4:19-16. Liability of owner regardless of viciousness of dog
The owner of any dog which shall bite a person while such person is on or in a public place, or lawfully on or in a private place, including the property of the owner of the dog, shall be liable for such damages as may be suffered by the person bitten, regardless of the former viciousness of such dog or the owner's knowledge of such viciousness.

For the purpose of this section, a person is lawfully upon the private property of such owner when he is on the property in the performance of any duty imposed upon him by the laws of this state or the laws or postal regulations of the United States, or when he is on such property upon the invitation, express or implied, of the owner thereof.





4:19-19. Impoundment of dog
An animal control officer shall seize and impound a dog when the officer has reasonable cause to believe that the dog:

a. attacked a person and caused death or serious bodily injury as defined in N.J.S.2C:11-1(b) to that person;

b. caused bodily injury as defined in N.J.S.2C:11-1(a) to a person during an unprovoked attack and poses a serious threat of harm to persons or domestic animals;

c. engaged in dog fighting activities as described in R.S.4:22-24 and R.S.4:22-26; or

d. has been trained, tormented, badgered, baited or encouraged to engage in unprovoked attacks upon persons or domestic animals.



The dog shall be impounded until the final disposition as to whether the dog is vicious or potentially dangerous. Subject to the approval of the municipal health officer, the dog may be impounded in a facility or other structure agreeable to the owner.




4:19-22. Dog declared vicious by municipal court; conditions
6. a. The municipal court shall declare the dog vicious if it finds by clear and convincing evidence that the dog:

(1) killed a person or caused serious bodily injury as defined in N.J.S.2C:11-1(b) to a person; or

(2) has engaged in dog fighting activities as described in R.S.4:22-24 and R.S.4:22-26.

b. A dog shall not be declared vicious for inflicting death or serious bodily injury as defined in N.J.S.2C:11-1(b) upon a person if the dog was provoked. The municipality shall bear the burden of proof to demonstrate that the dog was not provoked.

c. If the municipal court declares a dog to be vicious, and no appeal is made of this ruling pursuant to section 9 of P.L.1989, c.307 (C.4:19-25), the dog shall be destroyed in a humane and expeditious manner, except that no dog may be destroyed during the pendency of an appeal.

Shaking in my boots tough guy! If my dog walker brought my fragile/aggressive dog into an environment where they might be provoked, I would say they were incompetent and might be better served in a line of work with less thought required...just a heads up.

Actually, "Horse" (straight from the mouth? )as long as you vote for Carol Lester and Sterling Waterman I don't care if you vote for Angel. However, posted below is part of your answer regarding Angel:

Mr. Valentin did not vote to cut 373 teachers. Mr. Valentin is cutting extraneous positions and trying to keep JC's budget in check by making sure that the teachers we are paying are actually teaching kids, not hanging out at Central Office.


It seems that Mr. Valentin has a much better "sense"
of fiscal managment than either McCann or Dehere.

While not color coded, there are already ratings for the risks in securities down by private firms like Moody's and S&P. I don't think the government getting involved in taking that role is even on the table. Perhaps the CPA would if implemented, but I doubt they would rate anything except in the most general sense (stock = risky, tbills = safe).

Less regulation. well regardless of the time of day, i will not hesitate to kick your dog as a last resort to keep it away from either the fragile or dog aggressive dogs i sometimes walk. i will feel terrible for the dog and probably say something less than nice to you. just a heads up.

crowd is pretty mixed. laid back. i'd say mainly late 20's to mid 30's. i havent been there in a while but it was never packed. close to full though.

It's amazing that this place isn't up to speed as of yet. wasn't it summer of 2009 when it had it's "soft opening" ?

I'd like to go there, but it's hard to plan on going if you're not sure it's going to in fact be open.

How is the crowd on the weekends?

today I was walking behind a guy who blatantly threw his hamburger wrapper on the sidewalk, ten feet away from a trash can. he didn't get a ticket, so I guess he's not a douchebag.

Went out for a walk yesterday and noticed on 2 front doors and on a car on my block TP in big black letters was spray painted.

Then today I saw it on some doors on Grand Street

WTF???

I was just shown your Website so I appologize for this last minute response. My name is Gerald Lyons and I am running for the Jersey City Board of Education. I am not backed by any political party or organization so I am listed as an Independent. I teach at County Prep High School on Montgomery Street. This is my 23rd year with the district. I have five teaching certifications (vocational, academic, online, Supervisor of Instruction and Media Specialist), a master's and an additional 100 credits. I have won Teacher of the Year for my district twice and was honored by the Jersey Journal as an Everyday Hero in Education in 2006. I am a devoted teacher who still enjoys my job. I would like to bring my years of experience and my education to the Board of Ed. I think it is important to have someone who is in the classroom present when the Board is discussing policies that affect the students of Jersey City. the bottom line is that people let their dogs off leash in MP all the time and JCPD does nothing about it (or LSP police, since technically it is their jurisdiction too.) So if no one is handing out tickets, what is to stop everyone form doing it... nothing.

That said, I reiterate again, that LSP should seriously consider adopting off leash dog hours throughout the entire park. It is an even compromise.

Additionally, as to neonoora's comment about the nice weather bringing more people out.... I feel they are right on as well. Simply put, there are a lot of lazy dog owners out there. And you never see these people out for more than a pee and poop with their dogs when it's raining, snowing, sleeting or below freezing out. We too take our dog out in all weather conditions to make sure he has enough exercise.

And on another note, to me the off leash dogs in MP are a lot less of an issue than the off leash dogs on the marina walkway in Paulus Hook. These people have A LOT of nerve. At least in the park most people try to keep the dogs towards the end of the park and away from where kids are playing. The park has some flexibility for off leash dogs to share space with kids, adults, etc. but the walkway is a busier environment and is not meant for dogs to be off leash. I guarantee you if some biker or rollerblader ran into to one of these off leash dogs on the walkway, the dog owner's would through a hissy fit.

Are we talking about the same Dehere? He did improve his talk on Thursday but I was at PS#16 (Paulus Hook) the prior Tuesday where Dehere was awful, shouting out bromides as solutions to real problems particularly financial and promising that when McCann gets re-elected (LOL!)he would make McCann the head of finances and McCann said he'd make Dehere the President of school board.

No one seriously considers Dehere coherent to vote him back onto the school board. However you can see his and McCann's flyers illegally slapped up on fences in the Heights and at 5 Corners in JC.

Read the Jersey City Independent for what various candidates have said in their interviews if elected to school board.

There isn't, at the moment. The Obama administration is working on regulations but there is a fine line when it comes to how much regulation is too much.

Risk is one thing, fraud is another. People know there are risks but assume there is enough regulation to protect them from all out fraud i.e. the fraudulent AAA ratings given to these garbage securities being marketed by Goldman and other fraudsters. They knew they were garbage, that's why they were betting heavily against them. I'm in favor of better more effective regulation, not more.

stani - both. The lawmakers rushed to get the bailout package passed and did not even think to put in restrictions.

Most of the banks have already repaid the bailout funds - with interest. I do think the banks should be on the hook for AIG but again - the government passed the package without specifying any of this.

Without clients, these banks wouldn't be in business. Which is why you cannot solely blame banks, or call these bankers thieves. People still have an appetite for risk or most of the funds available today would no longer exist.

Question to those in this forum... Do you support more government regulation over the financial services industry, or less?

In all of these examples, the govt's actions were explicitly designed to help the financial industry. To paraphrase you, the govt wanted the financial industry to "steal" from taxpayers. So who should taxpayers blame for this, the financial industry or the govt?
