I have a friend who is a business man in the area. He goes to a local restaurant where the workers sit at the bar at lunch and drink. Drink a lot. One guy wears garlic around his neck because he thinks that the working situation is cursed.

But the drinking is what scares me, trust me - my pal takes the long way back to the office to avoid being under that building.

Concrete Company Cited for Alleged Fall and Protruding Rebar Hazards

OSHA has cited a New York City-headquartered company for numerous alleged safety and health violations, proposing $877,000 in fines. The company is the concrete contractor for the construction of 77 Hudson, a condominium project involving two 50-story condominium towers in Jersey City, New Jersey.

OSHA initiated its investigation on December 19, 2007, in response to a complaint alleging several fall hazards. OSHA investigators found that the company failed to provide adequate fall protection for employees exposed to falls from as high as 25 stories above the ground. The company also failed to provide protection from protruding rebar. According to OSHA, most of the violations were willful because the company was fully aware of OSHA's fall protection requirements. The company's superintendent for the 77 Hudson project, as well as its vice president were previously managers at other concrete companies that had violated the same standards on many previous occasions. In this case, OSHA visited the 77 Hudson project seven times between December 19, 2007, and January 24, 2008, and found the same violations on each successive floor as the building's height increased. Despite OSHA's repeated admonishments on each of these visits, the company's managers still failed to comply with the OSHA construction standards. As a result, OSHA cited the company for 15 willful violations, with $870,000 in penalties, and two serious violations, with $7,000 in penalties.

OSHA defines a willful violation as one committed with plain indifference to, or intentional disregard for, employee safety and health. Serious violations are those that could result in death or serious physical harm about which the employer knew or should have known.

The problems included a lack of guard rails, improperly built scaffolds, unguarded utility holes and protruding rebar, said Department of Labor spokeswoman Leni Fortson.

In all, Broadway Concrete racked up 15 "willful violations" totaling $870,000 in fines and two "serious violations" for another $7,000.

Broadway Concrete's site superintendent at 77 Hudson and its vice president were managers at other concrete companies that had violated the same standards, OSHA officials said.

"The many alleged safety violations found at Broadway Concrete's site put employees at great risk for potential injuries or death," said Edwin G. Foulke Jr., assistant secretary of labor for OSHA.

Broadway Concrete owner Robert Cassera, who also owns Tri-State Employment Services, could not be reached for comment. He has 15 business days to contest the penalties.

Calls to the site's general contractor, Hunter Roberts Construction Group, and to the developer of 77 Hudson, K. Hovnanian Homes, were not returned.


I'm assuming that's the concrete company that spilled liquid concrete onto my brand new car from about 40 stories up. My insurance is presently suing them. That construction site is a disaster. I've witnessed about 50 large pieces of lumber getting blown off the building due to high winds in the past 6 months. They've dropped so many things onto Greene St that it's actually been closed on several occassions. Not to mention that my building is now covered in scaffolding until they finish. I feel sorry for anyone in my bldg trying to sell a condo right now. The scaffolding is a big time eyesore!

That is not the way it works. Just because you are lowest bidder, does not mean that you are lowest qualified, it just means that you submitted the best price. If it is a government job, they must take the lowest bidder. If it is not a govt job, ie: a Trump building, they can take whomever they want if they want to pay the higher price, but most of the time they take the lowest bidder. We did the painting work inside the Goldman Sachs tower in JC and during that project an elevator worker fell down the shaft from one of the higher floors to his death, right before Christmas. It can happen on any job. Accidents happen, it is a tragedy, but it happens. Construction is dangerous work.

The man who died after falling 14 stories from a waterfront high-rise in Jersey City on Thursday has been identified as a 31-year-old Queens man, Hudson County officials said yesterday.

Quincy Brewster fell from the 25th floor of 77 Hudson St. and landed on the roof of an attached parking garage about 14 stories below.

Hudson County Prosecutor Edward DeFazio said Brewster had been wearing stilts while doing plastering work in the building, which is under construction, but was not wearing them when he fell.

A preliminary autopsy indicates Brewster, who was working for Broadway Taping, died of multiple blunt impact injuries and he suffered multiple skull fractures, as well as other broken bones in various parts of his body, DeFazio said, adding that there is no evidence of foul play.

DeFazio said investigators do not yet know the circumstances leading to the fall and have conducted interviews at the job site but have not found anyone who was a witness. The prosecutor said detectives will interview Brewster's family members as part of the investigation.

The federal Occupational Safety and Health Administration has launched an investigation, but Assistant Area Director Carol Hammell said she could not reveal any further information. The investigation could take up to six months, she said.

Hammell said OSHA also has an open investigation of Broadway Concrete Corp., stemming from a regular inspection at the property in November that revealed some potential safety issue relating to fall hazards. She said that incident did not involve a fall and she did not think the two companies are related.

The building, which K. Hovnanian Homes is developing and will include luxury apartments and retail space, is expected to reach 48 stories. It now reaches 46 stories.

"We are obviously going to cooperate with any investigation," Doug Fenichel, a spokesman for K. Hovnanian, said yesterday.

Fenichel referred further questions to Hunter Roberts Construction Group, the general contractor.

Reached yesterday, Hunter Roberts marketing manager Colleen Rugg said: "I know that the local authorities have been there and OSHA is looking into the accident and our hearts go out to the family affected by this tragedy. But at this time we have no other comments."

How a construction worker plunged to his death yesterday at 77 Hudson St. is not the first mystery surrounding the two-tower construction project in Downtown Jersey City.

Officials are still investigating the cause of a four-alarm blaze on Oct. 8 that engulfed two stories of 70 Green St., which is connected to 77 Hudson by a parking garage.

The flames kept firefighters on the scene for 18 hours and set off a spectacular blaze.

Fire officials deemed the blaze "suspicious" and continue to investigate, said Jersey City Fire Director Armando Roman, who would not go into details for fear of jeopardizing the investigation.

The blaze began when cement forms on the 17th and 18th floors caught fire. The flames were difficult to extinguish because the wood frames, forms and wide open floors allowed the blaze to spread far more quickly than in a completed high-rise, Roman said at the time.

Roughly 60 families were evacuated from nearby homes for about 24 hours while there were concerns the building might collapse.

A worker fell to his death early yesterday afternoon at a high-rise construction site on the Jersey City waterfront.

The man fell from the 25th floor of 77 Hudson St. and landed on the roof of an attached parking garage about 14 stories below, according to police and workers at the scene.

Jersey City spokesman Stan Eason said the cause of the fall had not been determined and the man's identity could not be released because his family had not been notified.

It was not clear how the man was not caught by a safety net at the 23rd floor, leading some workers to speculate that he may have fallen from a floor below the 25th.

"He just fell, that's all we know," said one worker as construction crews left after the site was shut down for the day.

Workers at the scene said the man was a plasterer or taper and that he may have been on stilts to reach the ceiling of the floor he was working on.

A spokeswoman for the Occupational Safety and Health Administration said yesterday's incident is under investigation.

She said there is also an open investigation of Broadway Concrete Corp., stemming from an OSHA inspection at 77 Hudson in November. "It was a planned inspection with an emphasis on fall protection," said spokeswoman Leni Uddyback-Forstin.

A spokesman for Broadway Concrete did not respond to requests for comment yesterday.

Calls to the company overseeing the construction, Hunter Roberts Construction Group, and to the developer of 77 Hudson, K. Hovnanian Homes, were not returned.

Construction at the building, which will hold luxury apartments and retail space, has reached the 46th of 48 planned floors.

It's Rocky the Frying Squirrel!

A kamikaze squirrel fell from the sky and detonated a Bayonne woman's car Wednesday, police said yesterday.

Lindsey Millar, 23, and her brother, Tony, 22, were both home Wednesday at about 12:45 p.m. when they suddenly noticed Lindsey's car burning outside their 42nd Street home.

Tony Millar said yesterday that firefighters told them it was the work of a buck-toothed saboteur that had been gnawing on power lines connected to a transformer above the 2006 Toyota Camry.

"The squirrel chewed through the wire, was set on fire, fell down directly to where the car was," Tony Millar said. "The squirrel, on fire, slid into the engine compartment and blew up the car.

"They're always coming around here chewing through the garbage," he added.

Tony Millar says his sister's car was fully insured.

"It's something to laugh about once she has a new car," he said. "It's not funny yet."

Police said there were no injuries - except, that is, for the squirrel, which is dead.

The Millars' home is decorated for Halloween, complete with a tiny plastic tombstone on their front lawn. Tony Millar said the family will consider dedicating the tombstone to the squirrel, who was not named.

Generally speaking, there's nothing unusual or peculiar about FBI involvement in major criminal investigations (as arson is); you just don't often hear about it often.

In the context of a post- 9/11 world, having multiple agencies (local, state and federal), with different jurisdictional reaches, looking into a possible arson of this magnitude along the JC waterfront is fairly routine. The Feds (not just the FBI) have also had an increased presence in the JC area post 9/11 because of the high concentration of financial industry firms located here -- again no surprise here.

That being said the investigations are continuing at the local level, concurrently. The FBI's involvement means very little in of itself.

Can someone with insight into these matters explain why the feds would be called in? Why couldn't this be handled on a state or local law enforcement level? What type of involvement does this potentially indicate?

The FBI is coming to Jersey City to join the investigation into last week's highrise fire that destroyed the top floors of a waterfront building under construction.

Jersey City Fire Chief William Sinnott says he was informed yesterday that the federal investigators will be in town today to look into the Oct. 8 fire, which ripped through the 17th and 18th floors of the rsidential tower under construction at 70 Greene St.

The chief said he had no further information to release on the investigation being conducted by the Fire Department's Arson Squad.

Sinnott also said the department has reviewed its performance fighting the blaze and did find one area in need of improvement.

When a first alarm sounds at a highrise, the department automatically sends double the normal contingent of firefighters and equipment, an amount equal to what is deployed to a two-alarm fire.

"One problem was that since this wasn't an occupied building, the dispatch center didn't have much info on it, so we didn't know it was a high-rise," Sinnott said.

Sinnott said the Fire Department's database does not reflect the fact that a highrise is under construction until a certificate of occupancy is issued late in the building process.

When the alarm sounded the night of the blaze, firefighters responded with only a regular, one-alarm size contingent. The fire later grew to four alarms.

Sinnott said firefighters will focus on noting highrises under construction as they make their regular tours through neighborhoods in order to keep the database up to date.

Firefighters arriving at the blaze found the 17th and 18th floors engulfed in flames, which were visible for miles. The cause of the fire has not yet been determined, but it is thought to have started on the top floor, Fire Director Armando Roman said, adding that the fire has been ruled suspicious.

Firefighters attempted to fight the flames from inside the building, but high heat and other factors forced them to withdraw and battle the blaze from the ground with high-pressure arcs of water. The two top floors were destroyed by the time the fire was under control, by 1 a.m. on Oct. 9, officials said. About 60 families in area homes were temporarily evacuated due to the fire.

"All investigative resources necessary will be used as we work to find out if in fact there was a crime involved, if someone purposefully started the fire," Roman said.

Jersey City Fire Department arson investigators are calling Monday's raging high-rise fire suspicious.

"We have a renowned arson investigation unit and if there was in fact any wrongdoing by anyone, they will find it," Fire Director Armando Roman said yesterday of the Downtown blaze.

And while the investigation into the fire continues, it appears life is returning to normal around the scene of the fire.

The roughly 60 families evacuated from their homes on Greene Street Monday night were allowed to return to their residences Tuesday evening, Roman said, and officials were hopeful that Greene and Grand streets near the fire would be reopened last night.

The nearby offices of Merrill Lynch were able to reopen yesterday, Roman said.

Jersey City Building Department officials have given construction crews permission to work extended hours at the site to clean up debris on the ground near the building and to deal with the fire damage in order to resume construction, Roman said.

Firefighters responding to the four-alarm blaze at 8:40 p.m. Monday found the 17th and 18th floors engulfed in flames. The building is under construction and the cement forms on the top floors caught fire and burned brightly. The cause of the fire has not yet been determined but it is thought to have started on the top floor, Roman said.

Firefighters attempted to fight the flames from inside the building, but high heat and other factors forced them to withdraw and battle the flames from the ground. The fire was under control by 1 a.m. Tuesday and firefighters left the scene 2:34 p.m. that day, officials said.

I seem to recall this happened with the Gotham (Warren and Montgomery) when it was being built in the late 90's. Not on the same scale though.

It was a scary sight. Thank you to all the Fireman and other responders!

The school where we opened the shelter was like a little Noah's Ark, lots of kitties, puppies and a gerbil!

That building also was the scene of a top-floor fire while it was under construction. That 2002 fire was on the 29th floor and the standpipe only went up to the 23rd floor.

Who the ffccuk was the safety officer for the site?
Why was there propane tanks up there, and if they were needed, why weren't they stored on the floor that had 'standpipe' protection.
The more you read the more I see red flags. Where was the site security officer?

JERSEY CITY (CBS) ― Firefighters are still battling wind that's stirring up hot pockets around a New Jersey high-rise.

Intense flames shoot into the sky as firefighters worked for hours trying to get this four alarm blaze under control. Firefighters were forced several times to pull back and fight the fire from the ground floor.

Several blocks around the building are closed off as officials continue to worry about the building collapsing. At least two floors collapsed before midnight inside the building as nearby residents watched the scene unfold, unable to return home.

"It looks serious, very serious, I mean as long as no one's hurt that's okay," Andrea Leonardelli said.

With the building's standpipe only activated up to the 14th floor, reaching some of the higher floors has become difficult.

Sparks came raining down, debris hit the sidewalks, even propane tanks exploded from inside the building at 77 Hudson Street which is under construction, an apartment and condo high rise slated to be open in the summer of 2009.

The fire began in an elevator well between the 17th and 18th floors.

"It seems like it's all kind of pieces were coming down," Jeff Diones said.

Up to 100 residents were not allowed back into their homes as firefighers worked to get the fire contained.

The scene is sure to be a headache for the morning commute, although the Hudson-Bergen light rail, PATH and buses are running, commuters are asking to go to Liberty State Park or the bus at Montogomery Street to get in and out of the area for now.

Most of the residents are with friends and family, some have been put up by Red Cross as they wait to find out when they will be allowed to return home.

Didn't Healy and Mr. Potato-head just open an Emergency Center to deal with 'EMERGENCIES'?

This fire shows that the emergency center is struggling to help coordinate or put out a fire and the JCFD most likely can't control an emergency above a certain height...Lets just spend money on emergency personnel and not invest in obviously required resources and appliances.

We need to have 'mutual aid' agreements with other local governments to help with these emergencies - this is basic 101 volunteer firefighting info, I learnt as a teenager.

I'd hate to think what might happen if there was a malfunction with a buildings sprinker system in an OCCUPIED building.

(Jersey City - WABC, October 9, 2007) - Jersey City police are imposing a frozen zone this morning around the scene of a high-rise fire that burned through the night.

Eyewitness News reporter Kemberly Richardson is live in Jersey City.

The frozen zone is still in place this morning because firefighters are still on the scene, putting water on the hotspots on the upper floors. Because it's pretty windy this morning, the flames are being fanned.

It was a much different story last night as the fire broke out just before 9:00 p.m., between the 17th and 18th floors of the high-rise located at 77 Hudson Street.

The building is under construction and played a major role in getting to the upper floors. Initially, crews tried to fight the flames from the inside but had to pull out, because those floors were not stable -- made up only of wet concrete and wooden two-by-fours.

They boarded the top tow floors within the last two days, and it takes really 21 days for concrete to cure. So, in this time frame, it would not be safe to have firefighters in there unless the floor is set and solid...It was a decision the chief made and obviously, it was a rational decision to make....,"

Crews were forced to fight the fire from the outside. However, the ladder trucks can only go up to about 10 stories. And there's also been talk about the building's standpipe (its source of water). It is said to only go up to 14 floors, but officials say that's not a violation.
