"Roughed up" mayor's trial starts this week

BRADLEY BEACH — A year after his altercation with police outside a Bradley Beach bar, Jersey City Mayor Jerramiah Healy will try to defend his actions when he goes on trial this week.

The mayor says he was arrested and roughed up by police for intervening in an argument between a couple outside a Bradley Beach bar. Police say Healy tried to throw his weight around as a mayor, refused orders to leave, and became verbally abusive.

Healy, mayor of the state's second-largest city, is charged with resisting arrest, disorderly conduct and obstructing justice. If convicted, the charges carry less than a year in jail and $2,500 in fines.

The mayor has said that as he and his wife, Maureen, left the bar, they saw a couple arguing and the man jumping on the hood of the woman's car. Healy said he talked the man down, and when police arrived, the mayor said he told an officer the woman was not at fault.

Healy said the officer, without reason, threw him on the ground and used a chemical spray. When his wife tried to retrieve his glasses, police shoved her to the ground, hurting her ankle and leg, according to Healy.

"I've professed my innocence from day one," Healy told The New York Times for Sunday editions. "I've told the truth about this thing from day one. I did nothing wrong. I did nothing illegal."

A grand jury declined to indict officer Terry Browning in December.

The charges against Healy, who worked as a Hudson County prosecutor and served as chief judge of the city's Municipal Court, are not the first nor the strangest.

In 1999, he was charged with resisting arrest and obstructing justice, again in Bradley Beach, where he owns a home. A neighbor told The Jersey Journal that he watched police wrestle with a naked Healy on his front porch.

Records show Healy pleaded guilty to a disorderly person charge and paid $130 in fines and court costs.

While running for mayor in 2004, Healy was photographed nude on his front porch in Jersey City. At the time, Healy did not deny that the photograph was authentic, or that he had been drinking alcohol. But he insisted he had been lured outside by someone banging his trash can, and that he was not naked.

Mayor’s Turbulent Evening Is Big Case for Small Court

BRADLEY BEACH, N.J., June 14 — Here in this shore town, a land of funnel cake and miniature golf, the talk is not of ocean tides and sand flies but of pepper spray and handcuffs. Not of saltwater taffy and lazy afternoons with Stephen King, but of motions of emergent relief and mornings with a judge.

On one side of the divide is Jerramiah T. Healy, Jersey City’s mayor, who says he was roughed up by a Bradley Beach policeman. On the other are the police, who claim that a disorderly mayor inserted himself into a situation in which he did not belong.

When the trial opens on Monday morning, the matter will have dragged out a year and a day since the encounter between the mayor and the policeman.

In all, there will be 39 pieces of evidence. Twenty witnesses, including the daughter of a local councilman, are on notice that they may be called to testify in a shabby courtroom with folding chairs and a fraying carpet held down by duct tape. There will even be opening and closing statements from lawyers — a rarity for municipal court — but no jury. Testimony is to be spread over three days, but that may not be enough.

“I’ve had Superior Court cases with a lot less witnesses,” Jason Shamy, the municipal prosecutor, said after a recent hearing. He waved to his opposing counsel, James Fagen. “I think Fagen has had capital cases with less witnesses.”

Mr. Healy has been charged with disorderly conduct, resisting arrest and obstruction of justice. If he receives the maximum penalty for all the charges, he could be imprisoned for a year and a month and owe $2,500 in fines, Mr. Shamy said, although he acknowledged that the punishment could be a good bit short of that.

It all began about 2 a.m. on a Saturday last June, when Mr. Healy, 56, left his sister’s bar, Barry’s Tavern, after a meal and several Miller Lites. There in a parking lot near the bar, Mr. Healy said, he saw a man jumping on the hood of a car with a woman inside. He said that he tried to calm the situation, and that when the police came, he tried to explain what had happened.

But he said that a police officer, Terry Browning, pushed him to the ground, handcuffed him, and sprayed a chemical in both eyes. He also said Officer Browning pushed his wife, Maureen, to the ground, injuring a finger and an ankle.

But the police have a very different version. They say Mr. Healy repeatedly inserted himself into their investigation into the dispute, even after he was told to back off. Eventually, they said, Mr. Healy resisted arrest and “became disorderly.”

Mr. Healy, a former assistant Hudson County prosecutor and municipal court chief judge in Jersey City, said that his father was a bar owner who died trying to break up a fight, and, that in this case, he was confident he would prevail.

“I’ve professed my innocence from Day 1,” he said in a recent interview. “I’ve told the truth about this thing from Day 1. I did nothing wrong. I did nothing illegal.”

Mr. Healy filed a countercharge accusing the officer of abusing him, but the Monmouth County prosecutor threw it out in December.

This is not the first time Mr. Healy has been at the center of bizarre late-night incidents, or even the first time he has clashed with the police in Bradley Beach. Privately, some officials in Jersey City and long-time allies question the mayor’s wisdom in pursuing a case that has opened up questions about his past.

In 2004, when he was a councilman running for mayor, Mr. Healy was photographed naked on the front porch of his house in Jersey City — he says he did not remember how he got there — after drinking what he said were “six to eight beers” at a local bar.

The photos eventually made their way onto the Internet, creating a brief uproar, but Mr. Healy went on to win. Nor did the winning stop there. Just last week, he was elected chairman of the storied Hudson County Democratic Organization.

In August 1999, Mr. Healy, who owns a home in Bradley Beach, was charged with resisting arrest and obstructing justice, according to court records. David Dellett, a neighbor of Mr. Healy’s in Bradley Beach, told The Jersey Journal last year about the 1999 incident, in which he saw four policemen wrestle down a naked Mr. Healy on his porch.

Mr. Dellett said Mr. Healy would often hold loud parties that featured the playing of ukuleles and the singing of Irish tunes. Last week, a second neighbor, who asked not to be identified, also reported witnessing the same incident on the porch, adding that the mayor had unsuccessfully tried to hold onto a towel wrapped around him.

Court records show that Mr. Healy pleaded guilty to a minor disorderly person charge and paid $130 in fines and court costs.

Mr. Healy and his lawyers said they are not concerned about these cases coming up at trial. “It’s totally extraneous,” said Joseph V. Kealy Jr., one of his three lawyers. “Totally irrelevant. The only issue is what happened on the night in the lot next to Barry’s bar.”

In this latest incident, the officer at the center of the dispute, Terry Browning, who lives in neighboring Neptune with his mother, will be called as a witness.

“I know my son,” said his mother, Doris Browning. “I know he didn’t do anything he shouldn’t have done.”

She also said her son told her that the mayor was trying to throw his weight around on the night of the arrest and asked the officer, “Do you know who I am?” Mr. Healy denied making such an assertion.

Officer Browning has been the subject of legal challenges in the past. In 2004, he was accused of driving his squad car with the lights turned off when he ran into a bicyclist named Israel Sanchez, who had just left Barry’s Tavern.

Mr. Sanchez settled the case with the officer and the Bradley Beach police earlier this year for “north of $1,000, but not a heck of a lot,” said his lawyer, James W. Taylor. Barry’s Tavern helped pick up the lawyer’s bills.

In the end, even Mr. Healy’s lawyers acknowledge that not much good will come from the case.

“There are going to be no winners here,” Mr. Kealy said. “We are certain that the mayor will have been exonerated. But nobody wins here, the mayor — Mr. Healy — the officer in the case, the town of Bradley Beach. No one.”

I would seriously consider going from my historic monument (sorry, but that still makes me chuckle). Is there anyplace to see floorplans of any of these buildings? The websites don't have them, or at least they didn't the last time I looked. I have been to LHN and was shocked at how small they were and the A was pretty tiny too. Is Trump or Hovnanian appealing to empty nesters with features like separate dining rooms, windowed bathrooms, house size living rooms,etc? I hate to go to the showrooms if the apartments aren't worth considering. The faux graciousness of the employees always works my last nerve.

Also is the tax on all abated condos 1.7% of puchase price? That's what I was told at LHN.

I'd ad one more question, "How many of these gun crimes were committed by people who went through the process of legally obtaining a firearm in NJ?" I suspect almost none of them did so and therefore placing and even larger burden on those who legally own firearms (via more gun control) is not going to stop this type of crime. What it will do is create a moral hazard; as criminals become more confident that their victims will be unarmed they will be more bold.

Housing prices are getting down, but interests are going up, or something like that... Probably this will affect rents too, although something is telling me that, no matter what happens, I will not be able to move to Pavonia or UES. Some of us worry about much simpler things that buying a house, some of us are so beyond the clouds that couldn't care less, but you keep reminding us these things.
How about a more interseting description of the weather in Long Island? Could you at least refrain from starting a thousand threads?

This will be one of the very few developments that will do well. I can already hear people at their work place and around town saying with a sense of attitude - 'I LIVE AT TRUMP TOWER' - it will have an appeal to the 'brand name' sect and I say good luck to them!

The other brand name building is the 'W'- same sect will love telling people which building they are in.

P.S. I'm just looking at LI, and thus far I've seen several 4-5 Bd. houses with boat-slips for equivalent prices of 2-3 Bd. "Luxury" condos in JC, so yes I'm tempted, but I'm also patient.

I'm not going from rental back to ownership til' prices are back to the historical trend, which BTW, is 2001 prices

MANY Americans fear the consequences of a housing bust, but few know what one would really look like...In the 12 months that ended in March, for example, the median price of an existing single-family home in the Sarasota-Bradenton- Venice area of Florida fell by 12.4 percent, according to the National Association of Realtors (NAR). In Louisiana, in the area of New Orleans, Metairie and Kenner, the average price fell by 11 percent. And in the Reno-Sparks area of Nevada, the average decline was 8.8 percent, not far from Mr. Zandi?s threshold. So how far have prices actually fallen? The median price of an existing home has declined 4 percent, on average, since the peak in October 2005, according to the National Association of Realtors. Yet in some areas, by Mr. Zandi?s definition, at least, the market is already experiencing a bust. Over all, Mr. Zandi points out that 40 percent of metropolitan areas around the country are now experiencing declines in housing prices. But if the pessimists are right that there?s more to come, look out. A 10 percent decline in prices is likely to feel pretty awful. And then everyone might agree on what a housing bust is.

New Orleans, Metairie and Kenner = Not able to tell due to the state/county blocking internet access, but I'm sure the "reporter" could have got the hard #s if he wasn't spinning for the NAR

Reno-Sparks area of Nevada = Hey, the NAR actually reported the right number! Of course, who wants to live in Reno

Phoenix = -5.6%

Hoboken = -6.9% (Coming soon to Jersey City once the new bldg. specualators depart)

Another interesting point to mention about this econo-spin fluff is the curious lack of mention about house for sale (supply) being at all-time historic highs, which of course means this slide is just beginning, which of course is why this scared lil' rabbit of a reporter put out this happy talk to begin with

What's the future for the primary winners and losers - higher office, or no more politics?

Hudson County's heated June 6 primary saw the clash of two countywide Democratic factions. Now that it's over, several of the winners and losers spoke about their political futures and whether they will work together.

There were several political races that affected Jersey City - state Senate and state Assembly in each of the 31st, 32nd and 33rd state legislative districts; and Hudson county executive, sheriff, and clerk.

The Hudson County Democratic Organization (HCDO), the longstanding political organization in Hudson County, strengthened its hold on June 6 as its candidates won in all the major races except for the 33rd District state Senate and state Assembly.

The HCDO held a meeting last Wednesday at Ferris High School in Jersey City, where they elected Jersey City Mayor Jerramiah Healy as their new chairman, replacing retiring State Sen. Bernard Kenny.

Healy is considered by a number of political observers as benefiting from his endorsement of Sandra Bolden Cunningham for state Senate in the 31st District, who beat out State Assemblyman Louis Manzo on June 6. Cunningham now may support Healy in the 2009 Jersey City mayor's race.

The rival Democratic faction to the HCDO, known as the Democrats for Hudson County, also held a meeting last week. Their founder, Union City Mayor Brian Stack, won the State Senate seat in the 33rd District and his running mates won the two state Assembly seats in that district.

They held their meeting in Union City also on Wednesday where they elected Weehawken Mayor Richard Turner as their chairman.

'I don't see it as a loss'

Tom DeGise won the Democratic nod in the primary election for Hudson County Executive over his opponent Noemi Velazquez by over 10,000 votes. He will be facing the Nov. 6 general election Republican candidate Agha M. Khan.

DeGise said he is now looking forward to the general election, which he is expected to win, and then a next four years of getting down to county business.

"Actually, that's fun to think about," DeGise said. "I would like to proceed with completing the new branch of the Hudson County Community College Also, building a new high school for the Vo-Tech system. Build some more parks including a cricket field in Laurel Hill Park and a new one in Guttenberg. And continue my homelessness initiatives."

He continued, "I am planning to have a retreat with my top administrative guys to set some goals and get a plan of action."

Velazquez, for her part, was also happy about the results despite coming out at the losing end.

"I don't see it as a loss," Velazquez said. "I feel victorious considering how I did in the election."

Velazquez said she feels positive about how she finished in the election, considering she had what she described as "one-tenth of the budget" of her opponent.

Velazquez said this election has given her the confidence to consider a political future.

"I don't want to get too specific," she said, "but I am looking to pursue politics again."

Perez pursues office

Juan Perez will next be facing Republican opponent Gregory Rivera in the Nov. 6 general election, after winning a close victory in the Hudson County Sheriff's race over incumbent Joseph Cassidy.

On the man he might replace, Perez said "he's a good man" but had hoped Cassidy would have reached out to him on election night to congratulate him. Perez said he didn't reach out to Cassidy either.

"I expected the way he was attacking me during the campaign, that maybe he was very unhappy about his loss," Perez said. "But I wish him the best of health and success in all his future endeavors."

Perez said if he is elected in November, he looks forward to carrying out such initiatives as resurrecting the Operation TELON program that specializes in going after deadbeat dads, having officers take on more responsibilities, and initiate a Junior Deputy Sheriff Day.

Connors contemplates

Jersey City police officer Sean Connors lost by a 5 to 1 margin in the 32nd District State Senate race to North Bergen Mayor and incumbent State Senator Nicholas Sacco. Connors expected to have a tough time in this election but said he had "no complaints" about his finish.

"When I look at it, the HCDO machine was totally against me," Connors said. "I didn't have one local official supporting me yet I beat them in 16 out of 29 in Ward D [Jersey City] and 22 out of 49 in the 33rd District."

When asked if running for his first political office whetted his appetite for a future political run (Hint: Jersey City City Council), Connors said "it was way too early" to consider any moves. Connors, if he ran for a City Council seat, would be running in Ward D, which is currently represented by Bill Gaughan.

"If the people feel I will be a better representative than who is representing them now, then I will listen to the people," Connors said.

He said in the meantime he will continue to work on issues such as the juvenile justice system and parking.

Fulop and Healy: Democratic primary and mayoral future

Healy obviously was happy that the candidates he endorsed in various races won, such as the 31st District state Senate race.

"We have a state senate seat back in Jersey City," Healy said. "[Cunningham] is the first woman state senator in Hudson County history as well as the first African-American woman."

When asked if being named chairman of the HCDO has given him inside track in winning a next term as mayor in 2009, Healy said those situations will not factor into any future mayoral run.

"Regardless of what has happened recently, I am running for mayor based on my record," Healy said. "That is, hiring more police, including more officers for our gang squad, and getting the one handgun per month bill passed in the state legislature."

City Councilman Steven Fulop is also seen as a potential mayoral opponent to Healy. But one had to wonder if his endorsement of Louis Manzo and his running mates for State Assembly, who all lost in the primary, were setbacks for future political aspirations.

Fulop disagreed with that assessment, citing Sandra Cunningham's overwhelming success in Jersey City's predominantly African-American Ward F as the reason Manzo lost.

"We did really well in the districts downtown but there was a strong message sent by the African-American community overall," Fulop said. "Everything would dictate that I shouldn't have done that but I believed [Manzo] would have done the best job."

However, Fulop said there were "lessons learned" from this past election and was planning a meeting this week with supporters for "better political organizing."

He denied the meeting had anything to do with any future run for mayor or another political office.

Obviously we have a problem here in Jersey City with the Professional Criminal Element (MUTANTS ) and guns. Hardly a day goes by without some type of mayhem and gunfire on our streets. Our Politicians ( HEALY ) and Prosecutor Edward J. DeFazio are quite vociferous on the need for more Gun Control but I am a simple man with simple questions.


Are the Mutants getting Paroled between shootings?

Are these Mutants experiencing the full weight of our current laws when caught?

Are the Mutants getting prosecuted on lesser charges?

What percentage of the Mutants are repeat offenders?

When a Mutant gets shot who pays for their medical care?


Thanks to the diligence of Grove Path we have a long list ?Mutant Activity? in our City and thanks to N.J.S.A. 47:1A-2 we have access to most records.


I think I see a Database in my future.

Yeah, the guy running kannekt is a shit when it comes to deleting posts. But it doesn't really matter, most of the people posting on the Jersey City kannekt boards don't even live here. Most of them are speculative real estate investorss or realtors. A good rule of thumb is you shouldn't post anything on kannekt that is worth posting because it will be deleted, and you shouldn't believe anything posted on kannekt because its all fluff being posted by real estate brokers.

Action Alert: County Planning Board to Hear Embankment Applications June 20th

June 15, 2007

Dear Embankment Coalition Supporter,

A soon-to-be-issued newsletter will update you on many Embankment activities, but for now the Coalition has an urgent request.

We need your presence at a Hudson County Planning Board meeting:

Wednesday, June 20
6:30 p.m.

Chambers of the Hudson County Board
of Chosen Freeholders
567 Pavonia Ave
Jersey City

The Board will be considering applications to subdivide the four westernmost Embankment blocks (from Erie to Brunswick Street). These applications have been filed by the developer to whom Conrail sold the Embankment, as we await a federal Surface Transportation Board ruling on the validity of the sale.

The County board usually applies narrow criteria to such applications (do the subdivisions affect a County road or County drainage?). We want to remind the board that subdividing this historic site will defy both the spirit and letter of the County's Master Plan and Open Space Plan, not to mention the wishes of the thousands of County residents who have petitioned for Embankment preservation.

The County Master Plan emphasizes the importance of historic preservation. The Open Space Plan makes the Embankment a priority acquisition site. Why should the Planning Board subvert the County's own planning by approving these applications?

What Can You Do?

Show up. Sign the speaker's list. When it is your turn, introduce yourself and say, "I am opposed to the subdivision of these properties, which are not vacant but contain a historic structure."

Tell us you will be there by sending a brief email to moher1@aol.com or calling 201-963-0232. If you want to do more, need more information, or would like a ride to the meeting, be sure to let us know.

Or maybe it would just be a way so that people who aren't obsessed with real estate can carry on other discussions on JCList without having to wade though 90 real estate related threads. It's not like this board is primarily focused on real estate.

Threads exist for a reason -- so that people who are interested in a topic can find it and those who aren't don't have to wade through irrelevant messages.

I think the name thing was more of a play on words than a non sequitur.

I do agree with skwirriking that since there is already a (quite long) thread on the health of the RE market, it would probably be nice to keep posts on that subject in that thread.
