It would be nice if there could be some way to assure that when this animal gets out of jail that there could be some way to foce him to live the rest of his days in the closest possible proximity to the judge and members of the jury who did not put him away for life. If those people ( who were the only ones the rest of us could rely on to take care of this matter) knew he would be spending the rest of his life in their face maybe they would have given his sentence more consideration. As it is he will get out and be in our collective faces, a reminder of a botched legal process the judge and jury were able to just walk away from.

Can't pin this on the judge, if the conviction is manslaughter - that goes on the prosecutor. I'm guessing that because the person he killed wasn't actually his original intended target, that's how they were able to justify going for the lesser manslaughter conviction, rather than murder. Still, it seems pretty pre-meditated to me...

Jersey City man sentenced to 25 years for 2009 fatal shooting

A Jersey City man found guilty in October of aggravated manslaughter in a 2009 shooting death near a city park was sentenced to 25 years in prison today.

Anthony Rose, 27, was found guilty on Oct. 5 of fatally shooting Dareus Burgess, 28, on June 8, 2009. The jury in the case, which deliberated for less than two days, acquitted Rose on weapons offense charges.

Rose will get three years credit for the jail time he's already served. He faces a possibility of parole after he completes 85 percent of his sentence.

Rose didn't react when Superior Court Judge Lisa Rose handed down the sentence. He winced earlier when Hudson County Prosecutor Dave Rastogi, urging the judge not to be lenient, referred to the defendant as a drug dealer.

Police say Burgess was killed by Rose in a case of mistaken identity.

On June 7, 2009, Rose's girlfriend got into a fight with a woman and it was broken up by a friend of Burgess, police said. Rose got into a fight with the man and returned the next day to get his revenge, but killed Burgess, who was near the park, police said.

Rastogi argued that Rose was near the park at the time of the killing and his car was seen driving away from the area afterward.

Rastogi also presented a witness who told police he overheard Rose trying to obtain a gun hours after he was beaten up. Another man testified Rose had asked him to get him a gun to settle a beef and had also asked him to kill a man that day.

Jersey City man guilty in killing, acquitted on weapons charges in 'confusing' verdict

A Jersey City man was found guilty yesterday of aggravated manslaughter, but was acquitted on weapons possession charges in a verdict that his attorney called "confusing."

A Hudson County jury deliberated less than two days before finding Anthony Rose, 27, guilty in the shooting death of Dareus Burgess, 28, near a Jersey City park on June 8, 2009. Rose faces up to 30 years in prison when he is sentenced on on Dec. 7 by Hudson County Superior Court Judge Lisa Rose.

Defense attorney Richard Sonntag, who argued throughout the trial that the prosecutor's case was built solely on circumstantial evidence, said finding Rose guilty in the shooting and not guilty on weapons charges was "confusing." It's likely that Sonntag will appeal the verdict.

"The family finally got some sort of justice," said Hudson County Assistant Prosecutor Dave Rastogi, who thanked "an attentive jury" and investigators from his office. "But they lost him, and this certainly doesn't change that."

The gun used in Burgess' shooting was recovered months later by Asbury Park police in an area known to be Bloods street gang hangout, according to testimony. There was no evidence presented at the trial that connected Rose to the gun.

Rose showed no emotion after hearing the verdict, which was rendered around noon, after about 11 hours of jury deliberation. He has a prior conviction for drug distribution within 1,000 of a school.

Burgess' mother was in court for the entire three-week trial, but left afterward without commenting.

Murder trial to start for Jersey City drug dealer

Jury selection begins tomorrow in the trial of a Jersey City drug dealer charged with gunning down a 28-year-old in a city playground, officials said.

Anthony Rose, 27, of Bidwell Avenue, is charged with the June 8, 2009 murder of Darius Burgess, 28, of Corbin Avenue, in Cosmo "Gussy" DiSanto Memorial Playground at West Side Avenue and Broadway, officials said.

On the day before Burgess was killed there was a fight in the playground between a woman and Rose's girlfriend and Rose's girlfriend allegedly pulled a knife, prosecutors allege. A good Samaritan stepped in, disarmed her and broke up the fight, prosecutors allege.

The girlfriend called Rose, who immediately went to the park, got into a fight with the man and was beaten up, prosecutors allege. The next day Rose went back seeking revenge and unable to find the man, he shot Burgess who had nothing to do with the incident, prosecutors allege.

On the day Burgess was killed, his mother, Miriam Melendez, got word of the shooting and ran to the playground from her nearby home only to find her son lying on a walkway between the basketball and boccie courts. He was already dead.

Rose was in prison from Feb. 10, 2006 to July 25, 2006 for drug possession and possession with intent to distribute within 1,000 feet of a school, state corrections records say. He faces 30 years to life if convicted of murder.

Anthony Rose has been charged with the murder of Jersey City resident Darius Burgess.The 28-year-old Jersey City man gunned down on a city playground last June was killed in retribution for a fight the murderer had with another man the day before, officials said today.

The other man, cops say, was an acquaintance of Darius Burgess, a resident of Corbin Avenue who was shot in the back in Cosmo "Gussy" DiSanto Memorial Playground at West Side Avenue and Broadway around 2 p.m. June 8.

Dogged detective work led to the arrest of 25-year-old Jersey City felon Anthony Omar Rose, aka "Mu Mu,'' on a charge of murder, Hudson County Prosecutor Edward DeFazio said..

"It feels so good. Thank you, God," Burgess' mother, Miriam Melendez, said today.

Interviews with witnesses and security videotape footage recovered in the area of the shooting led to charges against Rose, DeFazio said.

Melendez has maintained a memorial to her son at the playground.

"I went yesterday and I told him we are going to get whoever killed you,'' she said. "I spoke to his picture."

Rose was arrested last night at the Winfield Avenue home of a friend only hours after state Superior Court Judge Kevin Callahan signed the warrant for his arrest, DeFazio said.

There has already been one additional arrest but information on that person is not being released yet, DeFazio said. More arrests may be

Rose made his first appearance in Central Judicial Processing court in Jersey City this morning via video link from Hudson County jail in Kearny.

His bail has been set at $1 million cash only.

On the day Burgess was killed Melendez got a call telling her of the shooting and she ran to her son's side near the playground basketball courts but she was too late.

DeFazio said Burgess was pronounced dead at the scene at 2:15 p.m.

"It was a very comprehensive investigation by law enforcement and it is not over yet,'' he said. "There very well could be other people charged."

Melendez said her son was born in Jersey City and graduated from School 6 and Dickinson High School. He worked at a women's clothing store on Journal Square in shipping and receiving. The day he died was his day off and he was spending it playing basketball.

"I really don't have closure yet because I want them to get everyone," said Melendez, who attended this morning's CJP hearing. "His attitude was like he didn't care," she said of Rose.

Rose was in prison from Feb. 10 to July 25, 2006, on convictions for drug possession and drug possession with intent to distribute within 1,000 feet of a school, according to corrections records.

The state legislature needs to grow a set and and put laws on the books that "Trully" punish the low lifes and put them away forever versus whats going on now and stop catering to the leftwing special interest groups who feel that the rights of these scumbags superceed those of the victims!

Westside at the basketball courts between Broadway and Pavonia.

It is crazy how many day time shootings/murders we have this year. I heard from someone that knew him they think he was mistaken for someone else. Not sure how true that is. My condolences to the family.

I guess the gun buy back program must be working great...There is too much violence in Jersey City..Healy and the Administration need to get Goddamn serious on the crime issues in our city. You wanted to be reelected, you want the job of being Mayor....Now do the job you promised...You promised more police on the streets...Where are they? He has made this promise in every election and the stupid people of Jersey City vote him in...Well let's make him keep his promise..Can we recall him if he doesn't do the job he promised. Perhaps all his signs that are still up can shield us from bullets.

A Jersey City man was gunned down in a park off West Side Avenue yesterday afternoon and detectives said they had identified a person of interest and were trying to track him down last night, officials said.

"I saw him lying face down and I screamed, 'If you can hear me, say something,'" said Miriam Melendez about running to the side of her dead son, Darius Burgess, 28, of Corbin Avenue.

"When they turned him over, I screamed because I saw his face and I could see he was dead."

Burgess was shot at least once in the back at Cosmo "Gussy" DiSanto Memorial Playground at the corner of Broadway at about 2 p.m. and pronounced dead at 2:15 p.m. at the Jersey City Medical Center, said Hudson County Prosecutor Edward DeFazio.

Witnesses said the gunman used a semiautomatic pistol and fled the scene after the gunfire, DeFazio said.

"Apparently there was a dispute yesterday (Sunday) and that may be related to this incident," DeFazio said, adding that investigators are still trying to determine the relationship between the prior incident and the fatal shooting.

Melendez said her son was born in Jersey City and graduated from School 6 and Dickinson High School. He worked at a women's clothing store on Journal Square in shipping and receiving and he was at the park playing basketball yesterday on his day off. About 2 p.m., Melendez, a city crossing guard, got a call from a relative telling her to run to the park because her son had been shot.

By 7 p.m., a makeshift shrine for Burgess had been erected a few feet from where he died. More than 20 candles burned in front of his picture, which was mounted on cardboard covered with sentiments written by mourners. More than 30 people gathered in the area last night, many hugging Melendez and sharing kind words about her son.

Chaz Morris, 17, stopped at the shrine on his bicycle. He said he'd known Burgess his whole life.

"He was a cool man," Morris said. "He never even said anything and he never hurt anybody. That was a cool man. I'll always remember him."

Van Thomas said Burgess grew up with his own children and called him "a beautiful kid."

"He was someone that didn't bother anybody," Thomas said. "He was the kind of kid you would never fight with. He would just walk away. This has got to stop. The politicians and police have got to get together and stop this."

Melendez said she was surrounded by family members at her nearby home and they were a help to her in her grief.

"I would like for him to turn himself in and I want to know why," she said about the gunman. "What's the reason my son is dead?"

As of last night, no one was in custody and no one had been charged, DeFazio said.
