Attorney for son of federal cop charged in teen's death says shooting was 'accident'

JERSEY CITY -- The 18-year-old charged with aggravated manslaughter in the shooting death of a teen on Van Horne Street Monday morning is the son of a federal police sergeant, his attorney revealed in court Tuesday afternoon.

Jacob Pommerehn is charged with shooting 17-year-old Anthony Rios once in the head with one of two guns he unlawfully had in his possession, according to a criminal complaint.

His attorney, Anthony Pope, argued before Superior Court Judge Shelia Venable that the shooting was an "accident."

As Hudson County Assistant Prosecutor Leonardo Rinaldi read the three charges in the courtroom, Pommerehn sat in the video conference room at Hudson County jail in Kearny sobbing and wiping his face with his green jumpsuit.

Rinaldi said Pommerehn took two guns from his father's house ? a boat docked in the Newport section of Jersey City ? without permission. The weapons were loaded and Pommerehn thought the safety was on at the time of the shooting. After the weapon fired, the 18-year-old fled. He returned to the scene a short time after and later admitting to firing the weapon, Rinaldi said.

Pope, whose office is based in Newark, identified Pommerehn's father as a 20-year veteran sergeant with the United States Interior Police, heading the marine police.

"I think the facts will bear that this was some type of an accident, although it may rise to the level of some type of recklessness," Pope said.

A spokesperson from the National Park Service could not immediately be reached for comment. It's not clear if the weapons used were the officer's service weapons.

Pope argued that Pommerehn panicked and ran back home to his father, who brought him back to the scene. The 18-year-old's father has been taking funds from his pension and asked the bail be lowered to $150,000 from $250,000. Pope argued that he understands this is a serious offense, but there was no risk of flight.

Venable lowered bail to $200,000 cash or bond.

Following the hearing, Pope declined to comment much further on the investigation.

"I got a young kid, 18 years old, no prior record, great family, great support," Pope said. "Our hearts go out to the family of the young man killed, I can't even begin to imagine what the family is going through. Everybody has been so clearly emotionally effected by what was in my opinion was a clear accident."

Rios, who friends described as being passionate about basketball, died at the scene and his death was ruled a homicide. Pommerehn faces up to 30 years in prison if convicted of aggravated manslaughter.

JERSEY CITY -- A man was fatally shot early Monday morning in the Bergen-Lafayette section of the city, officials said.

The shooting was reported at around 1:30 a.m. on Van Horne Street between Halladay and Carbon streets, a spokesman for Hudson County Prosecutor's Office has confirmed.
