I'm all for making JC more bike friendly. But in conjunction with this, I want to see laws enforced on the many rogues cyclists who frequently:

- cut off cars
- ride without a helmet
- use crosswalks to ride/cross against the light to get across an intersection (this is the worst!)
- ride on sidewalks

This is crazy to me. How can the police refuse to say what the speed of the vehicle was? How is that legal in court?:
"Authorities allege Spolizino was speeding ? the speed limit on Kennedy Boulevard is 25 mph ? but have refused to say how fast he was driving. Jersey City officials, responding to a public-records request by The Jersey Journal, provided copies of the summonses Spolizino received, but the handwriting on the tickets is illegible."

Perhaps you should use the ENTIRE quote by Kelleher back in 2011 - see bolded - rather than taking the first part out of context?? Also I was only asking about the logic of the latest proposed changes/move of the dept., not who should/shouldn't lead it.

Exactly. And the pedxing WALK signal will not turn to WALK when the lane adjacent to it has the left turn signal up. ie., when cars have the left green arrow on Columbus East bound to turn left on Marin, the ped sign intentionally says DON'T WALK/RED MAN. Peds know this, they are just being rude to the drivers when the drivers have the very short turn light window.

Please reach out to the Police Captain in the East District (dtjc) about this. I did get a reply from the West District command indicating there is a noise ordinance for loud exhausts, and that traffic officers patrol until 10pm generally. The responding officer indicated he would I will discuss a plan to address this ongoing quality if life issue with his officers and get back to me.

I bet East District would take you seriously. You guys have to join in on speaking up to help us get this addressed city-wide.

I encourage anyone bothered by these riders to write their JCPD District commander/Community officers and CC your Councilperson(s) AND the Mayor. If they get enough Quality of Life Complaints from various neighborhoods on this, we may get some better answers/solutions.

EZ Towing is still at its predatory practices. Just happened to me in my neighborhood in a lot. I got to the car when it was 6" off the ground on their hoist. They demanded $150, cash only, to release it. They are suppose to let it go if you return to the vehicle. I've contacted NJ Consumer affairs, I have pictures to prove it.

Does anyone know if JC has any sort of city consumer agency? I'd love to see these guys busted.

He left the scene, as in he didn't stop his vehicle upon impact. Or pull over to see what happened. In fact, he drove about 1.5-2 blocks away before he returned to the scene. There were no skid marks at the scene. Per witnesses, he hit and ran, then returned. What he did in those estimated 60-120 secs. before he returned, we do not know (Like call a buddy for help, maybe??). So I hope his cell phone records are checked. Seems like the guy was driving so fast he has no idea he even hit anyone/anything. Then it dawned on him and he came back.

On the probably cause issue for breathalyzers, I personally feel that excessive speeding and a severe injury/fatality are major evidence of "probably cause".

No one thinks a car accident alone is a crime. But it is a crime to kill someone and leave the scene of the accident.

Agree completely. The victim lived in my building, btw. Also, there were many witnesses, and they gave their names, contrary to the reports. The summonses the driver received came about a month after the accident, (why??), police still refuse to release the 911 recordings, and they still won't say how fast he was driving. There were no skid marks, driver kept driving after impact. Victim was tossed about a half block down the road from point of impact, would have gone further had body not flew under parked cars between Fairmount and Montgomery. Witnesses reported that the car didn't even stop until it was well under the pedestrian bridge past Montgomery. We also haven't received any verification of the drivers phone records and cell phone usage work acquired. There is no proof that he didn't make a call to his buddies before coming back to the scene. Yes the indictments have been made against him, which is a start. and I hope it's a fair trial. But the greater concern at this point in my opinion is the lack of investigation as to how the police and sheriff's office have handled this entire thing since the accident occurred.

No offense, but how can getting priced out of a neighborhood be a positive and the key sign that an area has come around, as you say? A lot of great middle income people got priced out of dtjc in the past few years. I lived there since 1995 & hated to leave last summer for another area due to the extreme over pricing. I find a lot of the development in dtjc to be out of control and not smart urban planning in terms of the exponential added density. I also find the diversity fading a bit too much for my taste.

We almost moved to Lafayette last year. For us, the few transportation options didn't work for us as my boyfriend works until 10:30, getting back to JC after 11pm nightly. Otherwise, we liked it.

As I recall from my days as a newsman in NJ courts, I don't think speeding and reckless driving would normally be included in an indictment because they are traffic offenses, not criminal offenses. Prosecutors can go directly to trial without an indictment for those, normally in a municipal court.

When related criminal ("indictable") charges are also involved, as they are here, the traffic offenses get dragged up to the Superior Court criminal trial and are usually considered "lesser included offenses" to the more serious charges. They don't tend to have much consequence there unless a verdict or a plea wipes out the more serious charges, in which case there is often a conviction for just the lesser offenses as kind of a fallback.

This. It has to be a balance as to how its done. You should definitely call your District's office about this. Just make sure you tell them how much you like seeing the enforcement but that you think perhaps the present officer is putting other drivers in danger by driving a bit too recklessly.


I live on JFK blvd. near SPU, near where the fatality happened in April, I am ALL FOR more enforcement on this road. Its long overdue.

Can you be specific as to what part of JFK Blvd. this is happening around? If this is in Ward B, and parts of Greenville, you can call Lt. Voutsas, the new West District Command's community relations officer. Tell him what's going on. I've found him to be pretty helpful.

There is no red light camera at that intersection (Fairmount & JFK). However, there is a camera at the light before and after it. Also, St. Peter's U. may have some footage, but I do not know.

There's a distinction between the summonses that were issued right away for the traffic violations, and the criminal charges brought in the indictment by the grand jury.

Right, that's what I was trying to explain. Where are the criminal charges for speeding and reckless driving, along with the standing Manslaughter charge? He got sumonses for them, but they are not part of the criminal charges. Perhaps I am unclear on what actions fall under the current charges (ie, does speeding fall under "death by auto"?)

Also, if you recall, it took several weeks for those initial summonses to be issued against the driver, no blood/breathalizer were taken, and the police refuse to release the 911 recordings or the speed he was travelling at time of impact. This whole thing smells bad, IMHO. All because the perpetrator is a cop. If he wasn't a cop, you can bet it wouldn't have been handled so poorly.

A few of us are planning to speak on this issue before the City Council mtg. on Aug. 28th. We plan to ask them to demand of the County Prosecutor an answer as to why there is such a difference in the indictments when the basic fact of a the violent death by an out of control vehicle is so obvious. If anyone wants to join, or just come to the meeting to show support, we'd appreciate this.
