As I said, the unit is covered by the anti-eviction law as I don't live there, and I truly would prefer to buy them out rather than get into the ugliness and dubious odds of victory of trying to evict them for cause.

Yvonne, the term of lease in NJ is irrelevant if they have automatic renewal rights under the A-E law. You can't simply decline to renew. The only opportunity presented by the renewal is to raise the rent to the point they'll leave or challenge it in court to see if a judge will call it "unconscionable". I'd rather pay them and consider it part of the cost of purchasing an occupied building than get into a many months long legal struggle I might not win. And if they withhold the rent during it, I might end up out much more money.

If your tenants called the police over noise. Then that could be a basis for eviction. That is why I believe in one year lease.

How many families/apartments is your building and how long is the lease ? If it is only a 2 family then tell them you need the apartment after the lease is up. Perhaps you can do a secret inspection by going into their apartment to "fix" something and look for violations. I'm sure your insurance will stand by your side.

Can't you just evict them based on them ruining the other tenant's quality of life? Are there any clauses in the lease that they are breaking that can allow you to deny a lease renewal?

I want these tenant gone. It's not that they're evil, it's just that they're incredibly loud, and destroy any chance of other good tenants staying more than one lease. Many kids and it's absolute bedlam from 3:30 to after 10 every night.

So does anyone have experience or grapevine knowledge of this and how much it would take here in JC? It's a more common practice in rent controlled NYC, but I don't want to got to war with them by raising the rent a crazy amount and ending up in court under the anti-eviction protections. I just want them gone and will pay a reasonable amount. For a $1000 rent apt I would expect it to take at least $2-3k.
