Brennan was driving to a meeting Wednesday afternoon when her attorney called to say it was all over: the Middlesex County Prosecutor’s Office had decided the man she accused of rape —a former senior official who worked for Gov. Phil Murphywould not face criminal charges.

“I went from numb to angry to crying – wildly crying — on my way to a meeting,” Brennan told NJ Advance Media on Thursday. She immediately called her husband. “He cried,” she said.

State lawmakers investigating how Gov. Phil Murphy?s office handled rape allegations against a senior administration staffer are locked in a fight with Hudson County Prosecutor Esther Suarez?s office over e-mails that may raise questions about Suarez?s claims she had no knowledge of the case, NJ Advance Media has learned.

The dispute lays bare tension between the prosecutor and the legislative oversight committee, which has been conducting hearings on how Murphy?s administration responded to allegations one state official, Katie Brennan, brought forth against another high-level staffer, Albert J. Alvarez.

Murphy staffer accused of rape told his boss it was consensual

Albert J. Alvarez, the former official in Gov. Phil Murphy’s administration accused of sexually assaulting Katie Brennan during the 2017 campaign, told his boss before resigning in October that he was being falsely accused of rape and the encounter was consensual.

Lizette Delgado-Polanco, CEO of the New Jersey Schools Development Authority and Alvarez’s former boss, testified before a special legislative committee Tuesday that Alvarez abruptly submitted his resignation in person on Oct. 2.

N.J. Governor?s Inner Circle Knew of Sexual Assault Complaint Against Aide (NYTimes)

TRENTON ? Members of Gov. Philip D. Murphy?s inner circle testified on Tuesday that they knew for months about accusations of sexual assault against a top administration official, but did not take steps to force the man?s removal.

It was the first time that high-ranking members of the administration, including Pete Cammarano, the governor?s chief of staff, were called to testify under oath in front of a panel as part of an investigation into the incident, which has cast a pall over Mr. Murphy?s first year in office and threatens to impede his progressive agenda.

The hearing comes two weeks after Katie Brennan, in her first public comments since her allegations were made public in October, described in wrenching testimony in a separate hearing her allegations against Albert J. Alvarez, who she accused of sexually assaulting her following a campaign event last year. Ms. Brennan told the panel that administration officials ignored her requests for action and continued to employ Mr. Alvarez for nearly nine months after her allegations were first reported to several of Mr. Murphy?s senior aides.

In his testimony on Tuesday, Mr. Cammarano said he told Mr. Alvarez ?that he needed to leave state government? during a private meeting in his office on March 26. He called the meeting after learning that Ms. Brennan took her allegations directly to Mr. Murphy?s chief counsel, Matthew Platkin. The meeting had not been previously disclosed....

Murphy is really doing the Trenton Two Step, dancing around this. Let?s see if he ball peens his staff phones and bleach bits everything after being subpoenaed to hand over communication with his staff over what and when he knew about the allegations.

Think you need to separate things:
1. Is the law constitutional?
2. Does the accused rights change if they are in breach of such a law?

For example, sovereign citizens/travelers believe it's unconstitutional to require license and proof of insurance when operating a vehicle. Are their rights being violated if they're charged with doing so? The prosecution need only prove they broke the law. If the law is badly crafted, it may get tossed by a higher court.

Defendants rights generally don't change. Though rules of evidence can change depending on the charge - as is the case with rape shield laws. And arguably that leads to charge-dependant rights.

And you Bodipooh seem more interested in defending the rights of rapists with empty rhetoric, than engaging in a constructive debate. Think I'm done responding to you.

Sure, that is EXACTLY what I am doing. You claim to want to engage in a constructive debate, but your reaction says otherwise: the moment the logic fault in your stand is pointed out, you get up in a huff, stomp your feet and scream "I am going home and taking my marbles with me".

Nobody is defending the rights of rapists, but those who seek to weaken the legal protections of the accused in the name of fairness do so out of a myopic view. Our system may not be perfect, but it really seeks to strive for fairness and impartiality.

So, go ahead and walk way huffing and puffing but, if you truly want to engage in a constructive debate, you have to be willing to listen to all viewpoints and be willing to accept when you are wrong, or mistaken. You have done none of that.
