Didn't the Hudson County Court tell her the same thing? She agreed to ship them to California but they wound up getting boarded in JC. She went and got them during a storm without anyone saying a word. And here we are again. She'll agree to give them away and the same shite will happen. This story is just repeating itself.

The courts are finally moving in the right direction on this, but justice won't be served until these people are in prison and/or the dogs are euthanized...

Couple, accused of failing to muzzle dogs after multiple attacks, loses bid to dismiss charge

Published: Tuesday, October 02, 2012, 7:25 AM Updated: Tuesday, October 02, 2012, 7:58 AM

A state Superior Court judge refused to dismiss a criminal charge Monday that a Jefferson couple violated a court order by allegedly failing to muzzle their two African Boerboel dogs during a walk around their neighborhood last year, the Daily Record reported.

On Oct. 18, 2011, Gary and Susan Kolb were cited for walking their dogs, Jumba and Imani, without muzzles at 6:15 a.m. near their home in Jefferson, as reported by the Jersey Journal at the time. As part of an agreement they made with the court less than two weeks prior, the couple had agreed to muzzle their dogs when the animals were our of their enclosure.

The dogs, which have been in a Jefferson pound since last October, will receive a hearing Thursday to determine whether they will be euthanized, the Daily Record report said.

In separate incidents that occurred in 2008 and 2009 in Jersey City, the dogs had bitten a man in the groin, another man in the arm and knocked down a woman holding her 6-month old grandchild, the Jersey Journal has reported. Susan Kolb told a court in May 2009 the animals would be relocated to California to prevent their euthanization. However, the animals were later found in their Jersey City home in January 2011.

Susan Kolb was convicted last year of being in contempt of the court order to move the dogs and she was sentenced to two years probation by a Hudson County Superior Court judge. The couple, again, saved the dogs by agreeing to move them out of Jersey City and to abide by certain rules including muzzling the animals while out of their enclosure.

The couple was indicted by a Morris County grand jury in April for contempt of court for failing to muzzle their dogs in Jefferson despite their agreement in Jersey City and could face up to 18 months in state prison if found guilty, the Jersey Journal reported at the time. The Kolbs have pleaded not guilty to the charge.

There were three different civil lawsuits, all settled out of court, by the victims mentioned in the article. Nobody knows how much the owners paid in the settlements, but somehow the owners still had the money for various criminal attorneys to represent them against the prosecutors, to move out to Jefferson and to build fences for their dogs. I wish the civil suits had bankrupted these people and made them unable to afford these dogs.

Lawman: Court order violated

In mid-October, Kolb and her husband were spotted walking the unmuzzled dogs near their home, but the animals were each on a leash.

Defense lawyer Robert Dunn asked Weinsenbeck to dismiss the case on the grounds it is ?de minimis? or too trivial to be prosecuted. Dunn contended there was no one around when the Kolbs walked the dogs and therefore no danger to the public. He said the couple spent $30,000 erecting fencing and posting signs about the dogs at their Jefferson home and had muzzles for the dogs, but the Boerboels were able to remove them from their faces.

Then get better muzzles, bitch. The ones I've seen at the Greyhound racetracks seem to work pretty well. Your dogs are dangerous and you don't deserve to own them.

Jefferson couple battles to save two pets
Lawman: Court order violated

11:05 PM, Sep 28, 2012

Written by

A Jefferson couple who own two large African Boerboel dogs that bit two men in Jersey City asked a judge Friday to dismiss charges that they violated a court order by walking the pets without muzzles in their Oak Ridge neighborhood last year.

Jefferson Officer Bryan Christie on Oct. 18 cited Susan and Gary Kolb for walking their ?potentially dangerous? dogs, Jumba and Imani, without muzzles at 6:15 a.m., in violation of a court order issued on Oct. 7, 2011, by a Jersey City Municipal Court judge.

Superior Court Assignment Judge Thomas Weisenbeck, sitting in Morristown, said he would issue a ruling by Monday. But the Kolbs face a harsher hearing on Thursday in Jefferson Township Municipal Court, where municipal Prosecutor James LaSala has filed a motion for forfeiture and euthanization of the two mastiff breed dogs.

If the judge denies the request for dismissal of the charges, the Kolbs would face prosecution and penalties of up to 18 months in prison for violating a court order. The dogs have been held since Oct. 21, 2011, in an animal shelter in Jefferson, and the Kolbs say they visit their pets nearly every day.

Susan Kolb, who said Friday that the dogs are a companion to her severely autistic son, had agreed in May 2009, when she lived in Jersey City, that the dogs would be moved out of the county. The agreement was to stop an attempt by Hudson County officials to euthanize the dogs after separate incidents in 2008 and 2009 that involved one man being bitten in the groin, a second in the arm, and a woman knocked to the ground while holding her 6-month-old grandchild.

Susan Kolb was cited in January 2011 for contempt of court when authorities learned the dogs were still in Jersey City. She was convicted and placed on probation for two years. Last October, she signed another consent agreement in court to move the dogs ? deemed to be ?potentially dangerous? under state law ? to her new home in Oak Ridge.

?The only harm or threat of harm that day would be hypothetical,? Dunn said.

Attorney Peter LaGreca, a legal intern for the Morris County Prosecutor?s Office, argued that the charges should remain intact, and he pointed out the three violent occurrences in Jersey City.

?There?s no such thing as a trivial violation of a court order,? LaGreca said. He said the Kolbs are aware of the potential danger their dogs pose but ?had no qualms? about violating the court order on muzzling.

I'm amazed these dogs, if not their owners, haven't died of old age as this thing moves glacially through the courts.

A former Jersey City woman whose dogs were accused of committing violent attacks faces a violation-of-probation hearing Friday and possible prison time after authorities say she was walking the dogs without muzzles in her new hometown last October.

Susan Kolb and her husband, Gary Kolb, now of Jefferson Township, were indicted by a Morris County grand jury on one count of contempt for allegedly violating the terms of a court agreement which had spared the dogs from possible euthanizations.

Among the conditions of the agreement was to have the large South African Boerboels -- Jumba and Imani -- muzzled when not in their enclosure. Susan Kolb faces up to 18 months behind bars if found to have violated the terms of her probation.

Susan Kolb's attorney, Gerald Miller, said "She is going to enter a plea of not guilty."

After the Downtown Jersey City attacks in 2008 and 2009, which sent three adults and a baby to the hospital, the animals faced possible euthanization. In May 2009, Susan Kolb saved them by agreeing in Jersey City Municipal Court to move the large South African Boerboels out of the county.

The agreement fell apart in January 2011, when police found the dogs at the Kolbs' Jersey City home. Susan Kolb was convicted of being in contempt of the court order to move the dogs and she was sentenced to two years probation by a Hudson County Superior Court judge.

The couple saved the dogs again by once more agreeing to move them out of Jersey City and abide by certain rules. But soon after moving to Jefferson they were cited for failing to muzzle the dogs while they were out of their enclosure -- allegations that led to the indictment in Morris County. The dogs have been impounded since the muzzle violation on October.

The indictment, in the case of Susan Kolb, represents a re-involvement in the criminal justice system and a violation of her probation, officials said.

Susan Kolb's violation-of-probation hearing will be Friday morning before Hudson County Superior Court Judge Lisa Rose in the Hudson County Administration Building in Jersey City.

Caj - the Kolb's are facing violations in two jurisdictions - Morris County where they are facing contempt charges AND in Hudson County where they are facing parole violation charges.

That's the way I read it...

Well, now that her case has been transferred back to Hudson County, she'll probably get off easy again. It's the inmates running the asylum in this county's court system. I can only hope the legal bills are bankrupting her.

JJ: KOLB HEADING TO JAIL?

The recent indictment of a former Jersey City woman whose dogs committed violent Downtown attacks has triggered the filing of a violation of probation against her that could put her in state prison for 18 months, officials said yesterday.

Susan Kolb and her husband, Gary Kolb, now of Jefferson Township, were indicted by a Morris County grand jury recently on one count of contempt and they each face possible sentences of up to 18 months in prison if found guilty, officials said last month.

The agreement fell apart in January 2011, when police found the dogs at the Kolb's Jersey City home. Susan Kolb was convicted of being in contempt of the court order to move the dogs out of town and she was sentenced to two years probation by a Hudson County Superior Court judge.

The couple saved the dogs again by once more agreeing to move them out of Jersey City and abide by certain rules, but soon after moving to Jefferson they were cited for failing to muzzle the dogs while they were out of their enclosure. The muzzle allegations led to the recent indictments against the Kolbs in Morris County.

The indictment, in the case of Susan Kolb, represents a re-involvement in the criminal justice system and a violation of her probation, Hudson County Assistant Prosecutor Leo Hernandez said yesterday.

Susan Kolb's violation of probation hearing is scheduled for June 29 before Hudson County Superior Court Judge Lisa Rose in the Hudson County Administration Building in Jersey City.

It's not clear who is representing Susan Kolb in the matter of the violation of probation.

How insane are these people? Muzzle your dogs, keep them on leash and don't let them attack people. Pretty simple. Sounds like they should be impounded.

I really hope the Morris County courts have more sense than the Hudson County courts do.

The judge in Jersey City, Nesle Rodriguez, who released the dogs back to the Kolbs has to be one of the biggest idiots I've ever seen. You google her name and there's a lot of other information about ridiculous courtroom decisions she made. Definitely the perfect example of a corrupt judge. How the hell did she get through law school and the bar exam? The Hispaniic Bar Association of New Jersey supports her, however (surprise surprise), because her track record doesn't matter to them, only her ethnicity.

I wonder if the Kolbs ever paid the $10,000 fine, given they didn't pay the other municipal court fines, I have a pretty good idea about that.

So now we're in the fifth year of this case. I'm glad the dogs have been impounded again and the people in Oak Ridge don't have to worry- for now. Hopefully the judge in Morris County will have more sense than Nesle Rodriguez did and hand down a meaningful punishment.

as has been said before, a million times, these people have no regard for anyone's safety, nor for the law. the dogs should be taken - and never returned, and the couple needs to go to jail.

period.

From NJ.com:

The former Jersey City couple whose dogs committed violent attacks in Downtown Jersey City have been indicted on contempt charges after allegedly failing to muzzle the animals at their new home in Jefferson Township, officials said.

Susan and Gary Kolb have each been indicted on one count of contempt and they face a possible sentence of up to 18 months in prison if found guilty, Morris County Prosecutor's Office Captain Jeffrey S. Paul said yesterday.

The Kolbs' attorney, John Nulty, said yesterday that his clients "will continue to press ahead and demonstrate their innocence and obtain their dogs."

On Oct. 18, Jefferson officials cited the Kolbs for failing to muzzle their two large South African Boerboels -- Jumba and Imani -- while out of their enclosure, a violation of the agreement to allow them to bring the dogs there. The Kolbs were charged with contempt by the municipality and the dogs have been impounded since then.

The Kolbs pleaded not guilty to the failure-to-muzzle charge in Jefferson Township Municipal Court, where the judge ruled the contempt charge made the case a criminal matter and it was forwarded to the Morris County Prosecutor's Office. The pair were indicted following a presentation to a Morris County grand jury.

After the Downtown Jersey City attacks in 2008 and 2009 that sent three adults and a baby to the hospital, the animals faced possible euthanization. In May 2009, Susan Kolb saved them by agreeing in Jersey City Municipal Court to move them out of the county.

The agreement fell apart in January 2011 when police found the dogs at the Kolbs' Jersey City home.

The couple saved the dogs again by once more agreeing to move them out of Jersey City, but soon after moving to Jefferson they were cited for muzzle violations. If the couple is found guilty of the to contempt charges, the dogs could face euthanization under the state's Dangerous Dog Law.

Judge rules Jersey City couple whose dogs committed violent attacks should face criminal charges for failing to muzzle them

By Michaelangelo Conte/The Jersey Journal

JEFFERSON ? A judge has ruled that a Jersey City couple whose dogs committed violent attacks Downtown should face criminal charges for failing to muzzle the animals in their new home in Jefferson Township, officials said.

On Oct. 18, Jefferson officials had ticketed Susan and Gary Kolb for failing to muzzle the two large South African Boerboels while out of their enclosure. The couple is also charged with contempt of a Jersey City court order requiring the dogs be muzzled when not behind a fence.

The couple pleaded not guilty and when they appeared for trial Thursday night, the Jefferson Township municipal judge said the wrong statute had been cited in the contempt charge. He said the correct statute was a criminal matter and forwarded the case to the Morris County Prosecutor?s Office for review and possible presentation to a grand jury.

After the Downtown Jersey City attacks in 2008 and 2009 that sent three adults and a baby to the hospital, the animals faced possible euthanization. In May 2009, Susan Kolb saved them by agreeing in Jersey City Municipal Court to move them out of the county, but the agreement fell apart in January when police found the dogs at the Kolbs? Jersey City home.

The couple saved the dogs again by once more agreeing to move them out of Jersey City, but soon after moving to Jefferson Township the couple was issued the muzzle violation summonses. If the couple is found to be in contempt of the agreement made in Jersey City Municipal Court, the dogs lives? could be on the line again under the state?s Dangerous Dog Law.
Kolb?s attorney, John Nulty, declined to comment.

Here we go, round number... um, I've lost track of the number of rounds in court involving these people.

Their new trial date is set for December 15th. I wish I could get off work, I'd love to hear what they have to say for themselves this time...

Owners of dogs in Jersey City attacks have trial date in Jefferson

Published: Thursday, December 08, 2011

The former Jersey City couple who own dogs that committed violent Downtown attacks will be tried on Dec. 15 on charges they failed to muzzle the dogs in their new home of Jefferson Township, officials said today.

In early November, Susan and Gary Kolb were formally charged in Jefferson Township Municipal Court after being cited for failure to muzzle the two large South African Boerboels on Oct. 18. They pleaded not guilty, but for the third time since 2009 there is a possibility the dogs -- Jumba and Imani -- will be put down.

After the Downtown attacks in 2008 and 2009 that sent three adults and a baby to the hospital, Jersey City impounded the dogs. They faced possible euthanization under the state Vicious Dog Law, but in May 2009 Susan Kolb saved them by agreeing to move them out of the state.

The agreement fell apart in January when police found the dogs at Kolb's Jersey City home. She was arrested on warrants for unpaid municipal court fines and later pleaded guilty to criminal contempt of court. The violation of the court order also put the dogs' lives on the line a second time.

Earlier this year, the Kolbs saved the dogs from possible euthanization by agreeing in court to move them out of Hudson County. They relocated to Jefferson Township and promised to comply with the state's dangerous dog regulations, which require the dogs to be muzzled when not in their enclosure. After being cited for muzzle violations, the dogs were again impounded.

The trial is scheduled for 7 p.m. on Dec. 15 in Jefferson Township Municipal Court, located at 1033 Weldon Rd. in Lake Hopatcong.

Welcome, my friends, to the show that never ends...

This whole saga, undoubtedly, will enter its fourth year soon. If this woman had just done what the courts said, this would have been long over.

The saga with this continues, she'll be in court on Thursday for disobeying the court order (see links). I'd love to be there and hear her arguments this time:

This woman seriously needs some jail time to understand the reality of her situation. Please throw her in the slammer. I am surprised the dogs were actually out of JC.

Look how little time it took for Ms. Kolb to act above the law again this time.

I applaud Jefferson as well for taking swift action. Let's hope their judges have more of a backbone than Jersey City's judges. Hopefully the dogs will be permanently taken away, and Mr. and Ms. Kolb will spend a weekend or two in the big house for a little bit of thought refore. Of course, if they get off easy again and get their dogs back, I won't be terribly surprised given all they have gotten away with so far, but I'd like to think that justice will eventually prevail.

Kudos to Jefferson Township for taking quick and decisive action against this woman...

-----------------------------------------

Dangerous dogs shipped out of Hudson County are in trouble in new home - in danger of being put down:

The Jersey City owner of two dogs tied to violent attacks saved their lives twice by promising to move them out of Jersey City, but the dogs are again in danger of being put down after they were impounded yesterday, officials said.

"They moved here, with all kinds of conditions in the order, including that the dogs had to be muzzled," said Jefferson Township Police Capt. Eric Wilsusen said today of Susan and Gary Kolb and their South African Boerboels, Jumba and Imani.

"We are enforcing the agreement in Jersey City," Wilsusen said. "We took the dogs yesterday at about 3:45 p.m. We are holding them and Jersey City is making arrangements to get them."

After the Downtown Jersey City attacks in 2008 and 2009, which sent three adults and a baby to the hospital, Jersey City impounded Jumba and Imani, who weight a combined 160 pounds.

They faced possible euthanization under the state Vicious Dog Law, but Susan Kolb struck a deal in court in May 2009, agreeing to move them out of the state.

The agreement fell apart in January when police found the dogs at Kolb's Jersey City home. She was arrested on warrants for unpaid municipal court fines and the dogs' lives were on the line again. Kolb was also charged with criminal contempt in Superior Court, a charge to which she pleaded guilty.

Earlier this month she sentenced to two years probation and 100 hours of community service for the criminal offense.

The dogs sat in a pound for nine months, until the Kolbs again saved them with a new deal struck in Jersey City Municipal Court earlier this month. The Kolbs agreed to pay a $10,000 fine and promised the dogs would never set paw in Hudson County again.

?We are in the process of reviewing the (Jefferson Township) order and any citizen complaints that may have been alleged,? said Hudson County Assistant Prosecutor Leo Hernandez. The prosecutor said recent events ?May in fact lead to a violation of the terms or (Susan Kolb?s) probation.?

The couple moved to Jefferson Township and promised to comply with the state's dangerous dog regulations, which requires the dogs be muzzled whenever outside their enclosure.

Wilsusen said homes are pretty close together where the Kolbs now live and the neighbors were upset to see the couple and their notorious dogs move in. Town officials were concerned, too, and as a result, police "had patrols in the area and while the officer was sitting there they did see the dogs without a muzzle," Wilsusen said.

That was on Oct. 18 when the Kolbs were each cited for failing to muzzle the potentially dangerous dogs.

On Tuesday at a court hearing in Jefferson Township testimony was heard by a police officer and animal control officers who said they saw the dogs unmuzzled. After that, the judge ordered the dogs impounded, citing a violation of the Jersey City Municipal Court order.

The Kolbs' attorney, John Nulty of Jersey City, said today that "I will be discussing what the appropriate steps are to be taken on behalf of the Kolbs."

Owner of 'potentially dangerous' dogs cited for infraction in new home

http://www.nj.com/jjournal-news/index ... otentially_dangerous.html

The Jersey City woman whose dogs committed several violent attacks saved the animals? lives by agreeing in court to move them elsewhere.

But now police in a Morris County township, where they now reside, have cited her for an infraction that violates the agreement, officials said.

In a new deal struck in Jersey City Municipal Court two weeks ago, Susan Kolb and her husband, Gary Kolb, the owners of two South African Boerboels, agreed to pay a $10,000 fine and promised that the dogs would never set paw in Hudson County again.

The dogs are declared ?potentially dangerous? and as part of the deal the Kolbs agreed to comply with the state?s dangerous dog regulations, which require the dogs be muzzled when outside their enclosure.

But on Thursday, Jefferson Municipal Court Administrator Elizabeth Mertz said Susan Kolb was issued a summons on Oct. 14 citing her with ?failure to muzzle a potentially dangerous dog.?

Kolb is scheduled to appear on the violation Nov. 1, Mertz said. She also is serving two years? probation

Kolb attorney John Nulty of Jersey City said his clients ?are doing all they can to comply with all their legal obligations and any concerns of their neighbors and they want nothing more than to live a quiet life in the community.? He said he will look into the summons.

A Jefferson Township Health Department official said several township departments have received calls from residents with questions about the dogs.

On the morning of Monday, Oct. 17 ?they weren?t muzzled and I asked (Kolb) about it,? Jefferson resident Michelle Young said Thursday.

?She said she would (expletive) sue me if I kept harassing her ... She said her dogs haven?t hurt anyone since 2008.?

After the dog attacks in 2008 and 2009, which sent three adults and a baby to the hospital, Jersey City impounded the dogs.

The animals faced euthanization under the state Vicious Dog Law, but Kolb struck a deal in court in May 2009, agreeing to move them, initially out of the state.

In January of this year, however, police found the dogs at Kolb?s Jersey City home and arrested her on warrants for unpaid municipal court fines.

She also was charged with criminal contempt in Superior Court, to which she pleaded guilty and was sentenced to two years probation and 100 hours of community service.
