a person wrongly accused is TERRIBLE thing and can be a violation in itself, for sure.
but, imo, the worst possible scenario is disbelieving a victim -- i still don't know why you would do this out of hand -- so that she grows into an emotionally unhealthy adult and the perpetrator gets away with it, free to repeat the act.

we're not in court.
in general, in the real world, we should absolutely BEGIN with believing the child and moving forward, soberly, from there. to assume the child is NOT telling the truth sets up too many negatives in deference to one potential positive.

Children learn at some age that they have absolute power over adults if they make certain accusations. And while this case doesn't seem anything like that, certainly "your initial thought should be to believe the child" is a thinking process that will ruin a lot of innocent lives and protect no children.

Just asking if any proof or evidence has been released? If she was handcuffs, wouldn't there be marks on her wrists from getting out etc?

The whole thing is just really, really scary and disturbing. I used to live just a few houses down from that guy. And the business with the mother/son is really Norman Bates.
What really scares me the most is that he will not spend that much time under lock and key. Thank God that the quick-thinking, brave little girl escaped this time, but when he gets out of jail there is a good chance that he will try something again and succeed. This will be especially true if his mother is not around to watch. People like Mr. Luigi should NEVER, EVER be let loose again. Or if he is set loose, he should have his arms and legs cut off so he can't grab or chase any more little girls.

Girl Escapes From Alleged Captor In N.J.
Reporting Christine Sloan
JERSEY CITY, N.J. (CBS)
A 12-year-old girl allegedly held captive managed to set herself free by slipping out of her handcuffs.
The child told police Luigi Pandolfo handcuffed her and held her hostage for two hours inside an empty Jersey City apartment behind his mother's home on Colgate Street.
"The fellow in the next door house says he heard some screams," said neighbor Jean Kelly.
Soon after the cries for help, investigators said, came a daring escape from the building's window, after the girl slipped out of her handcuffs.
Police said the 12-year-old girl was able to flee as the suspect argued with his mother, using a fire escape.
Maria Pandolfo, the alleged kidnapper's mother, came to his court hearing and told CBS in Italian that the girl is making up the story. She said the 12-year-old was in her house for five minutes looking at cats up for adoption and that she left using the front door.
But the girl told the police she was abducted off of her bike, which she used again to ride back home.
In court, the 33-year-old appeared to clench his teeth as the judge read the serious charges, kidnapping and sexual assault. "Allegations are that you specifically by force, you attempted to take the victims pants down," the judge said.
A neighbor who did not want to be identified said Pandolfo tried to lead her into his apartment too. "He had three kittens and two, you know, the mommy and the daddy. I wouldn't go in. I had this sixth sense something wasn't right."
"He's a loner. He never talked to anyone, always came out night. You never saw him in the day time. He just a pretty weird kid," neighbor Anthony Kelly said.
Pandolfo's mother, still wearing black to mourn her husband's death, said her son was just misunderstood, and that he was innocent.
Police told CBS 2HD that inside the suspect's house, investigators found several pairs of handcuffs, pornography, weapons, and body bags. The suspect was held on $500,000 cash bail.

JERSEY CITY, N.J. (WABC) -- Police say a 12-year-old girl was abducted in Jersey City over the weekend, but she managed to escape and get help.
Police arrested the suspect and charged him with kidnapping and sexual assault.
In Italian and broken English, the mother of accused kidnapper, Luigi Pandolfo, insists her son is innocent.
"He's a good boy. No one comes to our home," Maria Pandolfo said.
She talked to Eyewitness News just moments before her son appeared by video monitor before a judge to hear the charges against him.
A 12-year-old girl told police Luigi Pandolfo snatched her from her bicycle, took her into an apartment at 82 Colgate Street, handcuffed her, and then tried to sexually assault her Saturday night.
The girl found her chance to escape when, police say, Pandolfo moved her to a vacant apartment behind his mother's house. He left, and when the girl heard Pandolfo arguing with his mother back at the apartment, the girl squeezed out of the cuffs, climbed down a fire escape, jumped on her bicycle and raced home to tell her parents.
The suspect's mother insists, the girl was never in her home and that she was outside, looking at a kitten.
A relative of the girl tells us, the family is still shaken, but is trying to help the child get through the ordeal.

I have known the Pandolfo family for many years. Luigi has been a reclusive hermit for well over a decade now. His father passed away a few years ago and his sister passed away 2 years ago (at the age of 33). Prior to his sister passing, she had expressed how they were not getting along and how angry he was with her. I heard that neighbors would hear him argue and yell at his mom all the time. My heart goes out to his mom because she buried her husband, then her daughter and has been at the very least verbally abused by her son. She is an older woman who barely speaks English and lives alone with her sick son. Now, she must face the fact that he has done this terrible thing to this poor girl.
My heart goes out to the poor girl and I hope that she finds the strenght to overcome such a horrific experience. I can only imagine what this experience has done to her. I pray for both her and her family in such a difficult time. As for Luigi, I hope they put him away for a really long time.
