"Hearsay" is defined as any out of court statement offered to prove the truth of the matter asserted in the statement. If you offer a statement that X said it was snowing to prove it was snowing, it's hearsay. If you offer the same statement to show X's mindset as to why he put on his boots before he went out it's not hearsay.

The general rule is that hearsay is inadmissible. However --- there are tons of exceptions to the general rule that hearsay is inadmissible. ANY statement against interest made by a defendant in a criminal matter is usually admissible, except if it coerced by police or was elicited without the usual Miranda warnings while the defendant was in custody.

So if they're off duty and they're home, you don't have a complaint? Or off duty and moonlighting in Hoboken, not an issue?

I guess I thought that if they're off duty but in JC in uniform they give the appearance of a greater police presences, which is actually a good thing.

I'm missing something about the "off duty cops" discussion.

If they're off duty, they're off duty. Whether they're making money at a construction site or sitting at home or at the track, they're off duty, right?

Or are you saying that police officers who are scheduled to work an 8-4 shift are actually protecting construction sites while they're on duty?

Marco & Pepe is still my favorite restaurant (they've even learned to turn down the loud music!), with Madame Claude as a close second. My only complaint about Madame Claude (and I've told this to the owners who chuckled) is their tiny thick rimmed wine glasses. Since the place is BYO, I bring good wine. I've threatened to bring my own glasses next time.

Have you checked out the Garden Preschool Cooperative at Hamilton Park? It was started by a group of downtown parents in 1995. Formerly located at Grove and York, it's now 1 McWilliams Place. They just had an open house yesterday, and application deadline for next year is Feb 16. Both my children went there.

The outside is a barn compared to the apartments. Gorgeous space, amenities and views. Good friends just sold their place a few months ago. We spent our July 4th with them watching fireworks in the harbor. We're still in mourning.

What was she doing with cash? Why was she out at 11 pm? Reminds me of the good old days of rape prosecutions. Why was her blouse so tight? Why was her skirt so shirt? She must have been asking for it.

People who behave stupidly or thoughtlessly make themselves more vulnerable to crime but they're not "asking for it."

So the Light Rail is responsible if a random crime happens at its station, but the city is not responsible if it happens 20 years away? How does this make sense? Do people sue the city when a crime occurs on Newark Avenue?

Whether or not we can "isolate" the mentally ill who might become dangerous has nothing to do with whether NJ Transit is any way legally or even morally liable for what happened here. Surely no one is suggesting that NJ Transit knew or should have known that this individual was a danger and did nothing to prevent the attack.
