Correct, there are subsidies for farmers markets, not for regular markets. We've never had legal farmers markets, only regular markets. This is new legislation to create a new designation of farmers markets. People can choose to be a farmers markets or continue as regular market.

Yes, the market was told if they wanted to receive the brand new designation of farmers market they would need to comply with the legislation (which does have a requirement about the amount of prepared foods that can be sold at the market as well as other things.) Many people have told them that. In past years, they have operated without a farmers market designation and they can continue to do so if they want, no problem whatsoever. It is a decision of the downtown SID (who runs the market) if they want to be a farmers market or just a regular market.

The market has always ended in December, so I don't think that's anything strange.

There is no change. The existing market can continue to operate April - December like they always have. It is just up to them if they want to change to become a designated farmers market.

In terms of tickets, that is likely true because there are existing laws on the books that say food trucks (operating outside of a specific market/festival/etc) cannot be within 300 feet of a business. It is sporadically enforced. That existing legislation is confusing and poor and needs to be changed. We have been discussing with food truck operators solutions that make more sense.

There's already a model in place for parking on Columbus - why not just extend that to food trucks - have them pay $200/month or so for parking. In fact Columbus just south of Marin hits most of the criteria and it's a short move from Grove plaza.


Pretty much in alignment with my thoughts. Not sure it should be purchased monthly versus daily or block of hours and some other operational things like that, but in terms of high level approach I agree.

Like you say, I'm sure the food trucks would want to pay a tax in the form of parking so they can set up shop at the Plaza instead of being issued (or threatened with) $2,000 tickets. But their banning is a recent occurrence. Shouldn't they be allowed to continue what they were doing until the City can come up with an acceptable arrangement? The recent change has the listed restaurant owners' fingerprints all over it, and the whole situation is very unfortunate.


So you nailed why it is important for us to clean up the food truck regulation. Markets can have food trucks, farmers markets can have food trucks (though less due to the limit on prepared foods.) It is really the day to day regulation that is a mess. Reasons why current legislation is a mess:

1 - Language in current legislation is unclear. Food trucks must be x feet away from nearest brick and mortar restaurant (I think 300.) Is that radius or walking distance? Police don't feel like there is a clear answer there.

2 - Legislation doesn't solve the problem of where food trucks CAN park in a way that at all helps the entreprenuers who start them. Food truck operators feel like they never know when/where they will get a ticket and they have to move the food truck every 2 hours.

3 - Legislation doesn't solve the problem of the fact that the food truck operators are getting a free ride by way of using city land (parking space) for commercial purpose without paying the equivalent of a rent for that space. Brick and mortar feel like they are operating on an un-level playing field as they have to pay rents which roll up to include both land use as well as property tax and the food truck operators do not.

So, the current legislation works for basically ZERO of the stakeholders and that's why things like this happen. We need to as a city determine: where exactly we want to allow food trucks and come up with a way to charge for the commercial use of public space. This shouldn't be hard, we just need to do it.

Thank you for your response here, I appreciate it and I'm sure others do too. Question about point #3. Are you saying that the SID, in order to receive city subsidies, made this decision on their own, and the letter from the various restaurants had no effect on their decision?


I am not sure...I know that I had complaints from both sides of the fence and my point to them was as follows:

1 - The city should support creation of good legislation that reflects what we believe a true farmers market should be city wide, versus supporting the one off issues that exist within one particular market.

2 - That if the SID (or any other market) didn't like what the city believed to be good legislation, they could continue to operate just as they are today, but without the benefits of being designated a farmers market.

3 - That if the SID chose to operate as they did today, and certain members of the SID didn't like that, they should run at the next SID election and change it. The SID is a legal entity with an elected board who governs how the markets are run within the SID.

Whether or not those parties successfully persuaded the SID one way or the other, I will let the SID speak to that (I don't know.) I am saying that there is a legal structure that will allow for either approach.

We do also need to deal with Food Trucks in some way. The current legislation surrounding them is poor. I think that brick and mortar restaurants have a completely legitimate point in that the trucks essentially have free use of a city asset (streets) whereas brick and mortar pay rent (which is used to: profit to property owner, pay down of any property owner mortgage debt, pay yearly property taxes AND pay yearly SID taxes.) Most food truck owners want us to resolve this legislation and I believe are more than willing to pay a tax (maybe in the form of commercial parking) in order to have more clear laws about where they can park/not park, etc.

Sorry should have been more explicit there. The Mayors executive order around tax abatements, which skews abatements away from the waterfront and torwards the rest of the city. The map (which is supposed to be reviewed and adjusted every 2 years) is essentially 5 years along waterfront, 10 years the rest of downtown, 20 years most other areas in the city and a few 30 year spots. The dividing line for downtown is Marin and Grand. So Liberty harbor north, Paulus hook, Powerhouse arts and Newport are 5 year zones (the same abatement anyone is eligible for) and the rest is 10 year. The only way a developer would be eligible to get a higher abatement is if they "buy up" with a giveback. One example of a giveback that's listed that will allow for a higher abatement amount is building a public school space in the building.

So, according to the abatement executive order, this is eligible for 10 years. Unless they build a school it would not be eligible for a higher abatement. Per the admin, the yearly revenue from that abatement would be $1.2 MM to city.

I think you may be mixing situations. The parking lot where teachers used to park at Bright and Varick was voted on by city council in 2011, well before I was on city council. Also, it is not part of my ward since it is west of Jersey Ave.

That is not 28 Bright though. 28 Bright IS in my ward. I know that there was something that was in Van Vorst Park that came for a vote in front of the JCRA in December but not in front of city council (I am going to assume it was 28 Bright.) The council president, who sits on the board of the JCRA, notified the neighborhood association in advance of that meeting.

So we are working on making this public (it was part of my platform.). I am also very enthusiastic about open data. I've been working with a couple of residents who founded OpenJC and they've already taken a sample data file from the police and uploaded it to an open data set.

We had to strip out things related to minors and sexual assault related items.

Obviously we need to codify this and make sure the proper security measures are in place to make sure no PII is uploaded, but when we do then the complete the raw data will be there for anyone to build whatever apps or analysis they want to.

If anyone is interested in this let me know and I'll connect you to the right people.

Agreed on all points.

1) The feedback on implementation has been given to Traffic & Engineering.

2) The yellow side signs are worthless and I requested the ones like Hoboken has for 80 intersections (City Council funded it via resolution reappropriating unused bond funds back in September.) The reason some other streets have it is that the actual buildings have put them out themselves. Jersey Avenue is one of the streets I requested these signs to go.

3) I will let the police department know as well.

The 1st and Jersey was a last minute miscommunication (it wasn't on the original plan to get a stop sign and then I misunderstood some feedback I got from the neighborhood association and added it in.) It will be removed.

Regarding the lack of painting and 3-way, 4-way signs, I will communicate that to traffic & engineering.

Here is a link to the recommendations. These recommendations will be vetted with the traffic and engineering departments next week. It surely is not perfect, but I wanted to start somewhere.

We will measure the results, we won't just place things out there and hope for the best. As a part of phase 2 analysis, we will look at those results and the community feedback and do a "start/stop/continue".

No conspiracy. That was me.

I donated the original soccer website for the JCCSA. Someone built a newer, better one and was supposed to forward the domain. Shelley needed a "quick and dirty" website for her new role and I was trying to help her out one day and threw one up there for her to take a look at. I told her she could forward her domain there until she got something better. She ended up getting a website set-up and never used it. I neglected to take it down and the hosting was set to expire so I figured it didn't matter. I also didn't think it would show to public since the old domain was supposed to be forwarded. I will take it down. Thanks!

Now, I can't begin to sing the praises of the new JC medical center. About four years ago they saved my life. I went two years misdiagnosed by four different doctors and the day that may have been my last, they found out what was wrong called in a specialist and I had emergency surgery that night.

I'm not sure if I would say this is the best place for children, since I have no first hand knowledge. I'm a big fan of Bristol-Myers Squibb Children's Hospital at Robert Wood Johnson University Hospital many friends with children have been there and had very good experiences.


+1. What a huge difference a good leader makes. The new CEO has done a fantastic job at turning that place around. My experience in 2006 versus 2011 was like night and day.
