I've rented apartments in other cities for vacations, and I honestly never thought about how the building residents felt about it. We're a pretty neat, quiet family, so I'd like to think we didn't bother anyone...but now I'll have second thoughts about doing it again.

This is nothing new, although I agree that it sucks.

In Grove Pointe I don't know of any airbnb units, but our building management fully sanctions Furnished Quarters. As residents move out, more and more units are going to Furnished Quarters. And they are also allowing much shorter stays now. At first it was mostly longer term corporate rentals.
Now we're getting lots of vacationers which is especially "fun" for us during the pool season. As the original poster stated; it's not desirable for us long term residents to make the switch to hotel living.

There was an interesting discussion on this on the radio on the topic of short term rentals (airbnb) and their legality and the effect on affordable housing. Senator Liz Krueger in NY is tackling the issue in NYC, but it is definitely an issue here too.

I am not sure what the law is in NJ, but this may be a good place to start getting info.

Interesting. The exact same thing is happening at Grove Pointe. I agree - it greatly changes the standard of living.

First thing - read your specific contract with the landlord. It should spell out your lease terms. But given the NJ law, I don't think you have grounds for breaking a fixed-term lease. I think you have 3 options:

1. Work out something with the landlord. They might be approachable if they think they can re-rent easily.
2. Find a tenant and sub-let if your contract allows it. You'll still be on the hook for the lease, but it'll allow you to move.
3. Hire an attorney.

Your chances of breaking your lease are slim. What's it say in the master deed about short term rentals? You could always try the "quiet enjoyment" route. You are entitled to quiet enjoyment of your apartment. If the problem is as bad as you say you may have an out. Basically you need to show cause to break your lease.

Please, no opinions but real advice needed. And do not turn this into a post that has nothing to do with the theme.

Our building at 9 Regent street, where we rented as a long term rental, allowed now shirt term rentals.
Tenants were never asked for the opinion.
What that did, is bring people who do not care, are noisy, lobby is like a hotel. We can barely walk through and elevators are constantly packed or do not work. There is a line with getting mail as concierge is busy with all the guests requests.
Not to mention, it does not feel safe.
It really does not.
Just..our standard of living has changed. We would like to break the lease. And get our deposit back. Do we have a right to do so?
