According to the Rule, he could have gotten a CNE (permit) for replacing existing vinyl or aluminum with new vinyl siding; however, he would not have been able to get a CNE to replace wood siding with vinyl. The NYC Landmarks Commission counsel has always taken the position that if a permit is issued in error, approving work that is contrary to the Rules, the permit is invalid. Thus his permit, if issued incorrectly, would not stand. It's the property owners as well as the contractors responsibility to know the law, and not try to take advantage of something approved erroneously; seeing the permit would clear this up.

Respecfully, We aren't in NYC or subject to NYC Regulations !

So the Building Department issued permits in error: allowing for the use of vinyl siding when it is in fact not allowed.

Can't the home owner just switch the siding from vinyl to Hardiboard or another similar product? I know it is a bit more expensive, but it looks a hell of a lot better than vinyl.

Thanks for that post, it's interesting language in that Ordinance.... If the City felt it was on strong grounds to prohibit the use of vinyl or aluminum, then it would have said so clearly. The fact that the Ordinance language does not contain a clear prohibition in all circumstances is telling in itself. The imprecise wording used makes me think those drafting it had concerns about going any further. It's not surprising I suppose, since the enabling legislation giving municipalities the power to regulate historic districts speaks of ?conservation? and ?preservation?. Those are the words used in the relevant sections of the act. The words ?restoration? or ?re-creation? don't appear, so it's a stretch to argue the enabling legislation could be read in a way that it permits the City to compel ?restoration? work. But since the City wields the power by denying permits, they often get their way.

If this house already had vinyl or aluminum siding that he just wants to replace, then he might consider applying for a certificate of no effect to replace it with the same. However, the City and Historic Preservation folks are zealots bent on ?recreating? the late 1800's / early 1900's. Since it's not their money being spent, they'll abuse their power in an attempt to ?force? people into using what the City wants ? expensive wood siding in this example. And they'll try, even if it's beyond the limits of what they are permitted to do under the MLUL provisions.

So, if he has the time and money, when the City rejects his initial application, his next step is the Zoning Board with an appeal. And if he doesn't like their decision, he could appeal, and so on, all the way perhaps to the State Supreme Court (maybe they'd agree to hear the case...?), since the fundamental issue is what is an individual permitted to do with her or her property, and what limits on that are appropriate. Rather important questions actually in a free, democratic society....

By doing this, The City can WEASEL OUT of any/all contracts & commitments they make to OUR Communities at the time of inception & so Empower their 'Foot-Soldiers' to have Absolute [yet Unsupported/Inconsistent by/with Higher Levels of Law] Discretion in Applying such Governing Documents during their Site inspections.

In one simple sentence:
"We the People..." ARE GETTING SCREWED.

Back when HPNA was trying to lynch Dan Rieden, I was told that lookalikes were not acceptable. A fiberglass cornice that looks like a wooden or terracotta one would not pass.

I don't want to sit through Yvonne's video, did anyone ask about the reval cancellation and it's affect on them?

You started this thread. You posted video. Either you don't have video from before it occurred or you do. If you do, it should be shown.

The fact is, Carlos doesn't live in that ward. He was there to disrupt that meeting with issues relating to a completely different area.

Did you hear Fulop? He addressed the crowds and explain why Carlos was removed. He was removed by the mayor's request. He was physically removed, Pebble. There were other people there shooting video, ask them these questions.

its taking away from people that have legitimate concerns about the city and its direction aside from one individual homeowner with some bizarre permit issue.

Actually, Pebble, you are wrong. Carlos was thrown out at the beginning of the meeting. If you do not believe me send an email to McDonald of the Jersey Journal or ask anyone who was there. Carlos made no statement when this happened.

That is a factually incorrect statement.

Carlos lives in a historic district. Vinyl siding cannot be placed on a home in a historic district. Carlos tried installing vinyl siding. A neighbor told the city. The city put a stop to the work. It is very straight forward.

Yvonne has video from before the individual was thrown out but that was cut. Most likely, Carlos was acting like a jack-ass and got tossed for it.

Secondly, Carlos does not live in Ward A. Like Yvonne, he chose to occupy a seat that a resident from that area would have occupied and disrupted a meeting that could focus on that area's needs by centering it on himself.

It's pathetic.

First, you are wrong, JCGuys when Carlos was interview (www.speaknj.com) he called Mayor Fulop many names. I edited those names from the show and I won't repeat them here. I go after the truth not the person. The city is responsible for giving him the permits. It is his house and the city caused this problem not Carlos.

That's such a dumb strategy. He should lawyer up rather than waste time getting kicked out of public meetings. It's like he's more interested in the performance than actual resolution of the issue.

He reminds me of the "don't tase me, bro" kid.

His issue is probably a valid one, but it's foolish to not immediately take legal action in these types of situations. He's wasting his own hard earned cash each day is home is exposed to the elements, at least it's not mine or taxpayers funds, so live and let live I guess.

Only see a clip of a guy getting tossed from a meeting, was he issued a permit to revamp his stoop and then started gutting a side wall to install a bay window?

It is not your home exposed to the elements after Carlos received a permit from the city. The work was stopped 3 days after it started, exposing his home to the elements. It is wrong to laugh when you don't pay his bills.

It is not your home exposed to the elements after Carlos received a permit from the city. The work was stopped 3 days after it started, exposing his home to the elements. It is wrong to laugh when you don't pay his bills.
