It is probably based on the height of surrounding buildings, based on the building going up on First down the street from Torico's in Harsimus Cove.

More interesting to me are the facade guidelines. The building on First has bay windows which certainly are not Harsimonious.

Yes, there most definitely are height restrictions and they can be found in the city zoning ordinance.

The historic preservation commission has their own set of regulations regarding development within the historic districts but I'm not sure if they have any specific height/bulk regulations.
