View Larger Map Jersey City ex-con is arrested after pointing gun at drunken man, cops say By Michaelangelo Conte/The Jersey Journal March 03, 2010, 9:55AM Wade Street and Martin Luther King Drive in Jersey City A Jersey City criminal is back behind bars after being arrested yesterday morning by police officers who were responding to a call reporting a fight. They found the suspect aiming a gun at an intoxicated man who hadn't even noticed the weapon, reports said. Damian L. Marshall, 30, of Woodlawn Avenue, was arrested at Wade Street and Martin Luther King Drive at 2:07 a.m. and charged with aggravated assault with a deadly weapon, resisting arrest and other weapons charges, including possession of a firearm by a felon, reports said. Officers racing to the location of the fight found Marshall pointing the loaded Smith and Wesson at a 31-year-old East Orange man, reports said. Marshall dropped the gun at his side and then became combative with police who used "reasonable force" to subdue and handcuff him, reports said. Police spoke to the victim, who was "under the influence," and learned that he had not noticed that Marshall had been pointing a gun at him, reports said. Because the East Orange man was in an "altered state," he was taken to the Jersey City Medical Center by ambulance, reports said. Marshall was taken to the South District Police Station, where he complained of pain and was also taken to the Medical Center by ambulance, reports said. Officers also found there was a warrant for Marshall's arrest out of the Jersey City Municipal Court, reports said. Marshall was in prison from Dec. 3, 2004 to April 5, 2005 on a conviction for unlawful possession of a handgun, state corrections records say. He has gone by aliases including Keith Clark, Damon Damien and Damien Marshall, records say. In July 2007, Marshall was sentenced to parole on a drug possession charge, Hudson County Prosecutor Edward DeFazio said. Since then he has been indicted on the charges of drug possession with intent to distribute within 1,000 feet of school property and he was out on a $50,000 bail when arrested yesterday, DeFazio said.
