A trial date has finally been set to determine the fate of two dogs who face possible euthanization after being accused in three attacks in Downtown Jersey City.

Yesterday afternoon Jersey City Municipal Court Judge Nesle Rodriguez set May 8 to start the trial at which Susan Kolb intends to defend her South African boerboels, Jumba and Imani.

The dogs have been held at Liberty Humane Society since Jan. 21, two days after the last alleged attack. The trial date has met with numerous delays as Kolb's lawyer waited for prosecutors to turn over pictures, statements and a witness list as part of the discovery process.

Meanwhile, Kolb has taken her fight to the Internet. She has a Web site - bringjumbaandimanihome.com - that tells of the dogs remaining at the shelter.

"Today, they sit on death row with no firm date set for a hearing or a trial," the site's home page said yesterday. "The dogs' family are at wits end and quickly going broke battling to save the dogs they love. The family moved at great expense to a house with a backyard and a 6-foot high fence. They purchased a secure kennel, yet . the city of Jersey City continues to delay."

At yesterday's hearing, the municipal prosecutor said all discovery had been turned over to defense attorney Gina Calogero, but it quickly became clear that was not true.

Calogero told the judge her client has been to numerous hearings and "Every time the state asks for more time. And oops there's more, and oops there's more and oops there's more. She would like to know there is a definite court date."

Calogero and the municipal prosecutor then had a lengthy meeting outside the courtroom and when they returned Rodriguez set April 9 as a deadline for turning all the material over to the defense and the judge also set the trial date.

Jonathan L. Rodriguez, 24, of Brunswick Street, was injured on Jan. 19 at Washington Street and Christopher Columbus Drive. He said Kolb unleashed the dogs and they ran across the street and tore into his arm. Kolb said the dogs got away from her.

James Joyce, 24, said he needed six stitches after being attacked on Jan. 9 by the dogs at Warren and Morris streets. Kolb said Joyce was not injured.

On Sept. 21, at the park at Greene and Essex streets, police said the two dogs, reportedly unleashed, knocked down a woman and the 6-month-old child she was carrying. Kolb said she thought the park was empty. All four alleged victims needed medical treatment.

Thanks for the simplistic translation, but what I am saying is that I prefer to award legal hardworking people, and if they fall on hard times, we pick them up. That we would be able to do much more easily if they didn't get lumped in with society's drains and waste of space.

My grandparents came here with less than $14, but they came here legally, worked and strived. I am sure they took handouts along the way, but they never looked at such things as entitlements. They learned English so that they could fit in and be American. Not some hyphenated form of American. They didn't come here and then cut themselves off to form their own society.

Well "regulator", I thought you would have been able to get my point, but I will spell it out in simpler language for you to understand in this hypothetical, which I hope is not a "legitimate scenario". That taxes the working who try to do things legally, just to pay for the lazy. I went to highschool, , college, grad school; avoided trouble; so that I could succeed. And I would say a good portion of my "rewards" goes for those who had a much better time and ignored society's rules. No one has personal responsibility under a welfare state.

In any event, I think for the most part "illegals" are good moral, hardworking people, but what part of illegal do you not understand. I just think the world would be better off if they did their hardworking back at home, rather than sending $$$ back there and contributing nothing here.

And K-Lo--offering drivers licenses will not, for the most part, mean that those you don't want on the road will be licensed and have insurance. It's just a first step towards regulator's legalization.

Well "regulator" we here in the thinking-world are hoping that no amnesty is granted because, quite simply, the illegals simply do not earn enough to make any meaningful contribution to society, unless you think draining education, healthcare, prison and welfare services is a contribution. Round em up and ship em out-and while we are at it-fine and jail their employers. I can mow my own lawn. And "Gnomegeneral"-what tiny piece of dirt is your mom having mowed for $10? Even the illegals won't show up for that.

Why exactly should the cops be commended for finding these three shooters!? It was broad daylight, there was a direct witness that pointed the cops in the shooters' direction, and they were only 2 blocks away. If anything, JC schools should be reprimanded for not teaching their students the correct way to commit a crime and leave the area. Maybe that's why the schools suck-so the cops' jobs will be easier.

Recent report on nj.com indicates that drug paraphanalia was found in the room and a male was seen with her. Sure, there could be other conclusions-but taking them too seriously is how OJ got acquitted of murder. I really doubt a nice couple was checking into that hotel for their honeymoon.

News reports generally indicate the deceased was a drug whore, so TammyD, go cry a river somewhere else. Not every death is a murder or a tragedy. And if this was MY FAMILY I would have done something for her before she died, not complain about the comments after. You never posted anything on here before-Did this hit home?

3. FACT: Carbajales uses the services of Dr. Carlos in Union City (USAC). Have animals been brought to that vet for vetting or euthanasia? Reports from a local rescuer claimed that the steel cages were in Dr. Carlos\' basement but have since been removed. Inside those cages were several dogs that did not belong to clients. Items \"stolen\" from the HCSPCA included steel animal cages. Sounds like filing a false police report if those cages were HCSPCA property.

4. FACT: A NJ State SPCA investigator did not inspect the HCSPCA despite pleas from volunteers. Two witnesses have come forward to report that the inspector \"hugged\" Ms. Carbajales and announced, \"I\'m here for the inspection.\" He left moments later without inspecting. Subsequent evidence proved that he \"pencil-whipped\" the inspection.

5. FACT: There was no goat carcass in the freezer during an inspection of the facility after April 11 which is the day a N.J. Superior Court judge ordered the animals removed. A goat carcass was among the other rotting carcasses removed by the Jersey City Health Department in June. Carbajales claims that he had no access to the facility after April and is blaming others for the rotting carcasses.

6. FACT: Hector had access to the facility after it was closed.

7. FACT: Zoe Carbajales let two sick animals die rather that euthanize them. She claimed that they were in a \"coma.\"

8. FACT: Hector claimed he purchased a heating unit that was actually purchased by a volunteer. Carbajales claimed several times the amount of the volunteer\'s purchase and reimbursed himself.

9. FACT: Hector Carbajales is on disability. Is he allowed to work?

10. FACT: He withdrew 12,000 dollars after the facility was closed.

11. FACT: One of Hector\'s staff claimed to breed fighting dogs in his basement. Even if it were a lie, why would the HCSPCA Board hire someone like this?

12. FACT: They removed the dog run after April 11.

13. FACT: Hector threatened the staff of an other shelter saying he had a weapon in his car after he was denied access. Unfortunately, the local authorities weren\'t called to investigate after the incident.

14. FACT: Two HCSPCA vehicles were missing from the HCSPCA property. What happened to them?
1-877-cars4kids? I doubt it

15. FACT: Hector claimed that the HCSPCA had no money. As a result, volunteers purchased a scale, heating unit, cleaning supplies, free labor for plumbing and carpentry, dog and cat food, medicine for animals, and fecal testing.

16. FACT: Zoe Carbajales was the manager of the facility beginning on December 23, 2007. She blames the old manager for the terrible conditions at the HCSPCA. The old manager quit because there was no heat and the animals were suffering. Hector said that he would start euthanizing immediately, so the manager quit in disgust.

17. FACT: Zoe Carbajales was the Treasurer for the HCSPCA but claimed she was the manager of the facility and not a volunteer. That is illegal.

18. WORTH INVESTIGATING: Hector allegedly skimmed money from salaries according to some staff.

19. WORTH INVESTIGATING: Hector ordered the euthanasia of two dogs that did not belong to him in March 2008.

20. WORTH INVESTIGATING: Hector supposedly brought animal carcasses to the incinerator authority, however, staff allege that he sometimes threw the carcasses into contruction dumpsters. Incinertor authority records should be matched to reports of dead animals picked up by Carbajales.

21. WORTH INVESTIGATING: Property and a home were endowed to the HCSPCA several years ago. Some of the money was allegedly embezzeled by a board member.

22. WORTH INVESTIGATING: Animals left abandoned outside of the HCSPCA went the to Liberty Humane Society. However, there is one case according to one volunteer when an animal was picked up in Union City, but Hector claimed that the animal was abandoned outside of his shelter in Jersey City. As a result, LHS became responsible for a dog that was outside of LHS\' area. How often did the HCSPCA contact LHS about an abandoned animal? Can reports from Union City and North Bergen of a stray be matched to LHS\' intake of an abandoned animal from the HCSPCA?


I assume you get this information from a variety of reputable sources. I was aware of about 1/2 of this. Have you relayed these allegations to anyone empowered to investigate, like the prosecutor's office? NY Attorney General? Have you relayed this to Steve Fulop--He seems to be animal friendly and has updated some of us on the boerboel case.

Frankly, the disability allegation alone would get him jail time, since this is clearly a job that someone with a disability (other than having a hideous witch of a wife) would not be able to perform.

Tomorrow's pre-trial hearing stemming from the discovery of maggot-infested animal carcasses and medical waste at the old Hudson County SPCA in Jersey City is likely to be postponed because of a scheduling conflict.

Former HCSPCA President Hector Carbajales and his wife, Zoe, face charges in municipal court but their lawyer, John Young of Jersey City, said today that a scheduling conflict will prevent him from appearing at the hearing.

In June, the bodies of 15 dogs, cats and a goat were found rotting inside an unplugged freezer in the fly-filled and reeking facility on Johnston Avenue, resulting in a number of citations being issued to the Carbajales.

Cited for violations related to failing to properly dispose of animal remains, medical waste and other issues, the Carbajales argue that they are not at fault because a court order had stripped them of any control over the facility.

A new date for the pretrial hearing has not yet been set, Young said.

Because of this reference does this negate using the Warsaw point, it wasn't meant for that, there were ghettos in many countries during WW II, Canada housed Italians, the U.S.A. housed Japanese, and Germany housed many different ethnic groups throughout Europe. Perhaps we Americans should keep better track of these "visitors" before others with less meaningful ways do more harm than good.

Listen Kitten-I was anticipating the usual losers, lunatics and grandmothers being up in arms over anti illegal immigrant statements, but you're off the wall. I am rarely scolded for not hating bleeding liberal heart agenda items enough. This isn't exactly a "chicken or the egg" argument though-if we kept the illegals out, no one would hire them.

That said, I don't know where you got the idea I was in favor of hiring them, or pro-contractors that hire them. It sounds to me like you've got enough hate in your heart for the contractors though-so that'll be your responsibility. I'm just tired. Peace.

Stop enabling. They should go back to where they came - drains on society - even when they can earn a living, they're not paying taxes but taking every free service state and federal governments offer.

Saabconv is absolutely right. In a lot of the interviews you hear his "victims" complain that the SEC fraud fund will only insure their initial investment. That's up to $500K. They should quit their bitching. It's a basic rule of investing that you don't put all your "eggs" in one basket. They blindly accepted impossible returns and never questioned it.

I learned as a child that if something sounds too good to be true, it usually is. If these hundreds of adults couldn't understand that, well, there's another old saying--a fool and his money are soon parted.

Apparently a trial date has not been set-Kolb's attorney is playing the "my client's the real victim" card now-claims she's being prejudiced by delay. I think the guy with puncture wounds in his crotch was prejudiced more, but then again, some folks think I'm batsh*t crazy. I hope the court and prosecutor don't lose focus.

Kolb's new attorney is apparently a specialist in this type of case. According to her website, she authored "Pitfalls for Pitbulls", NJ Lawyer Magazine, August 2005 and touts herself as an expert in NJ Vicious Dog law. Her website (which doesn't seem to be working - viewed in cache) says :

"In 1994, Gina took on the defense of ?Splinter,? a mixed breed terrier from Saddle Brook, wrongfully accused of an unprovoked attack on an 8-year-old girl. After two appeals and three trials, the verdict was finally overturned and Splinter was adjudicated not vicious.

Since then, Gina has represented numerous ?death row? dogs, impounded under the New Jersey Vicious Dog Act. Her efforts led to the only reported decision on the Act, State vs. Smith, 295 N. J. Super. 399 (Law Div. 1996).

Gina also handles other animal law-related cases, including veterinary malpractice, landlord tenant issues, pet custody, breach of contract and pet trusts, involving a variety of species and issues. Her representative clients have included animal activists, the New Jersey Animal Rights Alliance, Closter Animal Welfare Society (C.L.A.W.S), Helping Hands of Passaic and other animal rights groups. She is on the Board of Directors of Caring About the Strays Inc. (C.A.T.S.).

Gina?s work was also featured in an article in New Jersey Law Journal on animal law in 2002 and her various cases have been covered by the press and television. "

RECAP:

On June 23, 2008, the Jersey Journal reported that, ?Jersey City police and animal control officers were barraged with flies, maggots and the stench of rotting carcasses as they removed the remains of dogs, cats and a goat? from shuttered Hudson County SPCA. The newspaper further reported that, ?the carcasses, which totaled 16 inside eight bags, were pulled from a freezer? that was not turned on. Further inspection of the facility showed that medical waste that included syringes were found in the facility.

Many of you on this forum are well aware of the alleged criminal conduct of the HCSPCA Board President and his staff, and finally, they will be in court tomorrow, March 6, 2009 at the Municipal Court, 365 Summit Avenue, Court Room 6, 1:00 P.M.

Likewise, the Jersey Journal reported on July 28, 2008 that the HCSPCA ?is under criminal investigation by the state Attorney General's Office? and the ?the AG has subpoenaed records from Union City and North Bergen, two Hudson municipalities that have contracts with the HCSPCA for animal control services. Of course, records at the HCSPCA facility were ?stolen? because they must have been made of copper or something after the facility was looted.

Not surprisingly, one doesn?t have to dig deeply to find misappropriation. On June 24, 2008, the Jersey Journal further reported that ?the president of the Hudson County District Society for the Prevention of Cruelty Animals withdrew almost $12,000 from the bank account? more than two months after the facility was closed.

The Jersey Journal stated that, ?Sovereign Bank records show that Hector Carbajales, who now contracts independently with Union City and North Bergen to pick up their strays, personally withdrew $11,790 in multiple installments ranging from $40 to $2,200 in April from the account of the HCSPCA.?

Thanks for the update. Sadly, I have no faith that the Hudson County Judiciary will do anything. It's basically a year later, and these people are still in the animal control/care business. I will keep my fingers crossed that they get even a measure of what's coming to them.
