Smokers often assume since they are not in their unit no one else is being effected. The people who smoke outside office buildings are an example. Their smoke blows in the wind and it impacts on the passerby. Try one of those door cushions that keep the cold out. If your door is tight it may help. Your home is your castle and if there are no other issues you're probably ok.

It is the landlord's son and daughter (who are grown)...Their mom lives in the building and doesn't allow them to smoke in the apt, either for health or other reasons...
Unfortunately there is currently an acrimonious relationship between us...Otherwise I would simply ask them to kindly not smoke in the lobby...However, they are not very courteous, or responsive, people to begin with (ergo the source of the acrimony I am interested in the actual laws though. Thanks for all replies, I really do appreciate it... Nab

Obviously not, otherwise they would smoke in their apartment - It would appear the no smoking rule applies to all apartments and common areas of the property - They would be required to step out of the property area to smoke. If you had an underground carpark that area would also be out of bounds for smokers.
Ask the super or simply buy a NO SMOKING sign and stick it up in that area.

Howdy Folks,
Well, I have a pretty simple straight-forward question... I live in a multiple unit dwelling here in downtown JC...There are two people who, due to the colder weather, smoke all the time in the building's publice shared lobby...They smoke ALOT during any given day...The smoke obviously not only mucks up the lobby, but also inevitably drifts into my apt... My question is; is this legal...? --Thanks to all in advance, and I do hope you all are doing Well... Nab
