I met Grant at LHS when he was "Eli" and was interested in either him or Sharky. The next time I came back, he was gone into rescue, so I took Sharky. I re-met Grant at Bark in the Park and he looked like a happy go lucky dog. Kudos to you guys for taking charge of a bad situation.

One year ago today, this story was big news. Meanwhile, Hector is still the Animal Control Officer for Union City even after rotting carcasses were found in a facility under his control. After the facility on Johnston Avenue was "looted" and damaged by "vandals" Carbajales has managed to open up shop somewhere else. See the very first post for the original story ... January 11, 2008. wow... he leaves 15 animals to rot in a freezer and Jersey City spends a day or two responding and cleaning that mess.

Also, medical waste was not properly disposed of.

12,000 dollars withdrawn from bank account in April.

There are rumors that the prosecutor wants to settle the case which would be bad for the animals. Zoe has said in the past that she wants to become a certified animal control officer. If she is found guilty of these cruelty charges that would pretty much zero out her chances of getting cetified. So it is imperative that she go to trial.

We have to get these two bottom feeders out of the animal business completely.

Lawyer absence delays SPCA case

The manager of the shuttered animal shelter run by the Hudson County Society for the Prevention of Cruelty to Animals is still headed for trial on animal cruelty charges, but no date has been set.

A pre-trial conference scheduled yesterday in Guttenberg Municipal Court was postponed until Oct. 7 by Judge Frank Leanza because the attorney for Zoe Carbajales was not present.

Carbajales is fighting charges that she kept animals in freezing, filthy conditions at the Johnston Avenue facility in Jersey City. The case was moved from Jersey City Municipal Court to Guttenberg to avoid a conflict of interest because the violations were cited by Jersey City Animal Control Officer Joe Frank.

Carbajales has pressed theft charges against Frank in return, saying he improperly removed three dogs during an inspection in January.

In a separate proceeding, Hudson County state Superior Court Judge Thomas Olivieri, who shut the shelter down in April after a series of failed inspections, is considering what to do with the HCSPCA's assets. He will hold a conference with attorneys in that case on Monday.

Carbajales' husband Hector, the former president of the HCSPCA, is still doing animal control for Union City for $5,000 a month, according to the city's health officer, Richard Censullo. North Bergen, the other town that had strays taken to the shelter, has signed a contract with Associated Humane Societies of Newark.

The saga of the Hudson County District Society for the Prevention of Cruelty to Animals moved a step closer to resolution last night as a judge told the shelter's manager and two Jersey City inspectors to prepare for a trial over their competing charges.

On one side is Zoe Carbajales, manager of the now-closed Johnston Avenue facility. She faces a dozen animal cruelty charges based on two inspections in January that allegedly found her keeping malnourished dogs in filthy, freezing conditions.

Those inspections were carried out by Jersey City animal control officer Joe Frank and Bob Vogt, of the city's Health Department.

Their attorney, Andrew Abrams, said last night after a hearing before Guttenberg Municipal Judge Frank Leanza that Carbajales faces "substantial fines" if found guilty.

But she has filed theft charges against Frank in return, alleging that he improperly removed three dogs from the shelter.

The case was moved to Guttenberg from Jersey City Municipal Court to avoid a conflict of interest, since Frank is a city official.

The two sides exchanged evidence - including photographs and inspection reports - last night, and Leanza told the attorneys to appear before him on Sept. 16 to determine if the charges can be resolved or if a trial should be scheduled.

Carbajales is being represented by Michael Willis, a Jersey City attorney. She attended the hearing with her husband, Hector, the former president of the HCSPCA, but they declined to comment.

In a separate proceeding, Hudson County state Superior Court Judge Thomas Olivieri is considering what to do with the HCSPCA's assets.

He shut the shelter down in April after a series of failed inspections.

One has to ask whether Carbajales was the only one profiting from this alleged criminal enterprise that looks like a front for stealing money from the Townships of North Bergen and Union City.

They don't live lavishly, so the State Attorney General should cast a wider net.

Fellow Animal Lovers -

We desperately need your help.

For several weeks now we have been receiving assurances from Richard Censullo, the Health Officer for both Union City and North Bergen that he was doing all he could to make sure that Hector Carbajales , the disgraced President of the HCDSPCA, was replaced as Animal Control Officer for both towns. Now, according to Friday's Jersey Journal, Mr. Carbajales is being allowed to bid for the very contract that was stripped from his old organization after they were exposed for cruel, inhumane treatment of animals!

Mr. Carbajales has submitted a much lower bid than market rates - easy to do when you supply none of the legally required services - to undercut other bidders. At the same time, his bids would give him a $66,000 a year RAISE over what HCDSPCA made for the work last year.

In Union City alone, several animals have been taken home and fostered by local police after Mr. Carbajales has failed to show up for DAYS to pick them up. This puts any escaped animals OUT OF REACH of their owners who may be trying to find them.

Meanwhile, Mr. Carbajales is the subject of a criminal investigation by the State Attorney General that could lead to criminal charges and even jail time. In their filing with the court this past week the State Department of Consumer Affairs cited evidence that Hector and Zoe Carbajales may have embezzled over $90,000 in just the last two years, as well as $12,000 in the month of April alone!

Please take the time tomorrow - the earlier in the day the better, to call the Mayors and Commissioners of each of these towns and tell them to say NO to Mr. Carbajales!

A Sample call would go something like this:

"Hi. I am calling Commissioner/Mayor ___________ to state how vital it is that Hector Carbajales NOT be allowed to contract with Union City/North Bergen to provide Animal Control. Mr. Carbajales has a proven track record of Animal Cruelty and abuse and is currently the subject of multiple State Attorney General Investigations. His current handling of Animals in Union City is already in violation of State Animal Control Law. Hiring him is a blemish on your good name, and those who support him will be held accountable at the polls and in the courts. Again, I urge you for the safety of Union City/North Bergen's Animal Population and the legal protection of Town Governemnt NOT to award your Animal Control Contract to Hector Carbajales."

Both towns will make this decision by a vote of the Mayor and Commissioners. Their names and numbers are:

After being repeatedly slammed with health violations, the Hudson County SPCA was shut down last night under order of a Hudson County Superior Court.

The animals that were housed there - 15 dogs, one ferret and 24 cats, including a mother cat with kittens - were moved to Liberty Humane Society at around 6 p.m. last night. By order of the court, the HCSPCA is not permitted to take any new animals.

To the dismay of local animal activists, conditions at the HCSPCA have steadily worsened over the past year. In March, officials from the state Department of Health and Human Services cited the shelter with 24 violations ranging from improper disposal of feces to missing records.

An inspection report noted that conditions at the Johnston Avenue shelter had declined from the state's last inspection in November, 2007, when officials discovered that some of the shelter's cats and dogs were going without water and housed in cages that were too small.

Hector Carbajales, intern president of the HCSPCA, says he wasn't given a fair inspection by the state or the city.

The animals found themselves a new home this morning at Liberty Humane Shelter, said Vivian Kiggins, executive director of LHS.

Kiggins said that, just from looking at the cats and dogs, a mix of Dalmatians, terriers, German Shepherds and pit bulls, they did not appear sick or malnourished. However, she said all the animals need to be examined by a veterinarian.

"Right now our first concern is trying to make sure they're safe and happy," she said.

Liberty Humane is the contract shelter for Jersey City animals. The HSPCA was contracted with Union City and North Bergen to receive their strays.

This not a permanent closure; the shelter will be closed temporarily until May 19th, when the HCSPCA is due to appear in Hudson County Superior Court.

While I am thankful to the Journal for covering both the charges against Zoe Carbajales and the founding of Hudson Animal Advocates I feel that two points in your coverage need to be revisited.
First, while Ms. Carbajales may identify herself as a volunteer, she is not. She decides when they are open, she decides who works there, she decides what volunteers are allowed to do, she takes in money, and she hires and fires. Finally, I have been copied on e-mails where SHE identified herself as the manager. Calling herself a volunteer is a smear on all of the great people who do volunteer.
Second, Hector Carbajales saying he is "interim" president is meaningless since he has been in the role for some time and there is no known plan to replace him. His refusal to name the board members of a supposed not-for-profit even as he says it is the board whom should have been charged tells you all you need to know about the HCSPCA.

New group wants action on long-troubled Hudson County SPCA

FINDING A NEW HOME ? Bayonne residents Sandra and Jeremy Richardson found Precious when they volunteered at the shelter in January and adopted her.
A group of local animal lovers is sick and tired of the long-running problems at the Hudson County SPCA shelter in Jersey City.

In the last 10 years, a shelter worker was accused of beating an animal with a shovel; shelter officials went to court because two Rottweilers allegedly disappeared; a wide-ranging state report blasted the then-manager for allegedly selling the dog food for personal profit, and two months ago, separate inspections by the state and city claimed there were piles of feces and neglected animals.

The shelter, located on Johnston Avenue on the outskirts of downtown Jersey City, was inspected this past January by the city and in February by the state, both of whom found violations. This came seven years after a 2001 state investigation charged that the animals "languished in overcrowded, poorly ventilated enclosures without adequate food, water, or veterinary care."

Six years ago, partially in response to that state report, a longtime animal rights group called the Liberty Humane Society actually founded its own, separate shelter in Jersey City, and eventually won a contract for Jersey City's stray animals to be sent there.

But the SPCA shelter still gets animals from Union City, and sometimes from Jersey City.

After the 2001 report, the shelter's management changed several times. So why are there still alleged violations?
Recent inspections

Some animal lovers in Jersey City have taken the step of creating a new group, Hudson Animal Advocates, which seeks to make the Hudson County SPCA compliant with city and state regulations.

"There are issues with cleanliness and competent medical care for the animals that need to be addressed right away," said David Norman of Jersey City, one of the founders of Hudson Animal Advocates, last week.

Jersey City Animal Control Officer Joseph Frank said last week that the current operators of the shelter, Hector and Zoe Carbajales, were scheduled to appear in Jersey City Municipal Court this past Friday to respond to the violations found in the city inspection in January.

When reached at the SPCA for an interview last week, Zoe Carbajales replied with a "no comment."

State finds more than 20 violations

A report on the state inspection of the Hudson County SPCA facility on Feb. 20 found more than 20 violations of state rules governing the operation of kennels.

The report, done by state inspectors Renee Cirillo and Heather Bialy, listed in detail the problems found at the facility.

The report alleged that the drains at the shelter were "not used properly and are backed up with feces due to unproper cleaning procedures where piles of feces are hosed into the drains instead of scooped."

Another entry in the report listed "disease control program is inadequate" with several dogs in the shelter found to be "significantly underweight" and one of the dogs exhibiting "abnormal" breathing.

Bayonne residents Sandra and Jeremy Richardson said that they volunteered at the shelter in January and found similar problems.

The couple, who have operated a pet sitting/dog walking service for four years, said they saw a listing on the website Craigslist soliciting volunteers to walk the dogs there.

"They had no cleaning supplies when we got there," Jeremy Richardson alleged last week. "The place was filthy."

What broke their heart were the conditions of the animals, they said.

"They were nothing but skin and bones, it was just awful," Richardson said. "I would cry every time I came home from the shelter."

The Richardsons said they stopped volunteering after Sandra Richardson had an argument with Zoe Carabajes over how she and her husband were treated as volunteers, she said, as well over the conditions in the facility.

But they adopted a new pet from the shelter, a miniature poodle, after they said they saw her covered in feces.

Advocating for a better shelter

David Norman, who lives on Fourth Street in downtown Jersey City, owns two dogs.

"I can not for the life of me understand how that shelter continues to operate when it's been cited not just recently but in past years for violations," Norman said. "There needs to be a change of the board of directors that is supposed to oversee the shelter."

Residents have said that they have been unable to get the list of directors of the shelter.

Thus, there is no way of knowing whether some of the people cited by the state investigation in 2001 are still on the board.

Hudson Animal Advocates is currently in the process of applying for not-for-profit status. This organization will act as a watchdog to make sure the Hudson County SPCA follows all laws when operating their shelter.

The group has enlisted the help of New Jersey Appleseed Public Interest Law Center, based in Newark, for pro-bono legal representation, and the assistance of City Councilman Steven Fulop to find out who is on the shelter's board directors and whether the shelter has a current license.

Animals have a new friend in Hudson County.

One of the founding members of Hudson Animal Advocates says the advocacy group's immediate goal is to urge "major reforms" at the Hudson County District Society for the Prevention of Cruelty to Animals.

"We're basically speaking for those who can't speak for themselves," said David Norman, of Jersey City.

The organization has retained the services of the New Jersey Appleseed Public Interest Law Center for legal advice.

NJ Appleseed attorney Diana Jeffrey said she will help the group'sef forts to "bring transparency and accountability to the HCSPCA."

The group also has the support of Jersey City Ward E Councilman Steven Fulop, who said the SPCA shelter has been the site of "repeated offenses."

A volunteer at the shelter yesterday pleaded not guilty to animal cruelty charges.

"Significant change there is really what we're looking for," Fulop said.

SPCA official faces charges, files countercomplaint

A volunteer at the shelter run by the Hudson County District Society for the Prevention of Cruelty to Animals pleaded not guilty yesterday to animal cruelty charges in Jersey City Municipal Court.

Zoe Carbajales, also the secretary of the SPCA's board of trustees, is facing a dozen charges from the city's Animal Control Bureau alleging that the shelter, under her care, left animals in filthy and dangerous conditions.

In return, she is pressing charges against Animal Control Officer Joe Frank, who cited her for the alleged violations.

Carbajales, who held a Bible and used a cane to help her walk in court, says Frank improperly took three dogs from the shelter after his inspections in January.

Frank pleaded not guilty.

Judge Richard Nieto set a court date of April 11 at 1 p.m. and told both sides to get attorneys.

Bob Vogt, an assistant health officer for Jersey City who also cited the shelter for two violations, asked Nieto for an injunction preventing the shelter from taking in any new animals. But the judge said he can't act until there is a motion filed and he has the facts in front of him.

Nieto said he hopes a motion will be filed soon.

"This is a very serious matter that is affecting the public," he said.

He added that since Frank was acting as a city official, the case may have to be moved to a different jurisdiction.

Speaking at the Johnston Avenue shelter after the hearing, Carbajales' husband, Hector, who said he is the "interim president" of the SPCA board, said his wife is not the shelter's manager and that the charges against her are unfounded and unfair.

"My major problem is, why is Zoe being charged?" Carbajales said, adding that the board should be the target of any charges. "Why is that individual being charged when that individual is a volunteer?"

He also disputed the findings of a state Health Department inspection that found unsanitary conditions and said his family has been assaulted since the charges were made public.

The SPCA has three paid employees but has not had a manager since the previous one left in December, Hector Carbajales said. He said the board has nine members, but he declined to give their full names.

The SPCA has contracts with North Bergen and Union City to pick up strays. Carbajales said each contract is for about $47,000.

If someone really wants to help, adopt one of their animals. They have a lot of cats too. I notice that a lot of attention is being paid to the pooches. I just went to craigslist and searched for their animals and found some real cuties including the one that Dr. Death killed: Martha.

Did you see the picture on page 5 in the JJ? That was the "vicious" dog ordered put down? Incredible. The dog had a 250 dollar deposit on it, and they killed it instead of letting it live out its life with a family.

How many other animals were needlessly put down by this shelter? It's only because Martha was adopted by an apparently "proactive" family that this story made it into the media.

There are others with similiar complaints against Dr. Young. She seems to think she has a right to take the law into her own hands and mistreats animals in the process.

She also has a rescue called Lend a Paw that she sells dogs and cats from. Some of these animals she steals from her clients that cannot afford to pay her fees.She is also a breeder of pure bred cats that she sells.

She is nothing but greedy and pathological.

The animal shelter run by the Hudson County District Society for the Prevention of Cruelty to Animals has been hit with violations again - and that's not the only trouble at the pound.

Officials from the state Department of Health and Human Services cited the Johnston Avenue shelter for 24 violations ranging from improper disposal of feces to missing records during a Feb. 20 visit, according to an inspection report.

The report noted that conditions had worsened since the state's last inspection in November, with some of the shelter's 12 cats and 37 dogs going without water and housed in cages that were too small.

Workers were hosing animal waste toward clogged drains instead of scooping it up, and had left as many as five piles in some kennels, inspectors found. The lights were out in a second building, which had an odor caused by poor ventilation, the report said.

The inspectors said that several of the animals needed prompt veterinary care, including three dogs who were briefly removed from the shelter by city officials after inspections in January.

Zoe Carbajales, the shelter's manager, said the SPCA is addressing the problems found by inspectors, but she declined to comment further.

The city's January inspections found similar violations at the shelter, which has not applied to renew its city license, according to Animal Control Officer Joe Frank. Those violations are expected to be taken up in Jersey City Municipal Court sometime next week, officials said.

Meanwhile, a Clifton couple has alleged that a North Bergen veterinarian who provides services to the SPCA improperly put down a dog they tried to adopt from the shelter.

Mary Schneider says that she and her husband Paul decided to adopt Martha, a pit bull, after playing with her at the shelter. They paid the SPCA $250 and signed adoption papers, and the dog was taken to the Kennedy Boulevard office of Kimberlee Young to be inspected and spayed, Schneider said.

Four days later, the vet told the couple that the dog had attacked several people at the office and would be euthanized - and Schneider says Young suggested they buy a dog from her rescue operation, Lend-A-Paw, for $400.

Young denies that, and says Martha may have suffered "psychological damage" from the conditions at the shelter. She added that the decision to put down the dog was made by the SPCA, and that the couple did not own the dog because they did not have possession of it.

Putting down dangerous animals is the "horrible downside" of dealing with strays, Young said.

The Schneiders say the SPCA refunded their money, but they are furious that Martha, who they say was not aggressive, was euthanized without their consent. They have written to the state Attorney General's Division of Consumer Affairs.
