If you're already married, you missed the boat on the free name change which you can do when you're getting your marriage license. You must do a name change as a legal process. You can do it yourself.

Think long and hard about the name change. You have to change your names on EVERYTHING with EVERY ENTITY you do legal business with (credit cards, banks, passport agencies, social security, professional licenses, DMV (oh so much fun), mortgages, leases, wills, estates, trusts, advanced directives, credit reporting agencies etc.). And when you renew items at the DMV, you have to have proof of your name change EVERY TIME you visit. Be also prepared to explain the new name change which occurred after marriage. It's a major pain.



Keep that legal name change document in a very safe and accessible place. You will need it a lot.

How do I change my name?

You may apply to the court at any time for a court order to change your name. In considering a request for a name change, the main concern of the court is that you are not asking to change your name in order to commit fraud or avoid the consequences of a pending legal action. Although most requests for name changes are granted without question, you should explain in your application why you want to change your name.

To get a court order giving you permission to change your name, you must file a complaint for name change in the Law Division of the Superior Court. To begin the process of having the court consider your case, you must give the court clerk the necessary forms and a filing fee of $200. If you cannot afford the filing fee, you may apply to the court to be allowed to file without the fee.

The documents that you must file are:

?Civil Case Information Statement. This summarizes your case for the court.

?Verified Complaint for Name Change and Certification. The complaint tells the court what your name is, what name you want to change it to, why you want it changed, and whether or not you have ever been convicted of a crime or have criminal charges pending against you. In the certification attached to the complaint, you certify or swear that all information in the complaint is true to the best of your knowledge. It is important to include only accurate, truthful information in any documents that you file with the court. If you knowingly misrepresent a fact to the court, you may be charged with a crime of the fourth degree.

?Order Fixing Date of Hearing. You leave this document partially blank when you file it with the clerk. A judge then reviews it, completes it, and sends it back to you with directions to come back to court to have your case heard on a date that is 30 days or more from the date that the judge signs the order. The judge will also direct in the order that you publish notice of this hearing date in a specific newspaper.

Try a local lot or gas station (they might negotiate an overnight stay rate). Good luck.

Out of status individuals are subject to the draft. So if you're here "illegally" and you're 18 years old, you are required to register with Selective Services. Perhaps one provision of the bill should be proof of registration in the SSS at the age of 18 as an indication of their good faith effort to move toward citizenship (as lopsided as that sounds as SSS is for males only, at this time):

Non-citizens who are not required to register with Selective Service include men who are in the U.S. on student or visitor visas, and men who are part of a diplomatic or trade mission and their families. I'm not a cop, so I'm not seeing this issue from their perspective. If there's a solid reason for safety that I'm missing for cops being posted to construction sites, I've yet to understand it and I'd like to learn. Like others, I've witnessed a lot of standing around by officers (again, tell me why so I can understand if this is a good thing.)

If it's an issue of traffic safety, I'm not sure crossing guards are the answer here. It seems we'd have to hire more guards to cover the amount of construction that's going on in the city. Would they require additional training to safely do this job? Also, as another stated, would guards be pulled off their regular posts to handle jobs? Parents/kids appreciate the familiar face of their guards on their regular posts.

Two suggestions - I think larger construction companies should be required to provide their own recognizable traffic detail. Make it part of the permit process if need be.

Or, perhaps this job could be worked into part of the re-entry program that McGreevy is working on. Put our money where our mouths are. Train local folks who are looking for jobs a marketable skill. Create a pool of reliable, local men/women; have them instructed by the police department (helps build bridges); and give them work that may put them back on the right track.

When Superstorm Sandy hit last year, we lost all our food in the kitchen with the power outage, along with the whole of our inventory stored in the basement refrigerators and freezers and store cupboards due to the flooding. Although we have tried very hard for the last 11 months to get back on our feet, unfortunately we have not managed to do so.

I heard an interesting interview this weekend where the former director of Medicaid thought the federal ACA website could not be repaired any time soon - certainly not in time for the Jan 1 launch of benefits. He had some serious concerns about the security issues connected with the site as well. At the close of the interview, he believed that the entire system would need to be scrapped and started over again.

Here's some interesting info to keep in mind as well:

It?s been widely reported that the uninsured have until March 31 to buy coverage in the insurance marketplaces under the Affordable Care Act.

While it?s true the marketplace?s open enrollment lasts that long, those who intend to shop for insurance probably won?t want to wait. Bloomberg reports that people who buy coverage in March will end up paying a penalty.

Plans purchased between March 1 and March 15 wouldn?t take effect until April and coverage bought in the final days of March wouldn?t kick in until May. The Patient Protection and Affordable Care Act of 2010 requires most Americans have an active health insurance policy by March 31 or pay the higher of 1 percent of their annual income or $95.

Under the Affordable Care Act, starting Jan. 1, people who have access to affordable coverage and instead remain uninsured for more than three consecutive months will owe the ?individual responsibility? tax payment for those months, a Department of Health and Human Services spokeswoman told BNA in an e-mail.

Much also has been reported about high deductibles some marketplace plans include. Bloomberg reports that some people might not understand the significance of high deductibles until they seek health care.

When Barbara Retkowski went to a Cape Coral, Florida, health clinic in August to treat a blood condition, she figured the center would bill her insurance company. Instead, it demanded payment upfront.

Earlier in the year, another clinic insisted she pay her entire remaining insurance deductible for the year ? more than $1,000 ? before the doctor would even see her.

?I was surprised and frustrated,? Retkowski, a 59-year-old retiree, said in an interview. ?I had to pull money out of my savings.?

The practice of upfront payment for non-emergency care has been spreading in the U.S. as deductibles rise. Now, the advent of the Patient Protection and Affordable Care Act is likely to accelerate that trend.

Many of the plans offered through the law?s insurance exchanges have low initial premiums to attract customers, while carrying significant deductibles and other out-of-pocket cost sharing. The second-lowest tier of Obamacare plans in California, for example, carries a $2,000 annual deductible.

Hospitals say they need to charge patients prior to treatment because Americans are increasingly on the hook for more of their own medical costs. And once care is provided, it?s often difficult for hospitals to collect.

?It used to be taboo to look like you were looking for money at a time when you were supposed to be focused on patient care,? David Williams, president of Boston-based consulting firm Health Business Group, said. ?It?s not taboo anymore.?

If you're tied to Jersey City and you're on a budget (and you don't have kids), I also recommend the Heights area. Get used to some pesky, quality of life issues like broken car mirrors, stolen pumpkins, litter, graffiti, ripped off bikes, etc. If you can see past that, you'll do okay for the long term.

It's a good solid area to support a couple, transportation is close by, and you can walk to shops and the parks.

Watch out for craigslist ads. I've noticed a real turn in their offerings with a lot of scams in the rental listings. You can spot them when they seem "too good to be true." It may be better to go through a realtor if you can swing the fee.

You might also want to take a look at Weekhawken, Union City and West New York. Take a walk on Blvd. East this weekend if you're around. You might be surprised at what you see!

nrgravey - not quite sure what you're talking about. My plan (and I'm nowhere near the pesky level) will cost my self-employed family a ton of money we don't have with a huge deductible to boot.

We self-paid our way each year for our medical costs prior to this debacle and did just fine. I don't see anyone paying my way nor did I ever ask them to.

I'll never begrudge any successful business person - just be sure you know "what" you're paying for and what the middle class disproportionally shoulders as well.

And if I did my research correctly, the group who is expected to pay into this plan to "make it work" are large numbers of healthy young people.

Some (not so smart) landlords bank on the fact that busy professionals will not be able to make it to court to litigate. Many folks are completely taken advantage of by landlords in this area and it's sickening to me.

The OP potentially has a very strong case, but it's important to get court-related evidence in order.

It is only a one-day court process to sue (other than the time to file your paperwork, which is relatively painless). You are asked to first mediate with your landlord (which is your choice) where you meet in a room and try to hammer out an agreement that suits both parties. You do not have to do this, but it is encouraged to lessen the court load. If you cannot agree, you go in front of the judge.

If the other party doesn't show up and doesn't alert the court, you will get a default judgment which you have to collect.

The only item in the court case that can be annoying is if the other party reschedules - which they can do within 24 of the case - but only one time.

The judges, in my experience, are very attentive and fair to tenant's needs. If you have the time, it would be extremely beneficial to go to court ahead of your court date and listen to cases as they're presented and learn what the judge looks for. It's very interesting and a great learning experience to boot. The first time in front of a judge can be intimidating - this is a great way to prepare.

That really isn't relevant to your case, so I wouldn't include it. This arrangement created no damages to you directly (being uncomfortable with a workman doesn't count).

Remember - stick to the facts and remain business like. Judges hate emotion in their courtrooms.

The fact that she took pictures of your dust is fantastic - this will help your case.

Does she have a current green card for her 3-family? She needs one - and if she doesn't have it - she's in serious violation of multi-family laws.

Your landlord CANNOT withhold money for standard wear and tear and cleaning, unless you or your tenants left the place looking like a disaster zone when you left.

It's really, really important to take photographs prior to leaving an apartment, and if you can, have the landlord sign a simple statement that a walk-through was completed and they're satisfied with the condition of the apartment.

That said, you can still take this landlord to small claims court and try to sue them for damages. Local judges listen to tenants concerns but you also must bring proof that you communicated with your landlord.

Here's what you do:

1. Send a certified letter to the landlord requesting the withheld security and rent paid during the hurricane. Make the letter bullet points and to-the-point. Do not get emotional (ie; you're a crook, pay me back), be business-like in your request. Include an itemized total (rent during the time the unit was uninhabitable, rent withheld for cleaning, etc). Ask for any response to you to be put in writing.

2. They will likely not respond - that's fine. Either way, you have proof to take to court with you. You can further get a certified statement from the current tenant that the apartment was clean when they moved in and they wanted the furniture to present in court.

3. Did your landlord notify you of where your security deposit was being held (in what local bank?) and how much interest it was accruing? If they didn't, they're in violation of the law. It's something to add to your complaint that makes the landlord look even worse.

4. Because your landlord withheld your security for bogus reasons, the law states that you're able to sue for up to 3x the amount of the security up to the limit in small claims court (I think it's $5,000).

5. In your complaint, you need to carefully word exactly what the landlord did and you need to specifically ask for damages.

In the guide, you need to view the parts about habitability and security deposits. That will help shed light on the Hurricane payments and the clean out fees.

Your landlord sounds like a shyster. I encourage you to take them to court and not let them intimidate you by telling you that you cannot win in court. You can - it just takes careful attention to gathering your evidence and presenting it in court.

Hi WhoElse,

Did your friend create a paper trail of communication with her landlord that outlines her habitability claim? She would have needed to notify the landlord (judges normally want to see written communication - easiest to prove) of the roach problem; the fact that your friend was paying for extermination with receipts (did the landlord refuse this?); the "last straw" letter - (I cannot live here anymore because of the roaches); and the clear communication she was breaking her lease because of the roach problem.

If she can prove that she repeatedly asked her landlord to solve the problem and the landlord refused, she may be able to win in court AND get her security back.

If she just threw up her hands and left the landlord in the lurch without communication, she's not going to win, unfortunately.

The landlord needs to be notified and needs to be given a chance to rectify the problem before the tenant self-terminates the lease.

I wouldn't give up on the security issue if the communication/paper trail was established. PM me and I can give you a bit more guidance as I've been in your friend's shoes, went to court, and prevailed.

Not sure if that's entirely true on the Marketplace setup - look:

"After open enrollment ends on March 31, 2014, they won't be able to get health coverage through the Marketplace until the next annual enrollment period, unless they have a qualifying life event.

A change in your life that can make you eligible for a Special Enrollment Period to enroll in health coverage. Examples of qualifying life events are moving to a new state, certain changes in your income, and changes in your family size (for example, if you marry, divorce, or have a baby)."

Now look further into the "pre-existing" clause of the law:

"Being sick doesn't keep you from getting coverage -

Starting in 2014, being sick won't keep you from getting health coverage. An insurance company can't turn you down or charge you more because of your condition.

Once you have insurance, the plan can't refuse to cover treatment for pre-existing conditions. Coverage for your pre-existing conditions begins immediately.

This is true even if you have been turned down or refused coverage due to a pre-existing condition in the past.

One exception: Grandfathered individual health insurance plans

The only exception is for grandfathered individual health insurance plans--the kind you buy yourself, not through an employer. They do not have to cover pre-existing conditions.

If you have one of these plans you can switch to a Marketplace plan during open enrollment and immediately get coverage for your pre-existing conditions."

The Super Bowl means big bucks for enterprising New Yorkers planning to hand off their homes to tourists for a handsome fee.

Pricey hotels in the metro area are already filling up despite increased rates, creating opportunities for rookies in the New York real estate game to call an all-out blitz on out-of-towners using sites like Craigslist, AirBnB and Couchsurfing.com

Take Chelsea resident Scott Atkinson, who is trying to rent out his two-bedroom apartment for a whopping $12,000 the week of the big game on Feb. 2 at MetLife Stadium.

Couple Erika Baldassaro and Scott Atkinson share a two bedroom apartment in Chelsea that they are renting for the Super Bowl.

If Atkinson finds any takers, he plans to take a surfing trip to Puerto Rico or maybe the hang-ten playground of Bali, in the South Pacific. ?And I?d still have plenty of money left over!? said Atkinson, who just posted an ad for his digs on Craigslist last week.

The way Atkinson sees it, he?s offering a bargain. ?You figure four or five guys staying at a hotel in midtown . . . they?d be paying at least $500 or $600 a night,? Atkinson said. ?That?s about $17,000 for the week. And they don?t even have a kitchen or a view of the High Line!?

Maybe he?s on to something. Football-crazy tourists hoping to stay in hotels for Super Bowl XLVIII will encounter jacked-up rates.

The Holland Hotel in Jersey City ? which is about as pretty as the tunnel ? is charging $400 a night, four times its normal rate. The high-end W in Hoboken wants $619 and up ? and it?s already booked. And rooms at the Marriott Marquis in Times Square are going for $499 to $699 ? twice what midtown hotels would typically charge during the winter off-season, said hotel consultant John Fox. ?Occupancy that week is likely to approximate 100% for hotels in midtown,? Fox said.

But there?ll be no shortage of places to crash on both sides of the East River ? some with choice amenities.

Wandy Paul, a Jersey City resident rents the upstairs of her family's house to tourists.

John Driscoll is offering his four-bedroom split-level in West Orange, N.J., for $2,400 a night.

The owner of a car service in Ridgewood, N.J., wants $30,000 for his seven-bedroom McMansion for the week ? including two limos to the game 20 minutes away.

Wendy Taul will be raising the rates of her Jersey City rowhouse the week of the game from her usual $149 a night to $375 a night.

Tony, who lives in midtown and didn?t want to give his last name for fear of angering his landlord, didn?t plan to raise the rate ? $150 a night ? he typically charges through AirBnB for a bedroom in his railroad apartment in midtown. ?When I saw everything they?ve got planned for Times Square, and knowing I?m right next to both the Port Authority and the Holland Tunnel, I figured it was pretty unbeatable,? Tony said.

In many cases the e-hotel arrangement is illegal in New York City thanks to a 2010 law cracking down on short-term rentals.

The law was quarterbacked by state Sen. Liz Krueger (D-Manhattan), who sought to protect neighbors from strangers and tourists from scammers and discourage landlords from converting buildings into unregulated hotels. She alleges that more than half of all AirBnB listings violate her law.

?Super Bowl tickets are extraordinarily costly,? Krueger said. ?Don?t put an already expensive trip at risk by making a reservation for a private residence in an apartment building, sight unseen.?

But AirBnB calls interference on Krueger for standing in the way of progress, saying thousands of guests visited the London Olympics, yielding nary a complaint.

WASHINGTON, Aug. 27 (UPI) -- The IRS said Tuesday it has set the penalty Americans will have to pay for not getting health insurance under the Affordable Care Act, or Obamacare.

Under the so-called individual mandate, beginning Jan. 14, the charge for not obtaining health insurance will be $95 or 1 percent of household income, whichever is larger, The Hill reported. The penalty will increase to $695 per person, or 2.5 percent of household income, in 2016, the Washington publication said. There will be a cost-of-living formula for future years.

Not everyone without insurance would be hit with the penalty, which the IRS calls a "shared responsibility payment," The Hill said. People who qualify for Medicaid coverage but reside in states that aren't taking part in the law's expanded Medicaid will be exempt, as will those who are temporarily uninsured while between jobs, those opposed to having insurance coverage for religious reasons or members of Indian tribes.

"Today's rules ensure that millions more Americans will be able to get quality health care coverage at an affordable price, that provides health security for their families and bans discrimination against people with pre-existing conditions once and for all," a Treasury Department representative said in a statement received by The Hill.

Supporters say the mandatory participation is necessary to make the system sustainable, while detractors oppose being forced to participate.

I am also trying to find out about this - particularly the costs as my family will be forced to buy their own insurance come October.

There is an estimate calculator that can give you a ballpark of what you're expected to pay, and what your subsidy will be.

Just for an example, a family of four, non-smoking, with two parents who are 35, making a combined income of $75K will pay:

$11,209 per year for insurance under the SILVER plan

Their subsidy could be about $4,084

Which means their premium payment would be $7,125 per year or about $594.00 per month.

This is not counting the out-of-pocket - your out-of-pocket maximum for a Silver plan (not including the premium) can be no more than $12,700.

According to the site, The BRONZE plan - the bottom of the tier plan is noted as costing "about $5,206 per year (which is 6.94% of your household income, after taking into account $4,084 in subsidies). For most people, the Bronze plan represents the minimum level of coverage required under health reform. Although you would pay less in premiums by enrolling in a Bronze plan, you will face higher out-of-pocket costs than if you enrolled in a Silver plan."

Cory Booker's campaign says a rally featuring Chicago Mayor Rahm Emanuel in Jersey City has been canceled.

No reason was given.

But Chicago was the scene of a late-night shooting Thursday that left 13 people wounded, including a 3-year-old.

Booker's campaign earlier told The Star-Ledger the Democratic candidate for U.S. Senate would not be at the rally. Booker instead will be in San Francisco today at a fundraiser held by the "San Francisco Young Professionals for Cory Booker."

Emanuel and Jersey City Mayor Steven Fulop were scheduled to headline the event near the Grove Street PATH station.

Police Investigate 'Suspicious Deaths' at 233 1/2 Palisade Ave. in Heights

Two bodies have just been brought out of a Jersey City Heights home where a "suspicious death'' was reported earlier this morning.

Police and representatives of the state Medical Examiner's office have been going in and out of 233-1/2 Palisade Ave. all morning, neighbors say, with one official having come out at one point with blood on his feet.

The bodies are believed to have been in the basement apartment.

According to the building superintendent and other neighbors, the couple in the apartment were a young couple, probably in their mid-20s, who moved in several months ago and fought often.

Superintendent Louis Gonzalez, who lives in the unit next to the couple's, said the couple had been fixing up the apartment but that he'd recently seen the man sleeping outside of the apartment door with his clothes.

Lisa Ross, who lives two houses away, said she had seen the man sleeping outside several times and said he'd once told her that the woman was trying to kick him out.

Gonzalez said he didn't hear anything this morning and was awakened by a representative of the state Medical Examiner's office knocking on his door.

Jersey Journal calls to the Hudson County Prosecutor's Office have not yet been returned.

According to radio dispatches, a "suspicious death'' was reported at the address just before 9 a.m.

Kathleen McCrea, who lives across the street, said officials were already at the scene when she looked out around 8:30 a.m

Don't know if there is any validity to this trick - but it worked for me. I set the old-fashioned traps and the sticky ones against a right angle so that one corner of the trap is snug at two solid points in an "L" (like the end of counter wall). The little critters run along the walls and floors with a wall to their side so apparently this is a good way to trap them. Mice love chocolate by the way.

The glue traps are good for under the stove, fridge and dishwasher areas...mice like these areas for the warmth.

I once lived in a condo with a mouse issue. We couldn't figure out where they were coming in from until we pulled out the dishwasher and stove and discovered the huge holes in the walls that the mice were using to get in. We did the steel wool trick mentioned below - it worked quite well!

What's truly sad (for him) is that his classmates did elect him as Vice President in the same election - a fine activity for any transcript. Would he have won this position even without the texts? I cannot say. His Google profile listed several activities and honors - he seemed like a good kid under the influence of some very poor decisions/ideologies.

And what happens to the next kid who really goes through something like this? They lie in the wake of this farce - a "boy who cried wolf" perception that puts the burden of proof on a victim deserving of justice.
