Walking into a gate is clearly a stupid move. Whomever it was wasn't paying attention. Texting, drunk, born stupid, whatever.

There was a sidewalk heave on York where the streetlight would cast a shadow over the heave at night. About 6" wide, perfectly over the lifted sidewalk. It claimed my gf three times before she learned to lift her feet.

Everyone looks out for the errant dog pile or bit of debris when walking. A gate is no different. Your chipped tooth friend learned a valuable lesson.

Yes I believe there is a legal liability for shutting of the gates but if you are at work and a pass-a by person accidently thinks your property is their destination then on the way out leaves the gate open who's at fault ? Not to mention the mailman or delivery guy. One thing is for sure gates, sidewalks, curbs one should not wear open toed shoes such as sandals, nor text while walking.

I have seen too many people (mostly children) run, skate, ride and walk into front gates left open into the pathway of the sidewalk. Homeowners and renters alike have the legal (and moral) responsibility to keep the sidewalk in front of their homes as safe as possible; as is true after a snowfall. Many I have seen have broken latches preventing them from staying shut. Is it too much trouble to fix? I have a friend who actually chipped a tooth walking into one. I kind of understand how hard it is to fix a rising sidewalk from roots of trees; that's not an easy fix. I continue to trip on those every block. They're a lot fun with sandals on too. We can do better JC. Come on now, be nice.
