Jersey City man sentenced to 20 years in 'wolfpack' beating death

A Jersey City man was sentenced to 20 years in prison today for the savage "wolfpack" attack of a 27-year-old who was beaten into a coma with a brick and died eight days later, officials said.

Tyshaun Shannon, 21, of the Montgomery Gardens public housing complex, was the last of nine people -- all between the ages of 13 and 17 at the time of the beating -- to be sentenced in the killing of Carlos Orlando Quinones on Feb. 24, 2009.

Lucius Smith, 21, Shannon and two others were charged as adults. Smith was found guilty of murder and sentenced to 40 years, while the others two -- Markise Dawson and Augustus Bey -- pleaded guilty to robbery. The charges against the other five defendants were adjudicated in family court.

Shannon had pleaded guilty to aggravated manslaughter and perjury and must serve 17 years of his sentence before becoming eligible for parole, Hudson County Assistant Prosecutor Gene Rubino said.

A witness told police Quinones was walking at Cornelison Avenue and Florence Street at 8 p.m. when he was surrounded by a group of boys. Police said when Quinones resisted, he was battered in the head with a brick.

Quinones was left in critical condition and in a coma at the Jersey City Medical Center and it was days before police were even able to identify him. He never regained consciousness and died on March 3, 2009 as a result of the assault beneath a bridge just outside Montgomery Gardens.

Smith, who was found guilty last March and sentenced in April, must serve 34 years of his sentence before becoming eligible for parole.

Dawson, of Claremont Avenue, was sentenced to three years in state prison and Bey, of Dwight Street, was sentenced to four years, Rubino said.

Shannon testified at Smith's murder trial and he lied on the stand, Rubino said. He also pleaded guilty to perjury and was sentenced to four years for the crime, but the four-year term will run concurrent to the aggravated manslaughter sentence, Rubino said.

"It was a robbery that turned into a beating, and he took a brick and beat the man over the head with it," Hudson County Assistant Prosecutor Laura Magnone of Smith after his conviction. Smith was referred to as the "ring leader."

Jersey City man sentenced to 40 years in prison for role in fatal 2009 attack

A 20-year-old Jersey City man was sentenced today to 40 years in prison for the 2009 felony murder of a 26-year-old man who was beaten with a brick, kicked and punched by nine boys in a deadly game of "knock out."

In handcuffs and wearing a green Hudson County Corrections Center uniform, Lucius Smith today apologized to the victim's mother before Superior Court Judge Fred Theemling handed down the sentence.

"I am sorry what I did. I am sorry what happened to your son," Smith said. "I think about it every day.?

Smith, 20, must serve 85 percent of the 40-year sentence before he is eligible for parole.

A jury convicted Smith in March of felony murder, robbery, conspiracy to commit robbery and aggravated assault.

A total of nine juveniles ranging in age from 13 to 17 were charged in the Feb. 24, 2009 attack on Carlos Orlando Quinones, 27, of Monitor Street, but four had their charges waved up to criminal court for prosecution as adults.

Speaking on behalf of the mother, who was too distraught to testify, Hudson County Assistant Prosecutor Laura Magnone told the court the mother?s life had "drastically" changed after the loss of her youngest son, an incident that led to her losing her job and suffering from various illnesses.

Describing Quinones as a "good" and "quiet" person, Magnone said he had come from Puerto Rico to New Jersey to find work and become an organ donor after his death.

Asking for Smith to be sentenced to 50 years behind bars, Magnone described him as the leader of the group and the person who struck the victim with the brick. Magnone said that Smith had made a statement to authorities saying that the boys often played ?knock out,? a game where they would approach a homeless person and hit him with a brick until he lost consciousness.

The other alleged attackers charged as adults were Markise Dawson of Claremont Avenue and Augustus Bey of Dwight Street, who were both 17 years old when waived up to criminal court, and Tyshaun Shannon, of the Montgomery Gardens housing complex, who was 18 years old.

Asking today for the minimum sentence for his client, defense attorney Jim Sheehan asked the judge to consider that Smith's age was 17 at the time of the attack, adding that his client was one of "many, many individuals" involved in the incident.

?To see that on tape was shocking to everybody, but it was the group mentality, the pack mentality," Sheehan said."The defendant has been remorseful from day one."

Sheehan added: ?If there was a time machine and he could back and change what happened that night he would.?

Smith's mother, two sisters and brother spoke on the defendant?s behalf.

"This is my baby boy," his mother said through tears "He did wrong."

A witness to the 2009 attack told police Quinones was walking at Cornelison Avenue and Florence Street when the boys surrounded him. When Quinones resisted and the boys found he had no money, the homicidal attack began, Magnone said.

Quinones was left in critical condition and in a coma at the Jersey City Medical Center, and it was days before police were able to identify him. He never regained consciousness before he died on March 3, 2009 as a result of injuries from the attack.

I was asking a moral question. At some point, I think everyone knows right from wrong and perhaps teens need to be held to much tougher standards. They should learn that there are severe consequences and not just a slap on the wrist.

If you're asking a legal question: NJ doesn't currently use the death penalty as punishment.

4 Jersey City teens will be tried as adults on felony murder charges in man's beating death

Four Jersey City teens who were juveniles at the time a man was fatally beaten with a brick during a robbery in February 2009 have been indicted on charges including felony murder and will be prosecuted as adults, officials said yesterday.

Markise Dawson of Claremont Avenue and Augustus Bey of Dwight Street, both 17, as well as Tyshaun Shannon and Lucius Smith, both 18 and of the Montgomery Gardens housing complex, were charged in the indictment that was signed by a judge yesterday, said Hudson County Assistant Prosecutor Laura Perry.

They face charges of felony murder, robbery, conspiracy to commit robbery, aggravated assault and weapons offenses, Perry said.

A total of nine juveniles ranging in age from 13 to 17 were charged in the Feb. 24, 2009 attack on Carlos Orlando Quinones, 27, of Monitor Street, but five of those charged had their cases adjudicated in Family Court as juveniles.

A witness told police Quinones was walking at Cornelison Avenue and Florence Street at about 8 p.m. when he was surrounded by a group of boys. Police said that when Quinones resisted, the boys beat him in the head with a brick.

Quinones was left in critical condition and in a coma at the Jersey City Medical Center and it was days before police were able to identify him. Perry said the juvenile cases have all been adjudicated.

Tips led police to the nine boys charged in the deadly attack.

Eight 13- to 17-year-old Jersey City boys charged with beating a man with a brick during a robbery are expected to face felony murder charges based on an autopsy done yesterday that determined the man died as a result of the beating, officials said.

"A number of these juveniles could very well be subject to removal to the (Superior Court) Criminal Division, where they will be treated as adults," said Hudson County Prosecutor Edward DeFazio of the boys charged in the Feb. 24 attack on Carlos Orlando Quinones, 27, of Monitor Street.

In family court a juvenile faces up to 10 years in custody for the offense of felony murder, but if convicted as an adult in criminal court, the charge carries a sentence of 30 to 75 years, officials said.

A witness told police that on the night of the attack Quinones was walking at Cornelison Avenue and Florence Street at about 8 p.m. when he was surrounded by a group of boys. Police said that when Quinones resisted, he was beaten in the head with a brick the boys found nearby.

Quinones was left in critical condition and in a coma at the Jersey City Medical Center and it was days before police were able to identify him. He never regained consciousness and died on Tuesday.

Doctors also found a bullet lodged in Quinones' neck. Officials said the bullet got there when Quinones was 13 and a childhood friend fired a gun by accident.

Tips led to the arrests of the eight boys last weekend and they were charged with aggravated assault, robbery and various weapon charges, DeFazio said, adding that a ninth boy is expected to surrender.

Anyone with information on the crime is asked to call the Hudson County Prosecutor's Office's Homicide Squad at (201) 915-1345.

I can agree with you on that they should get the max penalty. If they are tried as adults just off the fact it was felony murder they will be looking at 25 to life. It wouldnt surprise me if one or two were tried as juveniles in exchange for testimony against the one or ones that dealt the fatal blows that caused his death but that would depend on how strong of a case the police have. Like if the witness couldnt identify them most likely someone would be offered a deal. I think they will be made an example out of though.

Mostly likely this was not a hate crime, the reason I suggested this is because it would get them a longer sentence. Which really it ought to be life long. If they are tried as juveniles they will not get what they deserve.

If it were 8 white boys vs. any 1 person that isn't white I'm sure it would automatically be considered a hate crime.


There are always going to be people that jump to that conclusion. That doesnt make it a hate crime even if the suspects are of a different race or ethnicity. The crime has to be motivated by hate to be a hate crime. Most of the group robberies and teens playing "knock out" choose random victims. It has more to do with the victim being in the wrong place at the wrong time then anything.

DId you know the family , because unless you have more info than I do than you are the ignorant one.
Besides the points here are what we can do to make JC better. DO you speak more than one language or are you familiar with this family?
REgardless, this was more like inferring since this poor guy came here 7 months ago and was looking for work. His mother lives there. I have been to PR many many times and this is very common to have people come and go. If you grew up in Puerto rico your first language isn't English its SPanish.....and if you come here and hear young kids yelling at you in JC lingo it would be difficult to understand...I was trying to point out that he was at the wrong place at the wrong time and yes the language and being an outsider on a desolate place didn't help much...Don't read too much into things you can use the time going to community meeting and contributing positive things!

By the way we are implementing the Neighboorhood watch tonight! We are not far off from this block on Cornelison! Wish us luck!!! Thanks for everyone's support!

Before you call someone ignorant, try conversing with a person who has only been in the US for 7 months. I bet it won't be easy.

This is very sad. The guy was new here and he probably didn't know not to walk around certain areas. The paper says he was only here 7 months from Puerto Rico so that means he didn't speak clear english.

These "wolf packs" are Allowed to roam because the JCPD say that it is perfectly legal to stand on the sidewalk...that they can't really tell people to move or they can't do something unless they are really doing something illegal.
Please! You see a group a youngsters you kow they are up to no good! This is not the Little Rascals and their pet dog..these are kids who come from broken homes...and a lot are receiving assistance from the government because they are poor. People who receive assistance needs to have the state and county agencies up their noses to see how they are living. Mothers are allowing their kids to be on the street, fathers a lot of times are not around...or even in a lot of cases I am seeing a lot of single fathers working and dealing with out of control kids.
This is another community effort....it starts in the home but when that is failing the others have to step in DYFS, Welfare, teachers, the school, TRA, Police, community groups, the mayor and the council members etc.....
The curfew needs to be enforced and hold parents responsible. Birth control needs to be accessible becuase a lot of thes 15 years olds have 30 year old moms! It's a chain, and unfortunately when people don't know any better they can't improve. Yes many people can change but its not the case most of the time. Poverty leads to a lot of things.....no ambition, no self pride, no hope,...etc.....I can keep going but we are allowing this to happen......the meeting on Tuesday was a start....lets hold people accountable and really be productive for once! Let's not accept this anymore!
