Man charged in fiery crash that critically injured innocent driver

JERSEY CITY - Authorities have arrested the driver they say caused a fiery crash on Tonnelle Avenue that critically injured an innocent bystander late Sunday night.

Leo Pinkston, 48, is charged with eluding and aggravated assault in connection with the pursuit that began near Ocean and Cator avenues, Hudson County Prosecutor Esther Suarez announced.

People attempted to stop Pinkston at about 11 p.m. when he fled the scene. Authorities have not commented on why they were stopping the vehicle. During the pursuit, Pinkston is alleged to have caused at least two separate crashes.

In the first crash, Pinkston tried to drive between two lanes of traffic. Jersey City police officers fired "multiple shots" at Pinkston, Suarez said.

While Suarez did not specifically identify where on Tonnelle Avenue shots were fired, authorities were investigating shell casings found near Carlton Avenue early Monday morning.

About a mile up the road, Pinkston crashed into a utility pole which caught fire and injured another driver who was not involved in the pursuit. The 28-year-old West New York man is currently in critical but stable condition at the Burn Center at St. Barnabas Medical Center, Suarez said.

Because police were involved in the shooting, the Hudson County Prosecutor's Office is leading the investigation.

"Our thoughts and prayers go out to the innocent victim and his family," Suarez said in a statement. "We will utilize all resources available to the Prosecutor's Office for a full and thorough investigation as we seek to bring this matter to a rightful conclusion."

Police did not provide a pursuit route, but it is estimated to have been anywhere between five and seven miles.

According to the Jersey City Police Department's guidelines, officers should not fire from or at moving vehicles unless "there exists an imminent danger or death or serious bodily harm to the officer or another person" and when "no other means are available at that time to avert or eliminate the danger."

Additionally, the use of deadly force is justified when an officer feels there is "imminent danger of death or serious bodily injury." Shooting at a fleeing suspect is only acceptable when the individual "caused or attempted to cause death or serious bodily injury," poses an "imminent danger of death or serious bodily injury should the escape succeed," and when there is "no substantial risk of injury to innocent persons."

The Hudson County Prosecutor's Office is asking that anyone with information or video to call 201-915-1345 or to leave an anonymous tip on the Hudson County Prosecutor's official website. All information will be kept confidential.

{Edit} Hudson County Prosecutors Units are rolling towards the scene. A few reasons as to why they would respond. Maybe there are fatalities. Could be because of the severity of the crime scene. Could also be because there maybe police involved shooting.

I counted 2 dozen + PD cars,marked and unmarked from the North, East, West, and South districts roll down North on JFK . Along side 4 Ambulances, a Paramedic unit, 3 ESU Trucks and Rescue 1.. Looks like all the new PD cars the city got is responding.

{edit} I'm updating the count as the cars/trucks go by.

{edit} Could be related, but 2 ambulances just went south on Kennedy and I believe a bomb squad esu truck went north towards the scene.

{edit} It's all calm for now. Only saw 2 or three other district units return.
