In the first article, a government employee made illegal use of the city's email system. In the second one, Fulop is accused of sending an email to people's personal email accounts. It's annoying, and maybe even unethical (depending on how strong you feel about the "sanctity" of personal email addresses) but definitely not illegal. Do you REALLY not see the difference? Think of it this way: in the first one the guy broke into the post office and sent out letters, in the other a guy legally sent out junk mail.
