Just a thought here - when you get the next commercial lease written, I would consult a lawyer (or a better lawyer than the one you used) to write the lease and plan for contingencies like these.

Assuming you can track the guy down, I believe you could file a case in small claims court without a lawyer. But, if he doesn't pay up on any judgement due to you, you would need to know which bank he has his business and/or personal accounts in order to collect. Also, was the lease between you and him, or you and his business entity? You may have to sue both.

It is my first time dealing with commercial lease and does not have cited anything that I have to bill him. But, he terminated the lease on his own and moved everything out overnight.

My lease allows for any fines & legal expenses incurred due to a tenant's actions to be recovered "as additional rent". Does your lease have that?

If so, starting billing your tenant. If he fails to pay, file for eviction in landlord / tenant court.

Bill Matsikoudis was the city legal expert, corporation counsel during the Healy years. He has his own practice now. If I was in your shoes, I would call him.

I rented a commercial space to a tenant who opened a pizza store without any permits. He was telling me that he is working on permits and had couple of issues with zoning. But, then he opened a pizza store and I assumed that he resolved all the issues. Then I got a fine of $2000 for him operating on a space without C/O and permits.
I closed on this house two days before we all went into lock down because of covid.

Does anyone knows a good lawyer that deals with municipal violations?
