Open fires are illegal. Contained/enclosed fires like a charcoal barbeque or a wood-burning stove or chimenea should be fine as long as they are far enough away from any structures. I'm not sure what the distance has to be but it's probably in the 20 ft range (check with the JCFD). If you have a condo or a 12 ft rowhouse with a patio, you probably don't have the room for a firepit.

Like a PP said, make sure it's cool with your neighbors, since there is going to be smoke and it's not above the rooftops like a fireplace chimney. Also, neighbors who don't know what kind of fire is allowed and not allowed may call the fire department. Even if your fire is enclosed and legal, that's a hassle for everyone, not least for the fire department.

It's all about whether your neighbors let you get away with it. One of my friends has been having backyard campfires for years without incident.

When the firemen came to the house, they informed me that open fires are illegal in JC and they were laughing that I even attempted it.

N.J.A.C. 5:70-3, 307.4.2 (Recreational fires)

Recreational fires shall not be conducted within 25 feet of a structure or combustible material. Conditions which could cause a fire to spread within 25 feet of a structure shall be eliminated prior to ignition. Fires in approved containers shall be permitted, provided that such fires are not less than 15 feet from any structure.

I have been to many Jersey City house parties where fire pits have been burning material. Legal or not, the fire department never showed up.

I've been to a backyard Guy Fawkes bonfire in Jersey City and nobody showed up.

They are definitely not legal in JC. I did one many years ago and promptly had firetrucks outside the brownstone.

I looked into this a few years ago and recall coming across something that specified the distance that the fire had to be away from any structures (which seemed to limit this option for many outdoor spaces in downtown JC as there's often someone's house quite near). Can't recall where I found that info though. I suspect the rules are fairly strict given the close proximity of houses.

A section of the concrete paving in my backyard gave way over the winter and I've decided to make a small fire pit out of it. Is there any reason to think that a small controlled campfire would be illegal? It doesn't seem like it should be, especially considering how many people use grills but I just wanted to make sure.
