..."The long running case is now over.".... Don't count on it, this story "ended" a few times and the crazy pet lady and her huge dog(s) continued to pop up in the news long after earlier parts of the saga apparently came to a close. Frankly its been one of my favorite stories to follow here on JC List and I will miss it if it truly is over. If someone is writing a book about Jersey City I hope this story makes it in.

JEFFERSON -- A contempt indictment has been dismissed against the former owner of a "potentially dangerous" dog in Jefferson Township after the 100-pound African Boerbel was shipped to Utah.

The Morris County Prosecutor's Office had agreed to drop the contempt case if the dog was permanently removed.

The long-running case is now over, except that Kolb and her husband Gary have not resolved a bill the township wants them to pay for more than a year of housing and feeding the dog, along with another dog that died in January.

Municipal Prosecutor James LaSala said yesterday that the Kolbs owe Jefferson approximately $10,000 and he expects to "work out a payment plan" with the couple in the near future.

The dogs were seized and the Kolbs were charged with contempt in Morris County when they were seen walking the dogs without muzzles in Jefferson on Oct. 18, 2011, after entering into an agreement in Jersey City to muzzle and restrain the animals in public.

The Kolbs were ordered to remove the dogs from Jersey City after incidents in 2008 and 2009 that included biting a man in the groin, biting another in the arm and knocking down a woman who was holding a child.

Jefferson entered proceedings to forfeit the dogs, which Municipal Judge William Bowkley ordered on March 15.

A contempt charge against Gary Kolb was dismissed previously because he had not been involved in the Jersey City case.

Last time they found them a "home" they ended up back in the Kolbs home. Someone needs to ship this dog back to the breeder in South Africa or send it to an actual breed specific rescue agency who will send someone on their own to pick up the dog and be done with it.

Judge tells former Jersey City residents to give up surviving 'potentially dangerous' dog

A Jefferson Municipal Court judge decided this week that former Jersey City residents Gary and Susan Kolb must give up their ?potentially dangerous? dog, according to an online report.

Judge William Bowkley ordered the Kolbs to forfeit Imani, their female African Boerboel, at a hearing Thursday night, NJ.com reported yesterday. But Bowkley also granted the couple?s request for a stay pending an appeal of the ruling, which must be filed within 20 days.

The appeals process could take months, Jefferson Municipal Prosecutor James LaSala said. During that time, the Kolbs will be allowed to visit the dog, which has been held at the Jefferson pound since late last year.

The couple?s other African Boerboel, Jumba, died of cancer at the pound Jan. 15.

The dogs were seized in October 2011 after Gary Kolb was seen outside their home one morning walking one of the dogs without a muzzle, authorities said at the time. Under a consent order signed in Jersey City, where the Kolbs? dog problems began, Jumba and Imani had to be muzzled when off the Kolbs? property.

The Kolbs? legal problems began in 2008 when Jumba and Imani knocked down a woman holding her 6-year-old grandchild in Jersey City. A few months later a man was bitten in the groin and another man in the arm. In May 2009, the Kolbs saved the dogs by agreeing to move them out of Hudson County.

Less than two years later, authorities found that the dogs had been moved back into the Kolbs? Jersey City home. The couple again saved the dogs by agreeing to move them out of Jersey City, and the couple moved with their dogs to Jefferson.

LaSala said he plans to work with the Kolbs to find a permanent home for Imani, NJ.com reported. In the meantime, Meredith Petrillo, Denville?s animal control officer, has agreed to help them find an independent professional to evaluate the dog and see whether it should still be considered ?potentially dangerous,? a term given to it by the state after the attacks, LaSala told NJ.com.

The town would have the option to euthanize the dog if it were to prevail in the Kolbs? appeals, but LaSala said that would be a last resort only considered if a suitable facility couldn?t be found.

?Nobody wants to kill the dog,? he said.

Try and spin what I write all you want but it makes you look silly. As I have stated many times, the Kolbs are TERRIBLE dog owners and I never supported THEM. They could not control these giant dogs. That being said if you are going to argue that the dogs are vicious then show us the bodies. That baby as well as the others would've been dead in seconds if the dogs were intent on killing or maiming. Don't they kill lions in Africa? Exactly.

The Jersey City woman ordered to give up a pair of large dogs in 2009 after they attacked several people was arrested after city animal control officers found she still had the dangerous South African Boerboels at her home, officials said today.

Susan Kolb is now charged with contempt and could face up to 18 months behind bars if convicted of disregarding the order of Jersey City Municipal Court Judge Nesle Rodriguez in 2009.

Kolb was released on her own recognizance when she made her first court appearance on the charges this morning before Hudson County Superior Court Judge Kevin Callahan, Hudson County Assistant Prosecutor Leo Hernandez said.

The dogs are currently being cared for at the Liberty Humane Society in Jersey City.

After the attacks in 2009, the dogs faced possible euthanization when Jersey City impounded them under the state Vicious Dog Law. Kolb went to trial to defend the dogs and as part of an agreement with prosecutors reached on May 15, 2009, the dogs were ordered removed from the jurisdiction.

It was said at the time that Kolb had made arrangements for the dogs to be cared for in California.

On Jan. 17 Jersey City police got a 911 call from Kolb's neighbor saying Kolb's husband was being attacked by two dogs. When police knocked on Kolb's door they were told there was no problem, Hernandez said.

Then Jersey City Animal Control got more information on the dogs and the municipal court issued a search and seizure warrant for the Kolb residence. On Jan. 28 police executed the warrant seized the dogs, named Jumba and Imani, and arrested Kolb on outstanding warrants for unpaid fines, Hernandez said.

The Hudson County Prosecutor's Office later filed the contempt charges and Kolb was arrested on that charge today and processed.

Jonathan L. Rodriguez, 24, of Brunswick Street, was injured on Jan. 19, 2009 at Washington Street and Christopher Columbus Drive. He said Kolb unleashed the dogs and they ran across the street and tore into his arm.

A group of construction workers tried to scare the dogs away during the attack and a driver tried to frighten them off with his car. Kolb said the dogs got spooked by trucks plowing snow and got away from her.

James Joyce, 24, said he needed six stitches after being attacked on Jan. 9, 2009 by the dogs at Warren and Morris streets. Joyce, who has also filed a lawsuit against Kolb and her husband, Gary, said he was struggling to keep one dog from biting his face when the other bit him in the groin area.

Susan Kolb said Joyce was not injured and that he had approached the dogs incorrectly.

On Sept. 21, 2009 at the park at Greene and Essex streets, police said the two dogs were reportedly unleashed when they knocked down a woman who was carrying her 6-month-old granddaughter. Kolb said she thought the park was empty.

In 2009 the Prosecutor's Office charged Kolb with aggravated assault with a deadly weapon after the dog attacks and after she was indicted on the charge. She was later allowed to enter the pretrial intervention program because she had no prior convictions and she served no jail sentence.


All these "almosts" and the dog was "trying". Sorry, ain't buying it. Those types of dogs would make quick work of anybody if they were truly vicious. An innocent but boisterous Springer Spaniel knocked my nephews tooth out just horsing around. Those Kolbs belong in a cage before those dogs do/did.

Regardless of anybody's injuries from the dogs, these people defied the court order requiring them to ship the dogs out of state. If they had a problem with that, which they obviously did, they should have appealed the court order, not disobeyed it. It's not supposed to work that way. Why is that so hard for them or anybody else to understand?

Need people be reminded that these nut jobs agreed to ship the dogs out of state originally. It was discovered that the agreement had been disregarded when police were called to the Kolb's home because one of these "just big and boisterous" dogs was eating the face off Gary Kolb.

What a pity that the one dog passed but, again, it all came about due to the heartless, selfish behaviour of the owners.

Once these people defied the original court order that required them to move the dogs out of state, all bets were off. However unreasonable the court order may have been, they should have filed an appeal rather than disregarded it. Now they and the dogs are in that much more of a mess because they acted above the law. Doesn't matter what the dogs did or didn't do at this point, even though I saw pictures of the injuries from 2008 and 2009 in the Jersey Journal, and these dogs' history is well documented.

Dog dies as Jefferson couple fights to bring animals home

JEFFERSON ? One of the dogs at the center of an ongoing legal battle has died, owner Susan Kolb said on her Facebook page.

Kolb said Jumba, one of two 100-plus-pound African Boerbels, died Wednesday at 11 a.m.

"He wanted to go home," Kolb said.

Jefferson seized the dogs ? Jumba and Imani ? when Kolb's husband, Gary, was allegedly caught by police walking one of them without a muzzle, violating a court order, in October 2011.

The Kolbs were under a court order to muzzle the dogs in public after the animals attacked several people in Jersey City in 2008 and 2009. The Kolbs are facing contempt of court charges, which could land each of them in jail for up to 18 months.

The Kolbs also allegedly violated a different court order when they agreed to move the dogs to California, but were found with them more than a year later in their Jersey City apartment. They have pleaded not guilty.

The dogs were impounded in the Jefferson Township Municipal Pound for most of the past 15 months but were later moved to Woofs and Whiskers in Lake Hopatcong before it closed. The dogs were then transferred back to Jefferson, leaving Jumba "heartbroken," Kolb said.

Jumba, she said, had contracted lymphona recently and within one month had lost 40 pounds. The couple received permission Wednesday to rush the animal to a veterinary hospital in Fairfield, she said.

"It was too late," she said. "Now Jumba is dead."

While the dogs have been impounded for over 15 months, the Jefferson couple had recently struck a deal with Jefferson Municipal Prosecutor James LaSala to hold
off a forfeiture hearing, which could result in the dogs' eventual death, until their criminal cases had been resolved.

The deal with LaSala to push back the forfeiture motion was contingent on the Kolbs finding suitable housing for the dogs and paying Jefferson the $12,000 the township racked up housing the dogs in two payments ? one on Nov. 27, the other on Jan. 27. The Kolbs made the first payment despite missing the deadline by a few days.

Despite the arrangement, the Kolbs recently received notice that they are scheduled to appear in court Thursday for the forfeiture hearing.

"I thought we had a deal in place," Kolb told NJ.com earlier this month. "I don't know what this is."

LaSala has said the dogs posed too great a threat to township's animal control officer and pound volunteers to remain at the shelter long-term, and that at least two of the alternatives the Kolbs have suggested wouldn't work.

Kolb said LaSala has rejected offers the couple has made to move the dogs to facilities in Green and Hackettstown. The prosecutor has said he hoped to move them to an out-of-state shelter, and that he didn't want to see the dogs euthanized, but would move ahead if a suitable location for the pair couldn't be found.

Regarding the couple's alleged violations of court orders, Kolb said on her Facebook page a motion hearing is set for Feb. 7 at 9 a.m. in Morris County Superior Court. Kolb said if their motion to dismiss all charges fails, they will go to trial.

The Kolbs, who have started an online petition to let the animals go home to die, have also started a website aimed at helping them save their dogs.

Agreed AlexC.

For people who need to put it in human type terms, this is an animal with the intelligence of a 2 or 3 year old. Even with the best guidance you cannot guarantee what your toddler will do when left to their own devices. Now couple that with inborn instincts or certain characteristics that humans have bred into the animal & you have this said situation. This is probably an incredible dog, out on the African savannah but here not so much.

Just sad.

not sure if this has been raised, but why do you need to raise a breed in the city or suburbs one that was meant to keep you safe from Lions?

Never bought that story. These dogs are boisterous and hard to handle for sure but aggressive? There would be lots of dead bodies if they were truly aggressive. I have met people who worked with those border collies who do frisbee catching. One guy got his scrotum ripped open and a woman got a cracked vertebrae in her neck. Neither was done on purpose, just big strong dogs that can injure during play.


Vigilante, with all due respect, read the history of this breed. It was not bred to be warm & cuddly. And comparing accidents that happen like those you mention are not even in the same ball park with what these dogs have done. As for the temperment thing. There are a whole poop load of dogs that the owner will tell you, "let me put the dog in the other room", "don't bother the dog", etc.. We both know this is true. I don't have to think twice about any child just coming up to my dog & petting her. Yet she was standoffish & aloof when I first got her. I worked hard at removing as many obstacles as possible that may have made her unpredictable & I still am vigilant. That is a responsibility & one that these people obviously feel does not apply to them.

I feel sorry for the dogs. Because of their owners selfish, irresponsible ownership, these dogs will never be in a loving home enjoying the remainder of their lives.

More than a year fighting would come to a close if Gary and Susan Kolb were forced to forfeit their two dogs, labeled "potentially dangerous" by the state, on Jan. 17.

Susan Kolb told NJ.com Saturday night she recently received a letter from Prosecutor James LaSala calling the couple back to court for the forfeiture hearing.

The Jefferson couple had recently struck a deal with LaSala to hold off such a hearing, which could result in the dogs' eventual death, until their criminal cases had been resolved.

"I thought we had a deal in place," Kolb said. "I don't know what this is."

Neither LaSala nor the Kolbs' lawyer, Robert Dunn, could immediately be reached for comment Sunday.

Jefferson seized the Kolbs' dogs ? two 100-plus-pound African Boerbels, Jumba and Imani, who allegedly attacked several people in Jersey City in 2008 and 2009 ? when Gary Kolb was allegedly caught by police walking one of them without a muzzle, violating a court order, in October 2011.

Gary and Susan Kolb each are facing contempt of court charges, which could land each of them in jail for up to 18 months. The Kolbs also allegedly violated a different court order when they agreed to move the dogs to California, but were found with them more than a year later in their Jersey City apartment. They have pleaded not guilty.

The deal with LaSala to push back the forfeiture motion was contingent on the Kolbs paying Jefferson the $12,000 the prosecutor said the township racked up housing the dogs in two payments ? one on Nov. 27, the other on Jan. 27. The Kolbs made the first payment despite missing the deadline by a few days.

The deal's other sticking point: that the dogs remain in housing LaSala deemed suitable. The African Boerbels were recently relocated to the Jefferson Township pound after the Andover facility at which they were staying went broke and closed.

LaSala has said the dogs posed too great a threat to township's animal control officer and pound volunteers to remain at the shelter long-term, and that at least two of the alternatives the Kolbs have suggested wouldn't work.

On Saturday, Susan Kolb said Jumba was recently diagnosed with lymphoma, a form of cancer.

"I hope we can get him out before he dies," said Kolb, who also said Imani was sick.

Susan Kolb said LaSala has rejected offers the couple has made to move the dogs to facilities in Green and Hackettstown. The prosecutor has said he hoped to move them to an out-of-state shelter, and that he didn't want to see the dogs euthanized, but would move ahead if a suitable location for the pair couldn't be found.

The couple plans to start a nonprofit aimed a helping "dog owners save their dogs," Susan Kolb said in an email

These people managed to outdo themselves again... they think that if they agree to move out of Jefferson, they should get the dog back, despite their continued flouting of the court's authority. They also don't want to pay Jefferson back for the costs of housing the dogs in a kennel while these court proceedings went on. They really have no shame.

A Jefferson Township couple said they're willing to move to get their dogs back.

Again.

Jefferson Township sized the dogs ? two 100-pound African Boerbels ? in October 2011 after police said an officer saw Gary Kolb walking one of them without a muzzle. To keep the dogs after they allegedly attacked three people in 2008 and 2009, Gary and Susan Kolb agreed to move them from Jersey City and to keep them muzzled.

Susan Kolb also said the charges against them were false.

"We are proposing that they drop all the charges, give the dogs back and we will move to an agreed upon location," Susan Kolb said.

Prosecutor James LaSala gave the Kolbs a week to agree to either move their dogs to an out-of-state facility and pay Jefferson back the $10,000 LaSala said it has cost to house the dogs.

Or they could face the dogs' possible euthanaziation, LaSala said.

LaSala has said he doesn't believe the dogs are necessarily the problem, but that they could be considered dangerous, and the Kolbs shouldn't own them.

The Kolbs were scheduled in court Thursday, but the appearance was pushed back to Oct. 25. The Kolbs' attorney, Robert Dunn, didn't return repeated messages asking for clarification on the reason for postponement.

Susan Kolb said in an email she didn't understand why the couple had been placed into the "Biblical position of giving up the dogs or having the dogs killed."

Susan Kolb said her family has been shown "tremendous hostility" by "certain individuals in the Township of Jefferson."

She didn't say whether the family would be amenable to paying back Jefferson if it were allowed to leave with its dogs. She said she wanted to see receipts for the money spent because the family provided the dogs food and cleaned their cages.

Their website is a little confusing to navigate, because the links at the top are somewhat hidden. Anyway, I'd like to know what insane "anonymous" person donated $2100 to help these people. Probably didn't happen, they just put it on there to look like people supported them.

Ahh, invoking the old black bear defense. Interesting how they conveniently forgot to mention the fact that their dogs attacked multiple people and caused serious injury:

And Here's why we don't have the money we need and why we need your help

Because, in order to get the dogs out of the Jersey City shelter they were in, we agreed to:1.
Move our family from Jersey City, New Jersey, to Morris County, New Jersey ($7500.00)

2.
Purchase potentially dangerous dog licenses ($600.00 dollars for each dog for each year for each town )


3.
Erect a 6 ft fence in the backyard ($3000.00)

4.
Get the dogs tattooed ($250.00 for each dog) even though they are already micro-chipped.


5.
Take the dogs to a dog behavorist ($450.00 for each dog)

6.
Walk Jumba and Imani with short leashes and muzzles which we gladly agreed to and did.


Now we have to defend ourselves from the contempt charges stemming from Jumba dislodging his muzzle...almost 8 months ago.


How much will it cost?

These charges carry a one year sentence, despite the fact no one was injured and the dog had the muzzle off his face for about a minute.

In fact, I had the muzzle in my hand...and was about to put it back on Jumba, when I was confronted by a policeman in an unmarked car that was parked in an unlit, wooded area at 6 am and asked if I was "Baldwin".

It was dark, too dark for me to see to immediately replace the muzzle. And I was concerned that there were bears in the area.

However, I asked the policeman if I should replace the muzzle. He said no, just walk the dogs home. I did as he asked and now we are facing contempt.

But nonetheless, our lawyer is telling us it will cost us another $20,000 to defend ourselves.

Why were Jumba and Imani wearing muzzles?

Because instead of going to Trial, we agreed to a settlement which declared the dogs potentially dangerous.

Do muzzles come off ?

Absolutely.

Are some harder to get off than others?

Yes.

Did we know which muzzles were the best ones to use?

No.

Were we told or did we agree to purchase a specific kind of muzzle for either dog?

No.

In addition, the only muzzles that the pet stores in our area sold were nylon muzzles. These muzzles even have pictures of dogs that look like Boerboels on the plastic packaging.

The good thing about these muzzles is they look less frightening to people than wire basket muzzles.

However, dogs actually prefer wire basket muzzles, because they allow the dog to pant and to drink water (which is how dogs regulate their body temperature). But we didn't know this at the time.

The other problem that nylon muzzles have, which we later found out, is that they are easier for dogs to dislodge.

And like you, (unless you're a professional dog trainer or breeder of large dogs) I thought a muzzle was a muzzle... like a leash was a leash.

In fact, it wasn't until I did a google search and also talked to a professional Boerboel breeder that I found out which muzzles were the best to use.

And yet, both my wife Susan and myself are still being charged with contempt. And our dogs are locked up in a kennel...with nothing to look at but four walls, and no place to run or exercise...why?

So we're asking for your help.

We are being accused of contempt of Court which carries up to a year in jail, and Jumba and Imani face a life of imprisonment or worse, because Jumba was able to pull his muzzle down.

Why did he pull his muzzle down?

Because as I said he sensed black bears.

How do we know this?
1.
According to New Jersey State officials human and bear encounters were on the rise in Fall of 2011, when this happened.

2.
In fact, that very morning we saw a mother black bear and her two cubs on our lawn.

3.
A couple of days later New Jersey authorized its 2nd consecutive yearly black bear hunt. This hadn't happened in over 40 years.


Again, this was at 5:30 in the morning on garbage collection day when bears are actively looking for food, when it was pitch black outside and there were no people around...so how is this contemptuous?

We are accused of a crime which defies logic, or motivation.

However, the only way we can get our dogs back is by going through with a Trial. And as you know lawyers cost money.

We believe our rights as Americans have been violated and our dogs have been seized and impounded without due process.

It has already cost us ten of thousands of dollars but just like you, our dogs are part of our family. We have to save them.

We were formally indicted on May 14, 2012. The Trial will be scheduled some time in the Fall. The next Court date is a pre-Trial hearing on June 21, 2012 ...and all this time our dogs will remain imprisoned.

We need money to pay for a lawyer, so we can defend ourselves, win, and save our dogs.
