so from looking things up:
"b)The driver of any vehicle knowingly involved in an accident resulting only in damage to a vehicle, including his own vehicle, or other property which is attended by any person shall immediately stop his vehicle at the scene of such accident or as close thereto as possible, but shall then forthwith return to and in every event shall remain at the scene of such accident until he has fulfilled the requirements of subsection (c) of this section. Every such stop shall be made without obstructing traffic more than is necessary. Any person who shall violate this subsection shall be fined not less than $200 nor more than $400, or be imprisoned for a period of not more than 30 days, or both, for the first offense, and for a subsequent offense, shall be fined not less than $400 nor more than $600, or be imprisoned for a period of not less than 30 days nor more than 90 days or both."

however the person can get up to 8 points for a hit and run. i am willing to go to court (even though my car was secondary) to get this guy if you guys are

I have to assume that by leaving the scene of the accident, the driver successfully avoided being tested for a potential DUI charge.
That doesn't seem like something that the law should encourage by reducing the charge.

I was in Hoboken Municipal Court yesterday contesting a ticket and one of the cases that came up before me was one similar to yours: someone hit a car and left the scene. The judge asked if the owner of the car that was hit was there to make a statement. The owner was not there, although they had received notice of the hearing. The city prosecutor recommended reducing the level of the offense, I don't remember to what, and the judge accepted it. I'm pretty sure the guy that did this got off with a lighter offense and fee because the owner of the car that was hit was not there.

If you're at all inclined to make sure that the person who hit your car gets what they deserve, I would suggest you attend their hearing.

Great suggestion Stani...the dishonesty of a hit and run deserves the full extent of the law to be applied!

"call back next week"? It almost seems they are going out of their way to give the owner of the car that hit you plenty of time to dispose of the evidence (repaired, junked, dumped out of state). Is anybody beginning to wonder if this car might be owned by "a friend of theirs"?

Thanks for the advice, Vigilante. Another sympathetic poster pointed us in that direction as well. We tried contacting the community relations officer on Tuesday, but she is on vacation until Monday. The officer on the phone told us to call back then. We will continue to move this up the ladder until we can reach someone who puts in more effort than a shoulder shrug.

I remember walking into the East District after the "kids" next door stole my neighbors air conditioner off his fire escape while his windows were being painted. It took considerable effort for these punks to steal it as it weighed about 60 lbs and had to be carried over a network of fire-escapes. Being criminals they were stupid enough to pop it into their window the next morning. When informed that this crime had happened the cops were totally disinterested and actually joked about it. In other words, they gave the classic shrug of the shoulders, "what do you want US to do about it"? Luckily, I knew two cops who I had spoken to often while walking my dog and requested that they respond. Within a half hour the punks were arrested and the AC unit returned.
I would suggest that you guys contact the community relations officer. I think it is Dina Reilly. Keep the pressure on because you pay taxes for these services. No, they aren't gonna send out Kojak or Columbo but you deserve justice. Good Luck.

i wish it wasn't up to us. We have been trying to work with the police and give them this information for days! With a very small amount of effort, I am confident that the police could have solved this by Sunday afternoon. Instead, my wife and I have had to sacrifice our own time between work and school to get this far.

The dude: When will you find these guys? I mean, do you have any promising leads?

cop: Leads, yeah. I'll just check with the boys down at the Crime Lab. They've assigned four more detectives to the case, got us working in shifts.

I'm glad you got the video and I hope that the driver or his insurance company pays you dearly. He must have been seriously drunk when that happened. Unacceptable in so many ways.

Now that I've stated the obvious, I just wanted to also say, wouldn't it have been a lot cooler if you put in the subject line "Dude, Who Hit My Car ?" instead ?

Sorry... couldn't resist.

Pretty sure I never said there shouldn't be punishment. Just thought eternal damnation is a bit of a stiff sentence.

You are so lucky to have gotten the footage and the plate number. This happened to me in June on Varick between York and Bright and nobody saw anything and no cameras. I hope this person not only has to pay for damages but that they get a hefty fine as well. Good luck with everything!

At the 37sec mark the person (looks like a man) walks over to the car after it crashed, He is carrying a bag, gets in and drives away. That person went into some establishment and either purchased something or came back to retrieve something.

In my opinion the item being carried looks like it could be a pocketbook/purse.

It looks like an Accord wagon to me. Maybe they forgot the bag after drinking at the Barge and came back to get it after the bar closed. Wow that video is solid evidence. It looks like the person in the car put the car in drive after the driver went in the bar, you can see the reverse light come on for a fraction of a second lighting up the car behind it, and then boom!

Looks like an ealy 1990's Accord or Saturn wagon. The Cam4 logo and headlights of the vehicle make that a hard id.
