What You Should Know About
Getting Towed

The amended Predatory Towing Prevention Act
became effective in New Jersey on April 15, 2009. The
amended Act regulates tows from private property, and
tows initiated by law enforcement, without the prior
consent of the vehicle?s owner or operator.

TOWING FROM PRIVATE PROPERTY
Unattended cars cannot be towed from private parking
lots, unless:
There is a sign posted at vehicular entrances to the property stating
1) The purposes for which parking is authorized;
2) The times when parking is permitted;
3) That unauthorized parking is prohibited and
unauthorized vehicles will be towed at the owner?s
expense;
4) The name of, and contact information for, the
towing company and the address of the storage
facility?which must be secure and located within a
reasonable distance of the property?to which the
vehicle will be towed;
5) The charges for towing and storage and the times
during which the vehicle may be redeemed; and
6) Contact information for the Division of Consumer
Affairs (1-800-242-5846, prompt #4.)
■ The property owner and the towing company have a
contract for the towing the property owner has authorized the towing company to remove the
particular vehicle.

■ The requirements do not apply to a single-family home
or an owner-occupied multi-unit structure, and the
signage requirements are different for a residential
community with clearly-marked assigned spaces
for residents.

TOWING AND STORAGE CHARGES
The towing company?s fees must be reasonable.
A reasonable fee is considered one that is no more than
25% greater than the company?s fee for the same
consensual (vehicle owner approved) towing services or no
more than 50% above the fees charged by other towing
companies in the community for the same towing services
without the vehicle owner?s permission.
Towing and storage charges cannot exceed rates set by town
ordinance.

VEHICLE STORAGE
The Act requires that after a vehicle is towed:
■ The vehicle must be stored in a secure facility;
■ The facility?s business office must be open to the
public between 8 a.m. and 6 p.m. at least five days
a week; and
■ A towing company must make reasonable
accommodation for after-hours release of stored
vehicles. The towing company may charge for
after-hours release.

UNLAWFUL PRACTICES FOR TOWING COMPANIES
The Act prohibits towing companies from the following:
■ Failing to release a vehicle hooked or lifted, but not
actually removed from private property, upon request
of the vehicle?s owner;
■ Trolling (cruising) for vehicles parked without authorization;
■ Paying for information about vehicles parked without
authorization;
Refusing to accept an insurance company check or a
debit card, charge card, credit card or check for towing
or storage services, if the towing company ordinarily
accepts such payment at its place of business;

■ Charging for a towing or storage service not on the
Division?s schedule of services;
■ Charging an unreasonable or excessive fee.

Two faults of Jersey City drivers that are clearly spelled out in the drivers manual:

I was crossing Washington Blvd in a crosswalk towards a cop on the opposite corner and a car flew in front of me at 30 mph making a right on red without even slowing down...the cop didn't bat an eye although the car went 90 degrees around him while he was looking at it, almost dusting me off.

The driver of a vehicle must stop and stay stopped for a pedestrian crossing the roadway within any marked crosswalk, but shall yield the right-of-way to a pedestrian crossing the roadway within an unmarked crosswalk at an intersection, except at crosswalks when the movement of traffic is being regulated by police officers or traffic control signals, or where otherwise prohibited by municipal, county, or State regulation, and except where a pedestrian tunnel or overhead pedestrian crossing has been provided, but no pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield.

So if you are crossing against the light you do not have the right of way, it is called jaywalking and is expressly against the law.


PEDESTRIANS MUST obey pedestrian signals and use crosswalks at signalized intersections. Both carry a $54.00 fine for failure to observe the law.

The funds were to provide for a officers to work on a dedicated enforcement program, so overtime is involved, either for them or those who are covering their regular tours.

I don't know about Hudson, but at Prep non students may not compete. Prep does invite alumni back for Black Flag Day, a kind of hell day for the team just before the season opens. During the off season they have open mat days and some recent alumni may participate in that but no coaches.

Was born in the Margaret Hague and grew up one of 4 boys on Concord and Fleet St in a house my great-grandparents bought in 1917. St. Joe's, Prep, SHU then SPC. Lived in Greenville and Country Village, then bought by Lincoln Park. 3 kids, 1 going to college, 1 in St. Doms and 1 in Prep. Work in Manhattan, so it has always been an easy commute.

Teacher-bashing is a pretty popular sport these days and some of the criticism is warranted. But make no mistake, the issue of raises is just a distraction. One has to strike a balance and shouldn't be too cozy with the NJEA, but a virulently anti-teacher politician should not be running the school system.

That's one reason why I support Sterling Waterman and Carol Lester. They will do the right things on the REAL issues like cutting administrative bloat: the principal driver of costs in the $600 million budget. I haven't heard Gerry McCann say a word about that. Wonder why?



I am not teacher bashing, I am union bashing, 2 different things. My understanding is that Sterling Waterman has been endorsed by the union. Sorry, but that puts my voting for him out of the question. When I hear that someone comes from a "family of teachers" I worry also. I come from a family of teachers. They will all tell you they were never overworked. Some were underpaid, most were under appreciated, but made up for some of that with great benefits and a lot of time off. But that was a long time ago(8 years since the last retired in JC). Now even they believe that salaries are pretty good and benefits are still excellent, and there is still a lot of time off. Even back then the staffing was bloated, lazy and unproductive, and that has just gotten worse. Something has to give. Abated properties pay nothing to the schools, so any increase in tax is put squarely on the backs of property owners who are already choking on city tax raises.
Give me the guy who everybody hates, but who is trying to keep taxes down. If it takes a sc#&bag to get it started, then so be it.

I am a lifelong JC resident and I personally cannot stand McCann, at his best he is a jacka**. However, he voted against the new teachers contract that gave unaffordable raises of over 4% per year for 3 years to the union. He also voted against the budget, given that we will be getting less state aid next year. Dehere voted the same way. Patel has indicated she supports renegotiating the contract and cutting costs at headquarters. So as much as I can't stand Jerry on a personal level, I will hold my nose and vote for him. Otherwise the School Board will become a part of the JCEA.

A lot of people tonight, now we have to keep up the pressure.

This tax increase is nothing compared to what can happen with the school budget of 600 million bucks. The city only pays about 20% of that. What will happen going forward? Do get out and vote in the school board election, because unless you live in an abated building there could be a world of tax hurt coming all our way.

Two Jersey City men were both shot in the head this morning at the corner of Woodlawn Avenue and Corcoran Street in what police believe to be a gang-related execution.

At around 4 a.m., cops found Lester "Bleek" Thompson and Mileak Richardson sprawled on the sidewalk face down, Hudson County Prosecutor Edward DeFazio said.T


While it is sad that 2 young lives were cut short, I will reserve my sympathies for the innocent victims of gang violence.

The Society Hill bus runs to JSQ I think. So if you are taking the PATH train it is easier. You can take the Montgomery Westside bus to Grove or the #80. The 80 takes the long way, through JSQ and down Newark Ave.

Why? Because the private citizen is in no position to return the favor through political influence. Which is why the ethical standards expected of public officials are higher. Or at least should be. That crucial distinction used to be well understood. I?m not so sure it is now.

The Sugar House wouldn't be empty, the apatments would have sold for a lower price. Of course the building also would have sold for less before it was renovated. Also, what will happen to the prices in 15 or so years when the abatement ends and the taxes more than double? The abatement has artificially inflated the selling price of the condo, enriching the developer, giving a break to the owner for a set number of years, but I wouldn't want to be an owner when the bill comes due.

When I bought my home the market price was very close to the assessed value. While the value of the home has gone up, it is not by a factor of 4, given current value my payment is a shade under 3% of the actual resale value. The article estimates the taxes would be about 3% of the value of the condos, so the owners are getting a tax break of more than 50%. 5% goes to the county, 95% to the city, bupkus to the school district. Taxes go up in the city, county and school district? No problem for the abated properties, those payments remain the same. Not just to single out the Sugar House, but for the last 15+ years it is a great deal for the developers and the owners, not such a great deal for anyone else.

I don't begrudge it for people who bought or built in the late seventies through 1990 or so, but it hasn't been NEEDED since then on the waterfront. It would have been built up no matter at that point. It just became expected by the developers and was built into the land prices. I don't begrudge it for developers of some other areas of the city, as i said it can be a useful tool. But any tool can become dangerous in the wrong hands.

The average Sugar House condo tax bill for 2007 was $10,700. Assuming the average unit was valued at $800,000 (the median should be close to the average), then the typical Sugar House condo owner is paying about 1.3% in property taxes to Jersey City. Is that really "a fraction" of what their neighbors are paying?

Without the abatement, this analysis states that the typical bill would have increased to $25,000, or 3%, annually. Do you know what you would have in place of condos without an abatement for the Sugar House? An empty sugar refining warehouse.

From what I understand, the way tax abatements work is the owner pays a reduced tax rate to the municipality. The original abatement law had all of the payments going direct to city coffers, cutting out the school district and county. After many complaints, centered around Jersey City?s overuse of abatements, which put a heavier county burden on surrounding towns, the law was changed to give the county a portion of the abated rate. It is lower then they would have gotten with regular property tax but better than zero. The school district is still cut out. This worked for the city in a few ways, there were up front payments, and at least in the beginning, the city would usually see more revenue then if they taxed the property at the normal rate. Most of the abated properties also have protections built in, so PILOTS don?t go up or go up in predictable increments.
As for the Sugar house, if they had not received abatements there would still be condos there, abet with cheaper amenities and the developer would have made a few million less.

I am a homeowner in one of the ?ghetto? areas of JC. I pay approximately 6% of the $132,000 rated value of my home in city, county and school taxes. So paying 1.3% of the value of a new construction ?luxury ? condo is extremely out of line with what the average homeowner in the city is paying, and it is being done on the backs of the people living in just about every area of JC except the waterfront.

Abatements have their place and can be an important tool for a city to use. But they should be a tool for those who are willing to gamble on an area that needs development and where the builder is taking a risk beyond a systemic economic risk. There has been no need for abatements in downtown for almost 20 years. It is however a cash cow for politicians running for office, and keeps wealthier new residents from paying too much attention to corruption, waste and the uselessness of the school system. Bump those taxes up a 2 or 3 thousand dollars a month and suddenly you might have a whole new group of people looking to clean up the city, with the resources to make life very uncomfortable for our entrenched political class.

This isn't true... The Federal Reserve was created via the Federal Reserve Act (circa 1913 and amended a few times since) and its chairman is appointed by the president and confirmed by congress.

Whether they have too much power is another issue, but they are certainly not private - perhaps by private you meant they are unelected, which is certainly true.



The Fed is a hybrid. It has a presidentially appointed Board of Governors of the Federal Reserve System, The FOMC and 12 regional privately-owned, Federal Reserve Banks

I drive through downtown at least once a day, and people darting out from the middle of the block and between cars and against lights is a constant concern as a driver. I am one of those funny drivers who actually stops when I see someone step into the crosswalk, but even I have had close calls with pedestrians who refuse to obey walk/don't walk signs, traffic signals and common sense. There is a large percentage of stupid drivers, especially the idiot who swung around me at Montgomery and Warren at about 40 mphs when I stopped to let someone in the crosswalk go last week, but there a also a large number of stupid walkers who need to realize that getting hit with a 2000 lb metal box going 25 hurts..a lot. One thing to remember if you insist on crossing against a light, when a car is making a legal right on red, the driver is looking to his left to make sure it is safe to go, so when you cross against the light you are putting yourself in his path as he starts to accelerate, when he is making a right with the light he is, or should be, looking to his right for pedestrians.

My question then would be, why is the traffic light at the intersection of Kennedy Blvd and Sip Ave in a black housing? Perhaps they should shut that on off until they replace it with a yellow housing and see how it works out.
