This poor kid is going to traumatized for life over this man's stupidity. Put him in jail for life and the mother should also be punished for caring more about her boyfriend then the welfare of her child.

WTF, The medical center should ALWAYS call the cops if someone comes in with a shot gun wound as a mandatory policy.

CON BACK IN JAIL AFTER BOY SHOT -- 25 shotgun pellets in 2-year-old's legs

Thursday, December 11, 2008
By MICHAELANGELO CONTE

A Jersey City felon is now facing more prison time after accidentally shooting a 2-year-old with a shotgun, officials said.

Hassan Tate, 28, of Rutgers Avenue, remains in jail following the Nov. 24 incident and he faces a possible sentence of more than 10 years in prison without the possibility of parole if convicted, officials said.

The toddler, found to have 25 shotgun pellets in his legs, is expected to fully recover, officials said.

"Clearly this could have been a very tragic situation due to a firearm being in the wrong hands," Hudson County Prosecutor Edward DeFazio said yesterday.

Tate is charged with aggravated assault, endangering the welfare of a child and possession of a firearm by a felon, DeFazio said.

Prosecutors allege that Tate was handling a shotgun in his Rutgers Avenue apartment where he lived with a female friend and her child, and while putting the gun into a box, it went off, DeFazio said.

The boy's mother took the child to the Jersey City Medical Center for treatment but "was less than forthcoming" with doctors about what happened, DeFazio said, adding that police were called because of potential child abuse.

When X-rays revealed the child had 25 shotgun pellets in his legs, the mother, who has not been charged with any crime, came clean, the prosecutor said.

Her statements led to Tate's arrest and a search of the apartment, but no gun was found and the apartment appeared to have been cleaned following the incident, DeFazio said.

Other adult witnesses were present when the boy was shot, he said.

The boy is expected to recover fully, said Hudson County Deputy First Assistant Prosecutor Debra Simon.

In 2004, Tate was convicted on the charge of drug possession with intent to distribute within 1,000 feet of a school. He was sentenced to three years, and served from July 2, 2004 to Jan. 3, 2005 in state prison, officials said.

He was also convicted of drug possession in 2003, and assault in 2000, Simon said.

Tate is being held in the Hudson County jail in Kearny on a bail of $150,000 cash or bond and his case is expected to be presented to a grand jury before spring, Simon said.

There was no answer at the Rutgers Avenue apartment yesterday.
