Don't waste time with access issues, let the insurers worry about that. Give notice of the occurrence to your liability insurer and the liability insurer for the building. Find out who the liability insurer is for the upstairs unit and give it notice too. The rest will work itself out. PM if you need additional help.

Yes, your By-laws should have an area where the unit owner can be fined daily until a situation is rectified. If your building has more investor owners than owner occupants, enforcement would be difficult. You should definitely get together with the other owner occupants to see what your options are.

Read what is in your by-laws. There could be a clause that the owner is fined for not allowing repairs. No owner want that expense.

I own my unit, but our building is increasingly occupied by renters who lease their units from absentee/investor owners. This situation has long caused problems with enforcing the house rules, increased wear and tear, etc.
Now I have an ongoing leak causing damage in my bathroom and kitchen. The managing agent called a contractor, however the residents in the units above me in my line did not make themselves available to be home when the contractor came. I think I may need to push the managing agent harder and/or confront the absentee owners to get them to live up to their responsibilities - any suggestions for a lawyer who deals with this, who you might recommend?
