This is not in the realm of the city. For a resale, the city will only issue a smoke detector certification, not a CO. But that's only for a 3-family or less. For 4-families and above, the state must issue the green card and it's up to the seller to provide it. Throw this back to the sellers and their attorney.

Get an new lawyer. This is what they're supposed to know or find out for you, not shrug. Too many lawyers think of RE closings as easy money that takes no work.

We are under contract to purchase a multi family property but just found out that its green card expired in 2010. Our lender and lawyer are unsure whether we can get get clean title without it.
The lender's lawyers said that as long as Jersey City does not require the green card for the CO that we can close without it and apply for it post-closing. However if Jersey City will not issue the CO without the green card then we have problems. We are checking the status of the CO with the building department (supposedly it has one) but curious if anyone here knows anything about this. Thanks.
