Hudson County shelter has been legally put out of business

The century old Hudson County Society for the Prevention of Cruelty to Animals was put out of its misery today by a Superior Court judge who gave it a scathing ruling based on a suit filed by the state Attorney General and animal rights organizations.

The "HCSPCA has repeatedly conducted it's business in an unlawful manner," Hudson County Superior Court Judge Thomas Olivieri said in today's order dissolving the organization which was based on Johnston Avenue in Jersey City.

The judge also stated as reasons for the dissolution that "The HCSPCA has suspended its ordinary activities for lack of funds," "is conducting its activities at a great loss and with great prejudice to the interests of it's creditors" and "in a manner that is prejudicial to the public."

The suit was filed against the HCSPCA; its president, Hector Cabajales; his wife Zoey Carbajales, and unnamed board members. The AG's suit was joined by the Hudson Animal Advocates and the Jersey City Division of Health.

The attorney for the HCSPCA, Jay Joseph Friedrich of Ridgewood, could not be reached for comment. Olivieri said the defendants argued that the allegations were untrue but their arguments were very general and insufficient.

On April 7 the Jersey City Department of Health and Senior Services revoked Hector Carbajales' Animal Control Officer Certification, stating he "engaged in conduct that was contrary to the duties and responsibilities of an animal control officers. Neither Hector Carbajales nor his attorney could not be reached for comment.

The HCSPCA facility was ordered shut in April 2008 by Olivieri after a series of failed inspections. Two months later the carcasses of 15 dogs, cats and a goat were found rotting inside an unplugged freezer in the fly-filled and reeking facility.

Before giving his ruling yesterday during a conference call, Olivieri outlined the history of the case which he said included findings of mistreatment of animals, abysmal record keeping regarding animals and there adoption or euthanization, filthy and unsanitary conditions, sick animals left untreated, operation without supervision of a veterinarian, and tax problems.

The judge also said, "The record clearly and convincingly substantiates at least $800,000 disappeared."

When the HCSPCA was closed the animals were transferred to the Liberty Human Society located near Liberty State Park. The court will now appoint a receiver to take control of and dispose of the assets of the HCSPCA.

Good news everyone... Guilty... but only one count. Until his ACO certification is revoked, he may continue as the ACO for any municipality.

Hector's guilty plea


Hector Carbajales pled guilty on May 7, 2009 in municipal court to creating a public health nuisance by abandoning dead animal bodies and medical waste at the HCSPCA in June, 2008. Accordingly, he should have his ACO certification revoked by the DHSS. I would ask that you spread the word that letters/emails should go out to the DHSS with this request. The mailing address is:

It costs money to bring an animal to the incinerator authority. Hector is the ACO without a shelter to bring animals. So, in a city of about 70,000 people, Hector has either been eating strays, storing strays in a secret location, or euthanizing all of them.

The dead goats are most likely Santeria which is widely practiced in Union City and North Bergen.

Here is something to ponder. When Hector left dead animals in the freezer last year, one of the 15 dead animals was a goat.

Also, one former staff member revealed that Hector periodically threw dead animals into construction dumpsters. So what does he do now that the heat is on him? Drop off live strays in surrounding towns? He hasn't produced an animal for boarding at the shelter where he has a contract in months.

Yes, local and state level law enforcement have been aware for many months. None of these assertions have been secret for over a year and are common knowledge for those close to the shelter. Carbajales claims he receives no salary and is an ordained reverend, so how does he support his family? His disability, which he spoke about openly and too often, was due to a head injury while playing rugby. My hunch is that he has the whole non-profit scam down to an art form.

The HCSPCA shelter "business" was a cash enterprise. The HCSPCA accepted no checks and when an animal was surrendered, the paperwork would reflect that the animal was a stray. The cash surrender fee would be stuffed into their pockets and that, my friend, is a FACT witnessed by volunteers and a Chow rescue group from New York.

Unfortunately, "looters" stole records for some crazy reason.

Items \"stolen\" from the HCSPCA included steel animal cages. Sounds like filing a false police report if those cages were HCSPCA property.

4. FACT: A NJ State SPCA investigator did not inspect the HCSPCA despite pleas from volunteers. Two witnesses have come forward to report that the inspector \"hugged\" Ms. Carbajales and announced, \"I\'m here for the inspection.\" He left moments later without inspecting. Subsequent evidence proved that he \"pencil-whipped\" the inspection.

5. FACT: There was no goat carcass in the freezer during an inspection of the facility after April 11 which is the day a N.J. Superior Court judge ordered the animals removed. This is unbelievable! I would've expected that some serious action would've been taken long before now, some sort of investigation or further charges filed yet he remains free, employed, doing the same probably lousy job, clearly incompetent and negligent.
I don't understand why mediocrity is being tolerated? I'm sure there are plenty of qualified, better candidates to fill his position who'd perform that job dutifuly, with all the unemployed Americans who'd love to be working right about now. What happened to standards and bare minimums? This is really upsetting...

Tomorrow's pre-trial hearing stemming from the discovery of maggot-infested animal carcasses and medical waste at the old Hudson County SPCA in Jersey City is likely to be postponed because of a scheduling conflict.

Former HCSPCA President Hector Carbajales and his wife, Zoe, face charges in municipal court but their lawyer, John Young of Jersey City, said today that a scheduling conflict will prevent him from appearing at the hearing.

In June, the bodies of 15 dogs, cats and a goat were found rotting inside an unplugged freezer in the fly-filled and reeking facility on Johnston Avenue, resulting in a number of citations being issued to the Carbajales.

Cited for violations related to failing to properly dispose of animal remains, medical waste and other issues, the Carbajales argue that they are not at fault because a court order had stripped them of any control over the facility.

A new date for the pretrial hearing has not yet been set, Young said.

Hector Carbajales the Animal Control Officer of Union City and North Bergen has no where to take lost pets and strays. Where is he taking them? What is he doing with them? Why does Richard Censullo the Health Officer of Union City and North Bergen continue to employ Hector Carbajales as your Animal Control Officer? It is a known fact that Hector Carbajales kept aninmals at the HCSPCA in horrible and deplorable conditions and the shelter was closed down due to his neglect and abuse of these animals who lanquished in their own filth and were visibly ill.
The citizens of Union City and North Bergen need to file a complaint with the Health Department and contact Richard Censullo. Your tax dollars are being used to employ Hector Carbajales. It's time that Union City and North Bergen employed a responsible Animal Control Officer.

This guy abused those poor animals, stole $ from the HCSPCA, robbed the place of its copper pipes, destroyed the records so there was no paper trail, and he continues to work for the county. And he's only up on civil fines. Absolutely absurd!

Likewise, the Jersey Journal reported on July 28, 2008 that the HCSPCA ?is under criminal investigation by the state Attorney General's Office? and the ?the AG has subpoenaed records from Union City and North Bergen, two Hudson municipalities that have contracts with the HCSPCA for animal control services. Of course, records at the HCSPCA facility were ?stolen? because they must have been made of copper or something after the facility was looted.

Not surprisingly, one doesn?t have to dig deeply to find misappropriation. On June 24, 2008, the Jersey Journal further reported that ?the president of the Hudson County District Society for the Prevention of Cruelty Animals withdrew almost $12,000 from the bank account? more than two months after the facility was closed.

The Jersey Journal stated that, ?Sovereign Bank records show that Hector Carbajales, who now contracts independently with Union City and North Bergen to pick up their strays, personally withdrew $11,790 in multiple installments ranging from $40 to $2,200 in April from the account of the HCSPCA.?

If you feel that Mr. Carbajales? current contracts with Union City and North Bergen are an abomination, please contact the appropriate officials:

Thanks for the update. Sadly, I have no faith that the Hudson County Judiciary will do anything. It's basically a year later, and these people are still in the animal control/care business. I will keep my fingers crossed that they get even a measure of what's coming to them.

I've been following this all along too. I am absolutely outraged that they are still doing animal control under local contracts. And the husband's supposed to be some sort of F'in Minister?! I've read that he also collects disability on the side!? Well, I hope he joins the pedophiles and sodomites in hell, because there do not seem to be any repurcusions for these abusers in Hudson County.

Justice??? Cruelty charges from January 2008 were dropped recently against Zoe Carbajales. Wonderful. Charges for creating a public nuisance and improper disposal of medical waste have been postponed until a February 20th hearing. Don't be surprised if they sue to reclaim the old facility. he's very dog friendly! my roommate's got a pit whippet or greyhound mix and they get along (and break into the garbage together) and he's also friends with the pit/boxer upstairs and my friend abby's pekingese.

I met Sharky at the HP-Festival last summer. He is the coolest dog ever! My wife and I loved him but we are at capacity with 3 dogs right now. Congratulations! You've got a winner there!
