5-year sentence for hit-run death of Jersey City musician

Staring straight ahead, John Dineen fidgeted with a rosary bead behind his back as he was sentenced to five years in prison yesterday morning for a fatal hit-and-run.

At around midnight on July 15, 2010, Dineen was driving his 2009 Toyota Land Cruiser when he struck Germaine Forrester as the man was crossing Route 139 in Jersey City.

Dineen then sped away, leaving Forrester, 33, of Queens lying on the pavement.

Forrester, a Guyanese-born Barbadian musician who opened for artists like Sean Paul and Ashanti, was pronounced dead at the scene.

Dineen had had three glasses of wine that night and had marijuana in his system, authorities said. A police officer pulled him over less than 30 minutes after the hit-and-run.

On Feb. 14 this year, Dineen pleaded guilty to leaving the scene of a fatal motor vehicle collision and failing to submit to a Breathalyzer test.

Dineen?s defense attorney, John R. Schwartz, unsuccessfully argued for a probationary sentence in front of Judge Paul DePascale.

Hudson County Assistant Prosecutor Michael D?Andrea told the judge that the state was already asking for a minimum sentence under the special request of Forrester?s mother, who was not present in court.

Schwartz had earlier read aloud a part of a letter that Forrester?s mother had addressed to the court, quoting ?I do not believe putting Mr. Dineen in prison for his actions would do any good.?

D?Andrea insisted that while Forrester?s mother did not think a prison sentence was appropriate for Dineen, there was still a need to deter others in society from doing what Dineen had done.

why is it not Vehicular Manslaughter? and he was out all this past 4 years on $50,000 bail?

And he was slapped on the wrist with a below-the-legal-minimum non-sentence, and went on being Senator. Apparently, MA decided that guy represented them best. And he was actually called by his party comrades "the lion of the Senate". With this example in front of everyone what do you expect from the rest of the country?

JERSEY CITY (WABC) -- Jermaine Forrester made it from Guyana to Barbados to America, steadily building on his dream to become a music sensation.

Forrester's dreams ended early Thursday morning along Route 139 in Jersey City, when he was hit by an SUV while crossing the four-lane highway with a friend.

Police say the driver sped off with other witnesses trying to chase down the Black Toyota Land Cruiser.


"They followed him for several blocks, but he was going so fast. They couldn't keep up," Dep. Chief Peter Nalbach said.
The driver escaped while a young may lie dying in the street. Jermaine's loved ones in Queens are heart-broken.

Within 30 minutes of police issuing a bulletin for the Land Cruiser, 23-year old John Dineen of Harrington Park was stopped by a River Vale cop.

"He was speeding. (The officer) noticed the front end damage, broken light," Nalbach said.

Dineen was charged with death by auto, endangering an injured victim, driving while intoxicated and refusing to submit to a Breathalyzer test.

Police say Dineen talked a lot, even implicating himself.

"He said he was getting sick. That he didn't realize he killed the guy," Nalbach said,

Forrester's social network pages speak of him opening for stars like Busta Rhymes, Sean Paul, and Ashanti. All now over, police say, because of a drunk driver.

Last name is the same as that on a law office up by the county court house. I had the impression at the time that there was a connection.

How could the guy that killed the two people on Grove be facing 15 years per death and his guy who was eventually stopped in River vale and arrested for DWI be only facing 5 years?

This man was drunk (I know allegedly, but he refused a breathalyzer test), and he killed a person while driving. He should go away for more than 5 years. That should be at least 20 years. You shouldn't be behind a wheel when you are drunk and 5 years is just not enough of a deterrent it seems as people keep driving drunk.

That was a few years ago and, luckily, the victim did not die.

Did we ever hear what happened in the similar case where a hit and run driver ran a red light and killed a pedestrian on Marin and 6th, there was video of the accident posted on Jclist.

After Dineen was arrested four years ago and told he was being charged with death by auto and other offenses, he exclaimed to River Vale Police, "Holy s---! I killed that guy?"
