Can it really be true that no one on this Board knows where and when the Jersey City Construction Board of Appeals meets? It should be an open public meeting, as required by N.J.A.C. ? 5:23A-1.5 and N.J.S.A. ? 10:4-6 et seq. The Board cannot possibly meet the requirements of the statue if adequate notice of the meetings is not made available to the public, and agendas are not published. Surely the City would not allow this to occur? Particularly as the Law permits any person to file a lawsuit in New Jersey Superior Court to invalidate any action taken by a public body at a meeting which violates the Open Public Meetings Law. The lawsuit must be brought within 45 days after the public body?s action sought to be nullified has been made public. In addition, any person may apply to New Jersey Superior Court for an injunction or other judicial relief to insure future compliance with the law.

The zoning and planning board minutes are posted up on the cityofjerseycity.com website, but I have never seen them for the construction board.

The New Jersey Administrative Code contains the provisions copied below regarding Construction Boards of Appeal. Does anyone know or have any experience with where to find the Public Notices of the meetings and the offices of the Jersey City Construction Board of Appeal for inspection of the decisions? I'd like to find out a bit more about this board.

N.J.A.C. ? 5:23A-1.5 Board meetings
???(a) 2. Public notice of all scheduled and special meetings shall be given, and meetings shall be open to the public, as required by the Open Public Meetings Act (N.J.S.A. 10:4-6 et seq.). Additionally, copies of all notices of meetings shall be provided by each board to the Office of Regulatory Affairs.

N.J.A.C. ? 5:23A-2.3 Board decisions
???(a) 3. Copies of all board decisions shall be deemed to be public records and shall be available for public inspection at the offices of both the board and of any local enforcing agency or other governmental agency that is a party to a case.
