Jersey City brothers plead guilty, face 5 years in horrific 2011 drag-racing death

Two brothers from Jersey City have plead guilty to lesser charges in a 2011 street-racing incident that resulted in one pedestrian dying after being impaled on a fence.

Giancarlo J. Guevara-Cabezas, 21, and Carlos J. Guevara-Cabezas, 26, each pleaded guilty to one count of third degree aggravated assault and one count of fourth degree aggravated assault by auto as part of a plea deal.

The brothers are expected to serve five years in state prison.

Jersey City lawyer says he's identified dead man in accident

The Jersey City man who died when he was struck by a car and impaled on a fence off Journal Square on Tuesday has been identified by an attorney retained by his parents in Mumbai.

Yesterday, attorney Zareh Beylerian, of Anise and Anise in Jersey City, told The Jersey Journal that friends of the victim contacted him after the man?s death and he has the man?s passport and other belongings.

He contacted police yesterday and as a courtesy to investigators he has identified the man only as Mr. Patel at this point.

At 3:30 p.m. yesterday, police reached out to Beylerian and the lawyer arranged to provide information he says will allow them to verify the victim?s identity. Investigators have been seeking the public?s help in identifying the crash victim.

The lawyer said he is in the process of arranging for power of attorney for a member of the local Indian community so the person can make funeral arrangements for the victim. He said he is also contacting the embassy in Mumbai to get visas for family members so they can travel to the United States to mourn.

Beylerian said a wrongful death suit will likely be filed, adding: ?We have to await the full investigation from police and take it from there.?

The pedestrian, who was on the sidewalk, died after being struck by a car during the three-vehicle crash at 10:49 p.m. at Kennedy Boulevard and St. Paul?s Avenue, police said.

The victim, described at the time as being of Indian descent and 25 to 30 years old, had no identification on him. He was struck so hard by the car that his body damaged a cast iron drain pipe when he slammed into a building, reports said, adding that he then fell onto the spikes of a wrought iron fence.

Following the crash, Giancarlo J. Guevera-Cabezas, 19, of Tonnelle Avenue in Jersey City, was issued summonses for speeding, reckless driving and making an unsafe lane change, reports said. It was his vehicle that struck the man who died, as well as a 19-year-old man who suffered a leg injury, reports said.

Giancarlo?s brother, Carlos J. Guevera-Cabezas, 24, of the same Tonnelle Avenue address, was driving a silver Honda Civic and he was issued summonses for speeding and careless driving, reports said.

His car spun out of control, crossed into oncoming traffic and collided with an SUV driven by a 30-year-old Bayonne man who suffered a broken wrist.

The two brothers also sustained injuries.

Anyone who witnessed the crash is asked to call the Jersey City Police Department at (201) 547-5245.

Jersey City police are still trying to identify the man who died after being be struck by a car and impaled on the spikes of an iron fence off Journal Square on Tuesday.

The pedestrian died after being struck by a car during the three-vehicle crash at 10:49 p.m. at Kennedy Boulevard and St. Paul?s Avenue, police said.

The victim, described as being of Indian descent, had no identification on him and police think he may have entered the country within five days of his death. He is described as being 25 to 30 years old, police said.

The victim was struck so hard by the car that his body damaged a cast iron drain pipe when he slammed into a building, reports said, adding that when he fell he landed on the spikes.

Following the crash, Giancarlo J. Guevera-Cabezas, 19, of Tonnelle Avenue in Jersey City, was issued summonses for speeding, reckless driving and making an unsafe lane change, reports said. It was his vehicle that struck the man who died, as well as a 19-year-old Palisade Avenue man who suffered a leg injury, reports said.

A man died Tuesday night in Jersey City after he was struck by a car and then impaled on the spikes of an iron fence, officials said yesterday.

?He wasn?t moving at all,? said Imran Ahmed, who heard the 10:49 p.m. crash at Kennedy Boulevard and St. Paul?s Avenue and rushed there before emergency responders.

Ahmed said he arrived to find the victim hanging upside down from the fence in front of School 31. ?I felt very bad for that guy.?

The victim, who is still unidentified, was walking past the school when he was struck by one of three cars involved in a crash on Kennedy Boulevard.

He was hit with such force that he was thrown through the air and damaged a large cast iron drain pipe when he slammed into the brick school, reports said. When he fell, he landed on the spikes, reports said.

Following the crash, which sent four other persons to the hospital, Giancarlo J. Guevera-Cabezas, 19, of Tonnelle Avenue in Jersey City, was issued summonses for speeding, reckless driving and making an unsafe lane change, reports said. It was his vehicle that struck the man who died, reports said.

Guevera-Cabezas? green Honda Civic also struck a 19-year-old Palisade Avenue man who was knocked to the ground and suffered a leg injury, reports said.

A witness told police the two Civics were both in the left lane, heading south, and ?traveling fast? when they passed Route 139. The green car then tried to pass the other car in the right lane, reports said.

The witness said it appeared the green Honda struck the other car during the pass and the silver Honda went into a spin, crossed into oncoming traffic and collided with an SUV driven by Jason A. Bermillo, 30, of Kennedy Boulevard in Bayonne, reports said.

That?s when the green car swerved right, jumped the curb and struck the two pedestrians, reports said.

The brothers told police they lost control after their vehicles were struck by another vehicle, which left the scene, reports said.

Bermillo, a registered nurse, said he was driving to work at a Union City nursing home when the silver car went out of control.

?Suddenly he appeared in my lane. I didn?t even have time to hit the brakes. They were going very fast, 50 to 60 (mph),? he said yesterday at his home. ?I couldn?t tell if they were racing, but they were going to fast.?

The man who was killed was described as being 25 to 30 years old, but he had no identification on him and police still don?t know who he is.

Jersey City firefighters had to cut a section of fence to free him, Fire Director Armando Roman said. He was pronounced dead at the Jersey City Medical Center at 11:29 p.m. Tuesday, reports said.

Giancarlo and Carlos Guevera-Cabezas were also taken to the Medical Center, reports said. Carlos Guevera-Cabezas suffered two broken legs and was transferred to another facility, while his brother was treated for minor cuts, reports said.

Anyone with information on the dead man?s identity is asked to call the Jersey City Police Department at (201) 547-5245.

Amazing that they only got some tickets. How fast would they have to be speeding to launch someone through the air with enough force to break a cast-iron fitting and high enough to land on top of a fence? If the cops shot these 2 douche-bags I don't think I'd be too upset.

I was on Kennedy after it happened, and it was shut from Rt 139 to St Pauls.. I didn't know what happened until I heard it on 1010 wins in the morning. For the most part I say people who drive on Kennedy goes 30-50 MPH around this area..
