STRONGLY recommend Dianne E Laurenzo, 201-448-8068, office in Hackensack and Hoboken.
When we bought our current DTJC condo, it was tenant occupied, they refused to leave, the owner started a costly eviction process, it was a nightmare as we had already closed.
Dianne breezed through the nightmare, she answers her phone, in addition to real estate she is a criminal lawyer, she sorted out the whole mess with no loose ends, which is what we all want.

When the tenant file the complaint again, will the court accept his filing, and go over the same process again, and arrange another court date?
Are there any limits on the number of time he could file, or the limit on duration?

The case can be brought up again(happened to me on eviction case last year). If it happens don't panic, just come and layout the facts. The justice usually prevails :)

Update:

I went to the court in the court day. It turns out this tenant did not show up. So, the Judge dismissed the case.

Here is my question, if any of you knows the law.
Can the law still accept the case if the tenant decide to file the complaints again?
If yes, then what can I do in the situation of that he failed to come to the court in the first filing?

2. I mailed remaining deposit to him, but he refused to deposit the check. What should I do with the deposit?

Like I said, I think the court will see this BS for what it is and tell him to get lost. I would not waste my money on a lawyer. Contrary to popular myth, the court is pretty sympathetic to small landlords representing themselves, often with poor english, and they hear a lot of BS from tenants. When I had tenants getting evicted that were months late, the mediator wouldn't even hear their complaints. Once they said they didn't have the money there and then, they were toast.

I can't imagine what he expects to gain here, it's not like the court can order you to heat his apartment, he's no longer your tenant! Cancel the previous check, and show up with a certified check for the balance due (minus the cost to stop the check).

And ask these collections clowns to provide you proof that you owe anything at all. I don't know why this is surprising, banks have been foreclosing on properties they don't own.

Yes, I sent the check by registered mail, and Tenant did receive the mail. You are right that I could not
prove the check in the mail.

As you could tell as well, the complaint is empty. However, he could make anything up, for instance, he could say that
the heat was not enough during his stay. Of course, this was not true. But, what should response to this claim on the court?

Wow, he handed you a big steaming pile of bullshit! Personally, I'd go without a lawyer to court and see what's up. Speak as little as possible, and only facts. The 2 times I've been to eviction court there was zero tolerance for bullshit. I can't imagine what collection agency would accept such a thinly documented debt, but that's not a business I know a lot about.

The undeposited check is an interesting problem. I wonder how one protects themselves against that, send it registered? But that doesn't prove there was a check in there.

Here is the problem. I am trying to make it as short as possible.

I filed an eviction for non-rental-payment. Then before the scheduled
court day, the tenants (family) moved out.

After he moved out, he filed complaints to the county court, and the following is full
contents he wrote in the complaint:
1. Did not comply with written or oral contract
2. Merchandise I received was defective.
3. Gave Landlord security check and was not fully returned.

those are all he said, and without any details. For the 1st and 2nd complaint, I could guess what
he meant, but since there are not any specifics, I don't know what I can start with. For the 3rd one,
I have already returned the remaining security deposit after I deducted the last rental, the fees for filing
eviction. But, he did not deposit the check.

I wrote a reply to the court as requested by the court. After that, the court scheduled a day for me and the tenant to appear.

My question is, should I hire a lawyer for the court appearance?

In addition, while we are waiting for the court appearance, the tenant asked a collecting agency, and ask me to pay $268.54 for settlement,
I don't know where he got this amount, but what should I do the response the debt collect agent?

Since this is first time for me as landlord to deal with this kind of situation, so, I am thinking to hire a lawyer, and to completely resolve the case

Any thoughts? Thanks for your input.

Wish I could help. In my experience there's no one who specializes in this, it's just a part of the practice of the bottom tier of lawyers who make Saul Goodman look like a white shoe attorney.
