Major donor to Jersey City animal shelter's operator is weighing continued support if it abandons unofficial "no kill" policy

Following the abrupt firing of Liberty Humane Society's executive director, a major donor said Wednesday she wasn't sure she would continue to fund the Jersey City animal shelter if it moves away from a "no-kill" policy.

"I would be very wary of putting money toward a facility that's not moving towards 'no-kill,'" said Wendy Neu, who with her husband John donates "several hundred thousand dollars" to the shelter each year.

But Neu added: "It's something that's very close to our hearts and we want to see it be a success. It's not an easy decision."

The shelter has a budget of roughly $1 million a year, said Diana Jeffrey, a past board president who is serving as an interim board member.

The interim board fired Joanna Hopkinson as director of the shelter Tuesday night.

The action came nearly a week after the former five-member board resigned, claiming Hopkinson's "no-kill" policy was leading the shelter into bankruptcy and causing severe overcrowding at the shelter, points the interim board agreed with.

Hopkinson's salary - which is "in the 70s," according to interim board members - is paid from a dedicated grant from the Neus.

Hopkinson did not return phone calls for comment.

Jeffrey said yesterday Hopkinson was fired because the shelter needs to start over. "There's so much bad blood and there's so much negativity, we need to start fresh," she said.

Asked if the shelter would risk not receiving funding from the Neus by moving away from Hopkinson's "no-kill" policy, Jeffrey said the shelter isn't in the financial position to forego the option of euthanizing animals that aren't adopted.

"We're going to have a hard look at what we can reasonably do based on our resources," Jeffrey said. "If the community wants it to be a 'no-kill' shelter then they have to step up and give us the resources to support that."

Shelter reform is a huge task. LHS a year ago was deceiving the public and its volunteers by saying they never killed an animal for space. Shelter managment at that time was doing it secretly. It was a "don't ask, dont't tell" situation.

Well that management and board were kicked out a year ago. New board and mgt installed. Though the new board and mgt succeeded in achieving a balanced budget it became apparent that the board was not really animal friendly and did not share the lifesaving vision of mgt.

Mgt put all efforts into lifesaving while the board refused to fundraise and add members to the board.

How can a board president assume presidency and declare he will not be raising money for the organization? How can a 5 member board after one year not be adding any new members that will bring donors to the organization.

In the end the board created a hostile working environment based on personal feelings and dummied up mismanagement charges.

And why did a fed up development director resign?

After an audit of the finances, no mismanagement has been discovered.

The public resignation of the board and the firing of the ED has done more harm to LHS than anything any mgt could have done.

That donor that the board so much did not want in the picture is pulling its funding. LHS is on its own.

Agree. Not only do people throw their garbage on and around my property, the wind blows the whole block's worth of crap to my property. It is sickening.

I think it would be fairly simple for our wondeful government to create a public awareness campaign about the problem and why it is not acceptable.

OFFICERS IN TROUBLE ? An attorney is suing the state to revoke the animal control officer certifications of several Hudson County-based officers, including Hector Carbajales (seen in a 2008 photo).

Animal advocate and attorney Diana Jeffrey has filed two lawsuits against the state?s Department of Health and Senior Services to revoke the certification of several animal control officers in Jersey City.

One lawsuit, filed in state Appellate Court on Dec. 29, seeks to revoke the certification of Jersey City?s lead animal control officer, Joe Frank, and his colleague, Emmanuel Machado, alleging that both incorrectly seized a woman?s dog back in 2005, and then allegedly tried to cover up the seizure. Frank declined to comment when reached last week.

A second lawsuit filed the same day in the same court calls for the revocation of Hector Carbajales? animal control officer certification. Carbajales is the former manager of the Hudson County?s Society for the Prevention of Cruelty of Animals (SPCA) shelter in Jersey City, which was shut down in April of 2008. Then, the rotting carcasses of animals were found inside a freezer in June 2008. The lawsuit cites Carbajales? guilty plea in May 2009 in Jersey City Municipal Court to charges relating to the discovery of the carcasses, believed to be animals he picked up while providing animal control services for the towns of Union City and North Bergen.

Carbajales still has a license to perform animal control work, and has done so in other towns, although he does not work in Jersey City. Now, the city?s stray animals are brought by city workers to the Liberty Humane Society Shelter, a facility founded by volunteers.

Carbajales could not be reached by telephone for comment last week about whether he still works as an animal control officer anywhere.

With the two lawsuits, Jeffrey is trying to compel the DHSS to follow a decision set down by the state?s Appellate Division in June 2008 that the DHSS has the authority to revoke the certifications of animal control officers when their conduct ?poses a significant threat to the public health and safety.?

Jeffrey said she has made several requests to the state to remove the three officials? certifications, but the state has not gone through with the revocations.

But she is confident that these lawsuits will get the decertification to take place.

?The department has a responsibility to police animal control officers,? said Jeffrey, a former board member of the Liberty Humane Society with a law practice in Bloomfield.

A DHSS spokesperson said on Wednesday that the department is aware of Jeffrey?s lawsuits but could not comment since it is ongoing litigation.

Officers out of control

The incident spurring the first lawsuit occurred in a Jersey City home on Dec. 21, 2005.

On that day, according to an independent August 2006 investigation by the Liberty Humane Society, Jersey City Animal Control Officer Joe Frank dispatched three animal control officers to remove a dog belonging to a tenant living in a home on Winfield Avenue in Jersey City?s Greenville section. Frank allegedly did this at the request of the landlord, who was a friend of his wife, according to the investigation. The landlord had previously gone to court to have the tenant?s dog removed but was unsuccessful, according to the investigation.

(It should be noted that the Liberty Humane Society is now under consideration to take over more animal control services for Jersey City, so they might stand to gain if the current animal control employees lost power.)

When the officers arrived at the location, they found the dog inside a locked basement apartment, and the dog?s owner not home. When two of the officers refused to remove the dog because they did not have a court order for removal, the third officer, Emmanuel Machado, allegedly entered the apartment and removed the dog by force, according to the investigation.

Machado then took the dog to the Liberty Humane Society?s shelter near Liberty State Park and registered the dog as a ?stray,? according to the investigation.

Machado later called a friend who knew the dog?s owner and passed along information. But Machado then issued the summonses according to the investigation.

In May 2006, a judge in the Fort Lee Municipal Court threw out the summonses after being provided information on how the dog was seized by Machado.

The Liberty Humane Society said the dog could have been euthanized if it had not been reclaimed within seven days as per state law. The investigation report was submitted to the DHSS by the LHS to prompt them to revoke Frank and Machado?s certification. But there has been no response then or now, Jeffrey said.

Machado could not be reached for comment last week.

+1 for posting the video. I think the council heard the message loud and clear. It is time to lay off non essential workers like my corporation did for the last 16 months. Well over 20,000 employees.

There is way too much waste in our city government. Furloughs don't do it. For any city workers who spend 3 hours working and the rest of the day surfing the internet you have to go. You know who you are too.

From what I understand Sava was near the Courthouses on Newark originally. The lease was getting too expensive and the owner was forced to relocate.

The new location does not have the great foot traffic of the previous location so it would be great if everyone would help keep a Mom and Pop in business by referring and recommending as they have in this thread.

Don't forget - the media will be photographing and videotaping so a sign that is easy, with large letters, to read like RESIGN NOW will show well in photos and on TV.

This is all about getting the media involved in the process.

It would be impactful if all outraged JC residents showed up at the City Council meeting on Wed to support Fulop in introducing these resolutions.


Meeting is at City Hall at 10am (summer hours). You can call the City Clerk the day before to have your name placed on the speakers list. Time and place to vent is there.

Better yet if all outraged JC citizens showed up at the council meeting next Wed to voice their outrage and to support Fulop's recommendation that Vega resign.

Meeting is at City Hall at 10am (summer hours). To speak you must contact the City Clerk the day before to have your name placed on the list.

This is better that the stimulas package. I pray they lose their jobs, their homes, their pensions, their husband, their wife and anything else they hold sacred. They make me sick.

Especially Vega. You are nothing but an arrogant POS. Go to jail.
